SAN DIEGO (KGTV) -- A second lawsuit has been filed by family members of a mother and daughter killed by a YouTube star in a deadly wrong-way crash last year.18-year-old Trevor Heitmann, known as McSkillet on YouTube, drove his McLaren the wrong way on I-805 in August 2018. The crash killed Aileen Pizarro and her 12-year-old daughter Aryana. This latest lawsuit was filed August 22nd by Angelo Pizarro and Arcelio Garcia. Pizarro is one of the sons of Aileen Pizarro. Garcia is the father of Aryana. A lawsuit earlier this summer was filed by Aileen Pizarro's other son, Dominic, and her father. The lawsuit claims wrongful death and negligence by the City of San Diego and the County of San Diego. The family is also suing Heitmann’s estate. It states that San Diego police received a “mental case” call that Heitmann was “screaming, paranoid and delusional and threatening to harm his mom.”Police were advised by a licensed psychiatrist that Heitmann needed to be “possibly placed on a 5150 mental hold,” according to court records. However, officers did not speak to or evaluate Heitmann to determine if he was a danger to himself or others. The lawsuit also states that “one or more of the Police Officers represented or implied that they were part of a San Diego County Psychiatric Emergency Team.”Team 10 reached out to both county and city officials. As of Wednesday afternoon, there was no comment regarding the lawsuit from the city. A county spokesperson said they have not seen the lawsuit yet. Cynthia Chihak, the attorney for Pizarro and Garcia, sent Team 10 a statement which reads in part:"I am privileged to represent Angelo Pizarro, the son of Aileen Pizarro, and Arcelio Garcia, the father and sole heir of twelve year old Aryana Pizarro, who were killed on August 23, 2018 when their car was struck head-on by a McLaren automobile driven by Trevor Heitmann... This family is not excusing Mr. Heitmann’ s reckless behavior, but believe this tragic loss of three lives could have been prevented if the City of San Diego has taken seriously earlier reports of his violent and dangerous behavior. The loss suffered by this young man Angelo, of his mother and sister and the loss to Mr. Garcia of his daughter can never be rectified. SAN DIEGO (KGTV) - A woman struck by a hit-and-run driver on a Logan Heights street suffered life-threatening injuries Friday, San Diego Police said. The crash happened about 11 a.m. in the 700 block of Cesar Chavez Parkway at Kearney Avenue. A white Ford F-150 pickup truck was driving west and struck a woman also heading west on the north sidewalk, police said. The truck made a right turn onto Kearney Avenue and struck the woman. The driver did not stop to help the woman and continued north on Kearney Avenue, according to investigators. The 52-year-old victim suffered major head trauma. Police said the truck had a tinted back window and a white California sticker. Anyone with information can call the San Diego Police Department. 747

SAN DIEGO (KGTV) -- A stunning photo of a female surfer riding the waves was taken at sunset in Cardiff, and the photographer who took the image is hoping to find her.Los Angeles-based photographer Robin Kerr is inspired by nature. She has been taking nature and wildlife photos since she was a child.“My dad lent me his camera on our family vacation to Montana in 1989, ever since then I’ve had the bug,” said Kerr.Kerr said she had visited some amazing places to take photos, but her trip to San Diego in 2018 is one of her favorites.“I took a trip down to the San Diego Zoo Safari Park to see all of the wildlife there," said Kerr. “It had rained on and off all day. I was thinking it might be a really great sunset, something dramatic with the clouds.”Kerr made her way to Cardiff just before it got too dark to snap pictures of the beach. At that moment, she took a stunning photo of a female surfer gliding on the water, in front of a golden sunset.“You can tell she’s just experiencing so much joy in the photo, doing what she loves," Kerr told ABC 10News.Kerr said while taking photos of other objects on the beach, she missed meeting the surfer. She posted the picture, and another zoomed-in image of the woman on her social media accounts, hoping to find her. She had no luck. Nearly two years later, she is resuming her search.“I came across that picture again; I thought man it would be so great to actually find her," Kerr said.Kerr said she has not been able to retake a photo like this. SAN DIEGO (KGTV) — A Scripps Ranch woman who contacted Team 10 about problems with her Samsung refrigerator is now receiving a full refund after Team 10’s story aired.Stephanie Nivinskus bought her Samsung french door refrigerator in December 2014. It cost her nearly ,000. She said she had issues roughly six months after she bought it. "It's been a headache since the beginning," Nivinskus told Team 10 in September.The first problem was the ice maker does not function properly, according to Nivinskus."The ice just gathers and collects up there. It makes it so it doesn't work," Nivinskus said.She also has issues with the temperature of the refrigerator. The FDA says a safe temperature inside a refrigerator is 40 degrees or below. During the initial interview with Team 10, the thermometer inside of Nivinskus' refrigerator read about 56 degrees."Having spoiled food is a real problem," she said.
