SAN DIEGO (CNS) - The caregiver for a 74-year-old man who died in her care and another senior who were both involuntarily locked away at her various San Diego residences was sentenced Friday to 13 years in state prison.Shirley Montano, 53, pleaded guilty earlier this year to charges of voluntary manslaughter, false imprisonment of a dependent adult and perjury.A murder charge stemming from the death of Robert Chagas was dropped under the plea agreement.RELATED: Woman to stand trial for senior's death, abuse of elderly womanProsecutors alleged the defendant withheld food from Chagas and Josefina Kellogg, 61, causing their health to deteriorate over the course of several years, during which she moved often and relocated them, as well.Chagas died Oct. 7, 2016, at Sharp Memorial Hospital of pneumonia, which prosecutors argued was exacerbated by severe malnutrition he suffered under Montano's care.While the victims lived with Montano, she used their social security checks and other government benefits to buy herself a truck, among other personal purchases, and gambled away their money at local casinos, according to prosecutors.Testimony from Montano's 2019 preliminary hearing indicated Chagas and Kellogg were kept isolated from others and were confined to their respective bedrooms. Montano's niece, who stayed with her for about a year, testified that for the first month she lived at her aunt's apartment, she was not even aware Kellogg existed because the woman would hardly ever emerge from her bedroom.RELATED: La Jolla man arrested for assaulting elderly woman in Morro Bay, police sayOthers who resided at Montano's apartment or visited were offered various explanations for the presence of the victims, according to testimony.Kellogg testified that she stayed in her bedroom for several hours each day and feared angering Montano, who would hit her if she did not obey the rules of the house.Chagas was "emaciated" when he was brought into the hospital, where he died five days later, prosecutors said.RELATED: Woman sentenced for defrauding 86-year-old auntAt the hospital, Montano posed as Chagas' niece and told medical personnel that he did not wish to be resuscitated, according to testimony. Chagas' family members were only notified of his hospitalization after his death, they testified.Montano's attorney, Shannon Sebeckis, argued at the preliminary hearing there was no evidence that Chagas' malnutrition was caused by her client, and instead was the natural result of aging.Sebeckis reiterated the testimony of San Diego County Chief Medical Examiner Glenn Wagner, who declined to classify Chagas' death as a homicide. Wagner said Chagas was not getting sufficient food, but could not opine as to why, only that it appeared to be due to non-medical factors.No calls were made by family or medical professionals to Adult Protective Services in Chagas' case, which also contributed to Wagner's opinion not to classify his death as a homicide, the doctor said.While evidence was presented that Chagas once told a doctor that his weight loss was due to not having enough money for food, Sebeckis said that was not proof that Montano was taking his money or withholding food, especially in light of Chagas' issues with handling his own finances.Chagas' family members testified that an accident that occurred at childbirth had left him "slow," as his brother Richard described it, and that throughout his adult life, Chagas was susceptible to being scammed and had lost exorbitant amounts of money to fraudsters, leading family members to take an active role in assisting him with taxes and paying bills.Sebeckis argued there was little direct evidence that Montano didn't feed the seniors, as past roommates said they had seen her providing food for Chagas and Kellogg. The attorney also said Chagas was not confined at all, and regularly left the apartment each day for his janitorial job at Sea World, which he attended with a sack lunch prepared by Montano each day.The defense attorney also said it was "pure speculation and conjecture" that Montano didn't use the seniors' funds to pay for their basic needs. 4151

SAN DIEGO (CNS) - Sales of previously owned single-family homes and attached properties like condominiums and townhomes both fell more than 15 percent from October to November, according to data released Friday by the Greater San Diego Association of Realtors. Single-family home sales fell from 1,719 in October to 1,452 in November, a 15.5 percent drop. Attached property sales suffered an even steeper drop, falling 22.8 percent from 942 in October to 727 in November. Home sales have trended down in the second half of the year since the high water mark of more than 2,200 single-family homes and nearly 1,200 attached properties sold in June.Month-over-month home prices also fell from October to November, albeit not as drastically. Single-family home prices dropped 1.4 percent from 3,700 to 5,000, while attached property prices fell 5 percent -- from 8,000 to 7,000. Prices of single-family and attached properties have remained steady for most of the year, according to the GSDAR.``The end of the year and the holiday season are usually a sluggish time for home sale activity,'' said SDAR President Steve Fraioli. ``But it does appear that the pace of home price growth has slowed. Buyers should keep watch for price reductions on homes they want for Christmas.'' Year-over-year single-family home sales fell 19.4 percent, from 1,802 in November 2017 to 1,452 last month. Attached property sales likewise fell 20.3 percent, from 912 to 727.Median prices for single-family homes ticked up slightly, increasing 1.6 percent from 5,000 in November 2017 to 5,000 last month. SAN DIEGO (CNS) - San Diego City Attorney Mara Elliott was celebrating a reelection victory Wednesday, following a dominant performance over private attorney Cory Briggs."When I was elected four years ago, I pledged to put the people of San Diego first, and that's just what we've done," Elliott said in a statement Tuesday night claiming victory in the race."With the help of our terrific team in the City Attorney's office, San Diego is a leader in reducing gun violence, helping domestic violence victims, and holding corporate polluters accountable. We moved quickly to protect public health during the pandemic and we've made it a priority to safeguard taxpayer dollars. I'm humbled and grateful that the people of San Diego have placed their trust in me to fight for them for another term."Elliott has been city attorney since 2016, and since then has taken an uncharacteristically proactive approach to the role, sometimes ruffling feathers, such as with the Smart Streetlights program. In August, members of the San Diego City Council boycotted a meeting with Elliott over restrictions on sensitive documents.Briggs has sued the city dozens of times, ostensibly to increase transparency at City Hall. He said during the campaign he wanted to remove petty politics from the office."As someone who has spent nearly two decades fighting special interests at City Hall, I believe now's the time to bring my training, experience and taxpayers-first approach to the City Attorney's Office," he said.Elliott pointed to Briggs' many lawsuits as reasons she is more fit for the office.The pair have faced off in court during the election cycle. Elliot sued Briggs for identifying himself as a taxpayers' advocate, while Briggs sued Elliot for claiming an endorsement from the San Diego Union-Tribune after it expired. Briggs prevailed in both cases.The city attorney serves as the city's prosecutor and legal adviser.Meanwhile, San Diego voters weighed in on a trio of ballot measures:-- Voters rejected Measure A, a housing bond that would have allowed the city to issue up to 0 million in bonds to fund low-income, substance abuse, and mental health service housing. It required two-thirds of the vote to pass, but initial tallies showed it with only 57%.-- Voters approved Measure B, which amends the city's charter to replace the Community Review Board on Police Practices with the Commission on Police Practices, which will be appointed by the City Council to conduct investigations and subpoena witnesses and documents related to deaths resulting from police interactions and complaints made against police officers.-- Voters also approved Measure E, providing an exception to the city's long-standing 30-foot height limit in the Coastal Zone for the Midway- Pacific Highway Community Plan. SAN DIEGO (CNS) - The San Diego City Council voted 5-4 today to extend the rent repayment period for commercial and residential renters to Dec. 30, giving renters who have lost income due to the COVID-19 pandemic a few extra months to repay back rent.Council President Georgette Gomez's initial motion Tuesday would have extended the repayment period for the eviction moratorium to March 31, 2021. Councilwoman Jennifer Campbell amended the motion to the December date as a compromise.On March 25, the council voted unanimously to begin an emergency eviction moratorium for renters. The moratorium requires renters to demonstrate through documentation that the pandemic has caused ``substantial loss of income,'' according to city staff. Renters are also required to follow rules in leases, but landlords cannot evict a tenant for nonpayment due to COVID-19.The moratorium expires Sept. 30. If tenants are in good standing with landlords, they can work out a repayment plan for back rent through Dec. 30, but otherwise things could get dicey for tenants.``We are all in it together,'' Gomez said before discussion of the motion. ``The economy is not fully restored. This is not an ideal policy, but it's a necessity for what we are dealing with.''Gomez represents District 9, which encompasses Southcrest, City Heights, Rolando and the College area. It has also been one of the most impacted areas during the pandemic.According to a member of Gomez' staff -- which gave the presentation on the topic -- the city had started 15,659 rental relief applications using federal Coronavirus Aid, Relief, and Economic Security Act funds. Disbursements from that pool of relief money are scheduled to be handed out in late August or early September. Those funds will go directly to landlords, however, and not renters.Council President Pro Tem Barbara Bry voted no on the motion Tuesday, not because she didn't agree that people needed help paying rent, but because the arbitrary nature of the rental relief program could leave the city open for lawsuits, she said. She added that not enough renters know the impact of not paying rent.``It's a cruel hoax,'' she said. Bry said that by not paying rent on time, tenants could be destroying their credit and leaving themselves with mountains of debt and no place to turn once the moratorium ends.In a public comment period, several dozen San Diegans called in, many urging the council to extend the moratorium -- which was not the motion in front of council -- and many to forgive rent and mortgages outright. About an equal number of landlords called in to urge the council to allow for evictions again, as many said they were paying two mortgages and not receiving income.The repayment plan extension to December will pass a critical few months, including local, state and national elections. On Nov. 3, San Diego voters will select a new mayor and five new members of its City Council -- something that could cause significant shakeup in how the city is run.``I think in three more months we will be able to tell better what the future holds,'' Campbell said. Councilmembers Chris Cate and Scott Sherman were opposed to the extension on legal grounds, as the gap between when the moratorium was passed to the date proposed in Tuesday's initial motion would have been more than a year. They claimed this could cause trouble for landlords trying to evict delinquent tenants or to collect back rent.Because the repayment extension passed with just five votes, it is susceptible to a possible veto by Mayor Kevin Faulconer.
