INDIANAPOLIS — A homeless man was rescued from the back of a garbage truck near Indianapolis early Thursday.According to a report from the Decatur Township Fire Department, rescue crews were called shortly before 8 a.m. Thursday for an injured person.When they arrived, firefighters found an injured person inside the back of a garbage truck.Firefighters said the driver of the trash truck told them he had made two previous stops along Kentucky Avenue, reached his third stop and started the compactor without knowing someone was in the back. The driver told firefighters he heard a man yelling and immediately stopped the compactor and called 911.Firefighters said the man was extricated from the back of the garbage truck within 30 minutes and was taken to an area hospital with serious injuries.According to firefighters, the man in the back of the garbage truck told rescue crews he was in the dumpster to stay warm because he was homeless. New NYPD training videos released Wednesday clearly show officers what they can and cannot do when taking a suspect into custody,But sometimes that training does not translate in real life. There's already there’s a law on the books banning officers from putting people in chokeholds, but the city council wants to take things a step further, banning officers from applying pressure or restricting a suspect's diaphragm.“It’s tough right now to be a police officer," said NYPD Chief of Department Terence Monahan. "You have to worry that if a suspect shot at you and you put a knee on his back, that now you become the criminal.”Monahan said these new rules have his officers fighting crime with their hands tied behind their backs.Those in favor say that officers are merely being given a script telling them how to behave in a critical incident. However, there are still those that argue that the city council does not have expertise in police tactics.Even so, the NYPD argues every encounter is different and a blanket law is not the answer. Peak flu season is starting now, and doctors say to get ready for a potentially extended season. This year’s flu season has been rough, with the CDC reporting the flu is widespread in 24 states, with 19 states reporting high levels of flu activity. That's more than double the activity of the previous week. A total of 13 children have died so far this flu season. Doctors say it could get worse. “Flu activity has taken off our projection is that it's going to continue to increase, probably for the next few months,” says Dr. Andrew Walshak with Presbyterian/ St. Luke’s Medical Center. Dr. Walshak says he expects to see more flu cases around the country. “The graph of flu activity in our hospital is just increasing,” he explains. “It's just a slow upward, so we're only at the beginning of flu season right now.” Everyone is at risk: your family, friends, neighbors and co-workers. “It can really affect the lungs and affect our ability to get oxygen in our bodies, and that's what primarily the fatalities have been caused by his severe breathing problems,” he says. Dr. Walshak says it's not too late to get the flu shot. Vaccines protect against multiple flu strains. “So, just because one strain of flu is circulating in the community doesn't mean that another strain of flu won't circulate later in the flu season,” Dr. Walshak says. “So, I tell patients it's never too late to get your flu shot.” An estimated 80,000 people died during the 2017-2018 flu season, according to the CDC. 1513

Kyle Rittenhouse's attorney has filed a motion to dismiss two charges late Tuesday.According to court records, they seek to dismiss Possession of a Dangerous Weapon by a Person Under 18, and First Degree Recklessly Endangering Safety, Use of a Dangerous Weapon.Rittenhouse is facing a total of six charges, including two counts of 1st-Degree Reckless Homicide after prosecutors say he shot and killed two people and wounded a third during protests in Kenosha.Attorney Mark Richards argues in Tuesday's filing that possession of a dangerous weapon by a person under 18 should be dismissed because "the complaint [filed against Rittenhouse] fails to allege facts which could allow a reasonable person to conclude that a crime was committed."In regard to first-degree recklessly endangering safety, Richards writes that "no reasonable person could find that this crime was ever committed. Thus, the criminal complaint is defective and Count 2 should be dismissed." PINELLAS COUNTY, Fla. — Millions of drivers received refunds on their car insurance after the pandemic forced a national shutdown. But the I-Team found out at least one major insurance carrier is asking to raise rates for drivers across Florida.Pinellas County resident Robert Stickler and his wife started working from home after the pandemic shut down Florida in March. “My family hasn't been driving, the cars have been sitting," Stickler said.Their insurance carrier Geico and many other large auto insurers in the nation refunded drivers. The Sticklers were refunded 15 to 20 percent of premium costs after the pandemic delivered a drastic dip in accidents and claims. That credit was reflected on the Stickler family bill.Robert Stickler welcomed the refund but said they suffered sticker shock when Geico socked them with a 0 rate hike to their 6-month policy in June. The increase was approved by the state. “It was going to be over 4 a month for 3 older vehicles,” said Stickler.In a letter from Geico:"There are many factors that affect your insurance premium such as age, driving history, location and the increasing cost of vehicle repairs." But this driver says that explanation does not add up. “There had been no changes what-so-ever,” said Stickler.We reached out to Geico and have yet to hear back. The I-Team checked state records and found Geico petitioned the Florida Office of Insurance regulation between March and August for a separate rate hike of nearly 7 percent after the pandemic hit.Doug Heller is with the Consumer Federation of America, a watchdog group that called on Geico this past May to give back some of its profits the CFA claims the company raked in during the pandemic as drivers stayed off the road. “We are paying premiums as if the pandemic never happened,” said Heller.The I-Team reviewed second-quarter profit earnings for some of the nation’s largest insurance companies. We looked at overall profits which include their auto insurance and found Allstate, Progressive and Geico business shot up by hundreds of millions of dollars for the second quarter of this year compared to the second quarter of 2019.Geico's parent company reported to investors its 2020 overall insurance profits were, ”...largely attributable to unusually high earnings from Geico due to lower claims frequencies. These results are likely to be temporary…"Former Florida Deputy Insurance Commissioner Lisa Miller says there’s a state law that regulates how much insurance can profit. “We have very strict set of factors of what these insurance companies can profit," Miller said. No one is alleging that Geico or any other insurance company made an excessive profit. However, Miller says if state regulators find that any auto carrier made an excessive profit, customers could be refunded under a Florida law meant to protect consumers.The I-Team requested an interview with Florida's Insurance Commissioner David Altmaier. His spokesperson declined our request but said in a statement."OIR thoroughly reviews all filed auto insurance rates filings to ensure they comply with all applicable laws and are not excessive, inadequate, or unfairly discriminatory.
