SAN DIEGO, Calif. (KGTV) – A prominent harbor cruise company is continuing to operate despite being cited for violating a County health order. Tuesday afternoon, 10News took video of Flagship Cruises & Events taking passengers aboard for bay tours even after the company was cited by San Diego Harbor Police over the holiday weekend for violating the County's health order 14C which bans recreational boating unless all the passengers are from the same household. Tuesday, a company spokesperson sent the following statement to 10News.“We are part of the Passenger Vessel Association, not recreational boating. They are classifying us under a charter business which is still banned. We DO have a charter business but are not operating any charters at this time. Only public tours and maintaining all safety guidelines set by the city & CDC. We didn’t receive a cease & desist, and will continue to operate our harbor tours & patriot jet boat this week. We open up our dining cruises starting this Friday with Hops on the Harbor – pairing with local brewery, Pizza Port.”Monday night, the company told 10News it's part 14E of the County health order, not 14C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."During Tuesday’s County press conference, Supervisor Nathan Fletcher told 10News, “The rental items that they're alluding [are for] individual use type things like a bicycle or a kayak or a surfboard and so they are not covered under the current public health order,” and added, “If they continue to operate, they are going to continue to be cited.”Harbor Police say the citation comes with a fine of up to ,000 and up to a year in jail. Harbor Police say they're documenting each sail the company is doing and incorporating those into the original citation that it sent to the City Attorney's Office. 2046

(KGTV) Firefighters continue to mop up after the Valley Fire tore through Lawson Valley, burning 17,665 acres.Messages of gratitude for the crews on the frontlines can be seen throughout the area.At least 30 homes and 31 minor structures were destroyed, but all evacuation orders and road closures were lifted on Friday.In much of the burn area, firetrucks have been replaced with utility vehicles.“I watched the flames start coming over the mountain, like fingers, like some creature,” said Seth Matteson who lives in Lawson Valley.He left his home as the fire started to spread Sept. 5, fearing the worst, but was thankful to come home and find his house on Prairie Drive still standing.“In the back it came right up to the house, and in the front it came right up to the house,” he explained.Just down the road, several homes and vehicles burned in the fire.“I’ve been through 8 hurricanes, and this is way scarier to me than that. SAN DIEGO, Calif. (KGTV) -- An appeals court today overturned a ruling that would have allowed the conditional release of the “Bolder Than Most” rapist, Alvin Quarles. The ruling was issued by the 4th District Court of Appeals Monday. The court said, in part that “Quarles is a serial rapist whose crimes were shockingly brutal and destructive. If he fails after he is conditionally released, considering his past, we shudder to contemplate the consequences of such a failure.”After news broke of the reversal, Dianne Jacob, who serves on the San Diego County Board of Supervisors and has been adamantly against the release, spoke out on Twitter. We must continue to fight the placement of sexually violent predators into our communities,” Jacob said in part. The ruling comes after San Diego County Superior Court Judge David M. Gill's decision to release Quarles to a home somewhere in San Diego County. After his release, he would have undergone treatment through a conditional release program.Gill's ruling followed a series of closed-door hearings that involved testimony from psychiatrists and other experts. Quarles was dubbed the "Bolder Than Most" rapist due to the way he attacked his victims at knifepoint, sometimes forcing the women's husbands or boyfriends to watch. In 1989, he pleaded guilty to committing over a dozen sexual assaults in the mid-to-late 1980s. He was sentenced to 50 years in prison. SAN DIEGO (KGTV)- The fight continues fort tenants in Oak Park who say they soon won't be able to pay their rent if it continues to go up. The group met with the San Diego Housing Commission Friday morning. Many of the tenants are seniors living on a fixed income. Some of them say they've already seen their rent increased twice this year. "There doesn't seem to be any protections for people like us," says one of the tenants who spoke during Friday's board meeting. "We're on a fixed income; we get a two percent raise every year. My rent was raised by 50 percent."Olive Wood Gardens is a low-income housing complex for seniors and those who are disabled. Tenants say they are scared for their future. "I don't know what to do now," says Kathy Blackstock. "I don't think I can go back to homelessness."They're not only asking help from the San Diego Housing Commission; the tenants are hoping the state would pass Assembly Bill 1482. Last week, a rally was held outside of the complex in support of the bill. It would make it illegal for property owners to raise rents more than seven percent in one year. The Senate Committee is currently reviewing the bill. The San Diego Housing Commission board says they've referred the tenants' comments and information to the staff. They will work on making some progress before next month. 1342
