(KGTV) — The jury deciding former NFL star Kellen Winslow Jr.'s fate in a rape trial, sent a note to the judge asking two questions.The questions lending a window into what's happening as the jury continues deliberating.10News spoke with Defense Attorney Gretchen Von Helms, to gain insight.On the surface, the questions seem obvious: "The jurors could benefit from an explanation as to what being under oath means. Yes, you're supposed to follow the law," Von Helms said.She said the note made her think the jury was not agreeing, "the jury's trying to be nice here and say there's one person who just doesn't want to follow the rules, that's what it sounds like."The first question, she said, could indicate questions the jurors have, "sometimes police officers have to take an oath to be a police officer and maybe they feel that the police officer didn't do their job and follow up correctly or maybe they feel that their definition of that oath is different from the jurors oath."In regards to the second question, she said "the gut versus law issue, they must follow the law, even if they don't like the defendant, even though some people may not want to convict him because he's a football legacy, you can't do that. WARNING: This story contains content that is graphic in nature.LAND O' LAKES, Fla. -- A Pasco County, Florida deputy has been fired after he was arrested for touching a woman against her will and placing semen on her. Joseph Mercado, 25, has been charged with battery. The Pasco County Sheriff's Office has confirmed Mercado was terminated after he was arrested on February 28. Mercado and the victim were "NOT involved in an ongoing dating relationship at the time of this incident," according to the arrest affidavit.On February 15, 2018, while Mercado was off-duty, he arrived at the victim's home and told the victim they needed to discuss a "serious incident" that he witnessed. The victim met Mercado outside in the driveway and repeatedly asked him to leave. According to arrest documents, Mercado masturbated in front of the woman. She repeatedly told him to leave. Mercado then used his finger to place semen on the victim's breast, above the neckline of her shirt and then attempted to place it on the victim's lips, prior to her pulling away, according to the arrest affidavit. The victim continued to ask Mercado to leave and she went into her home until he left the property.Mercado was arrested on February 28th without incident.The Sheriff released a statement about the incident: "The Pasco Sheriff's Office ensures discipline is paramount in our organization. (KGTV) -- A man who detained two juveniles before taking their skateboards while posing as a sheriff’s deputy was sentenced Monday.  Abraham Joseph Nava, 24, was sentenced to three years of formal probation after pleading guilty in July to felony false imprisonment.In a separate case, Nava also admitted to calling in a false report of a bomb threat. Nava was given credit for 149 days in custody.RELATED: Guilty plea from man who posed as deputy, detained juveniles  He will have to comply with counseling conditions as required by the probation department, including a forensic examination to help determine what course of treatment to take, said Deputy District Attorney Peter Estes.Nava was arrested on June 14, several days after the sheriff’s department was contacted about a suspect claiming to be an undercover deputy.During interviews with several employees in the Main Street area of Vista, investigators learned that the suspect passed out fake business cards and was interacting with juveniles.Investigators also learned that the two juveniles were detained and had their skateboards taken. After identifying Nava as the suspect, investigators obtained a warrant to search his home where they discovered several pieces of San Diego County Sheriff’s Department uniform items, including badges.A box of fraudulent business cards was also found.
