Californians have voted to carve out specific gig workers from a state employment law about who is considered an employee and eligible for benefits.That means people who drive for Uber and Lyft will remain classified as independent contractors and will not be eligible for employee benefits.A California Supreme Court decision in 2018 created a strict test to decide whether a self-employed worker, like gig workers, should be considered employees.In response to the ruling, lawmakers amended Assembly Bill 5 in 2019 to add additional professions where services could be provided by independent contractors, and would not necessarily be employees. However, no changes were made for app-based companies like Lyft, Uber and DoorDash.The state law made app-based drivers employees, and would pay them for their time both while they are driving and they are waiting for a new ride, and offer employee benefits like paid sick leave and workers compensation for one-the-job injuries, the Los Angeles Times explains.Since the proposition has passed, drivers will remain categorized as independent contractors, although the proposition includes wording to require companies to provide an hourly wage for time spent driving equal to 120% of minimum wage. The language also gives drivers a stipend for purchasing health insurance coverage when their driving time averages at least 15 hours a week. However, only hours spent driving counts toward that total, not the time spent waiting between trips.Proposition 22 was launched and partially funded by Lyft and Uber. CHAPEL HILL, N.C. – The pandemic ignited a global fight against a fast-moving and deadly virus. “In the beginning, a lot of manufacturers shifted gears and started doing more COVID manufacturing," said Dr. Melissa Miller, a clinical lab director.Manufacturers began ramping up testing production and diverting supplies to combat the virus. But in the months ahead, laboratories started facing another threat due to a strained supply chain. Not only were labs facing shortages of supplies needed for COVID-19, but several other common illnesses. “Probably the biggest one was for sexually transmitted diseases, chlamydia, gonorrhea being the most common ones we diagnose in the labs," said Dr. Miller. The American Society for Microbiology (ASM) partnered with the Association of Supply Chain Management to track shortages across the country. ASM leaders say the data collection tool provides a near real-time visualization into the capacity, utilization, and resources necessary to meet consumer and patient demand for testing.“It was a bit of a surprise of how overwhelming it was throughout the country and that there weren’t just hot spots; it really indicated that this was a major national issue," said Dr. Miller. “The first week of the survey, almost 90% of the laboratories that responded reported a shortage of tests for STI’s.”Dr. Miller has a leadership role within ASM and has also been experiencing shortages in the lab firsthand."It’s a guessing game. Many times we don’t know when the next shipment is coming for some of the items we’re short on," said Dr. Miller. Since September, 134 CLIA-certified labs have responded to the survey, which is updated every week. Dr. Miller says the figure for STI testing supplies has improved but is still too high around 50%. And she says 47% of labs have a shortage of non-COVID-19 testing supplies to detect routine bacteria, including the bacteria that cause strep throat, pneumonia, bronchitis, and urinary tract infections."Since June, I have been worried about this exact moment," said Dr. Miller. “You have the COVID surge, the upcoming holidays, and the winter season, and you have respiratory season."The survey also showed 74% of labs have a shortage of commercial testing kits for COVID-19.She says the hope is to include more labs in the weekly survey to get a clearer picture of the supply chain issues.“Data is power; we need the data that this is a problem. And getting some federal action on this, I think, is critical," said Dr. Miller. CARLSBAD, Calif. (KGTV) - Hundreds of people packed into a classroom in Carlsbad Wednesday night, concerned about community safety in the wake of a brutal murder. More than 200 people showed up. Many were forced to listen from the hallway because the room was so crowded. “We don’t feel as safe as we used to,” said Carlsbad resident Charlie Christenson about why he came to the meeting. “I thought it was great to have the forum,” he added. It came more than a week after 64-year-old Marj Gawitt was stabbed to death in her home on Outrigger Lane, a development overlooking the Agua Hedionda Lagoon. Two transients were arrested and charged in the murder. Prosecutors say Gawitt was stabbed 50 times and tortured. Still, she managed to call 911 herself and alert police about her assailants. “I’ve been a police officer in Carlsbad for over 28 years, and to my knowledge this is the firs time in that particular community a crime like that has happened,” said Carlsbad police Chief Neil Gallucci. For two hours, Gallucci and other top police officials fielded questions from residents about the murder and the lingering safety concerns it has brought about.Christenson said he came to ask the chief one question. “I asked him if there were any changes to outreach or enforcement in response to this issue and he said no,” said Christenson. “That was disappointing.” But Gallucci said the meeting itself was necessary to get a feel for the issues. “I think having this meeting was a big step forward,” he said.
