Retired Supreme Court Justice John Paul Stevens believes the students and demonstrators who protested this past weekend for gun control should seek a repeal of the Second Amendment."A concern that a national standing army might pose a threat to the security of the separate states led to the adoption of that amendment," Stevens wrote an op-ed published in The New York Times Tuesday, adding, "today that concern is a relic of the 18th century."A lifelong Republican but considered liberal in his judicial rulings, Stevens pointed to his dissent in the 2008 landmark District of Columbia v. Heller case that the Second Amendment protects an individual's right to possess a firearm for self-defense within his home. 722

RIVERSIDE, Calif. (KGTV) -- One of the California Highway Patrol officers wounded during a shootout in Riverside Monday evening died and two others remain hospitalized Tuesday, according to the CHP.According to Riverside authorities, the shooting happened around 5:35 p.m. on the 215 Freeway near Box Springs Boulevard and Eastridge Avenue. CHP officer Andre Moye stopped the suspect driving a GMC pickup truck and then decided to impound the vehicle, officials said.RELATED: Cellphone video captures deadly officer-involved shooting in RiversideAs he was calling for a tow truck and filling out paperwork, the suspect entered the truck, grabbed a rifle and fired it at the officer, police say. Officer Moye was able to broadcast an "officer needs assistance" call.Of the first three officers on scene, two of them were immediately engaged, both of them were struck during a gun fire exchange, authorities said. One of them received major injuries to his leg and was taken to the hospital in critical condition. By Tuesday afternoon, “he was conscious and talking, in good spirits," said CHP Inland Chief Bill Dance. The other CHP officer received minor injuries to his leg.The suspect was killed in a shootout with a fourth CHP officer.Officer Moye was transported to Riverside County Medical Center in Moreno Valley and was pronounced dead, authorities said.“This incident shows just how dangerous the job of the California Highway Patrol and law enforcement is in general," said Dance.A "large contingent of security" was established at the hospital out of an "abundance of caution," said Riverside County Sheriff Chad Bianco.Tuesday, investigators continued the lengthy task of looking for evidence on the side of the 215 freeway."It was a long and horrific gun battle," said Riverside Police Chief Sergio Diaz. "And it resulted in a very extensive crime scene."In addition to the three CHP officers who were shot, police said a witness may have also been hit with something, but it doesn't appear to be gunfire. Video from the scene shows bullet holes in the front windshields of two CHP cars. During a news conference Tuesday, Diaz identified the gun used by the suspect only as a rifle, saying it had not yet been processed.KABC is reporting that family members of the suspected gunman identified him as Aaron Luther, a father of two from Beaumont in his late 40s.Watch the news conference in the player below: 2424

Running out of ideas to entertain your kids? A California writer and performer took his ideas, got crafty on Instagram and it has kids everywhere giggling. Avery Monsen took us behind the scenes of the "Super Secret Secret Club."Monsen has a lot of day jobs these days. He writes and illustrates books for children and adults, he's done some acting and he's been in commercials. But these days, Hollywood isn't doing much. One day a friend of his asked him to make a video to help entertain his own kids, who were quite literally climbing the walls.“He knows that I have this sort of grab bag of circus and magic tricks and skills that are very rarely actually useful in life, but they are useful in entertaining children,” said Monsen. And so, the Super Secret Secret Club was born. You can find it online, on Instagram or on Instagram TV, and it is full of good, clean fun.“It’s just a bunch of cardboard and duct tape, but there’s also all these strings that go everywhere we’re probably going to lose our security deposit on this place, whoops,” said Monsen. There's no market research about what kids like and Avery describes himself as a someone who is quite possibly still a kid.“I think I’m just making things that I like is the truth, and my taste is the taste of a 4 and 9-year-old. The things that I think are funny are the things a 4-year-old thinks are funny,” said Monsen. He also made activity pages for kids. There's puzzles and games and even a Super Secret Secret Club membership card.“I knew that kids were going to get bored and antsy in the quarantine times. I felt the least I could do is make some fun videos for them," said Monsen.Monsen isn't in it for the clicks, likes or comments. He's purely helping kids laugh, for free. And admittedly, he says, he needed a project and he happens to have a garage full of crafts as well as a huge paper maché pet rock named Anthony, who talks, by the way.“Which maybe means I’m a bit of a hoarder. I have a lot of cardboard. We had just moved into this new apartment which had a garage. Before that, I was doing projects in the living room which made my wife very sad,” said Monsen. His content has kids everywhere giggling and Monsen says, “when you’re devoting your entire week to making a silly video and you’re not getting paid for any of it, getting videos of kids enjoying it and doing the activities and laughing really, really makes it worthwhile.”Certainly, it’s a worthwhile effort from a guy who has all the tricks, trades and a huge knack for making all the little ones laugh during a time when giggles are hard to come by. 2603

ROCHESTER, N.Y. (AP) — The mayor of New York’s third largest city has suspended a group of police officers involved in the suffocation death of a Black man last March. Daniel Prude died March 30 when his family took him off life support, seven days after officers who encountered him running naked through the street put a hood over his head to stop him from spitting, then held him down for about two minutes until he stopped breathing.Wednesday, Prude’s family held a news conference and released police body camera video obtained through a public records request that captured his fatal interaction with the officers.Prude had been taken to a Rochester hospital for a mental health evaluation about eight hours before the encounter that led to his death. He was released back into the care of his family and then abruptly ran into the street and took off his clothes.A medical examiner concluded that Prude’s death was a homicide caused by “complications of asphyxia in the setting of physical restraint.” The report lists excited delirium and acute intoxication by phencyclidine, or PCP, as contributing factors.New York Attorney General Letitia James’ office took over the investigation of the death in April. It is ongoing.Rochester Mayor Lovely Warren announced the suspension of the officers Thursday. She said the officers would still be paid because of contract rules. “Mr. Daniel Prude was failed by the police department, our mental health care system, our society and he was failed by me,” Warren said.Messages left with the union representing Rochester police officers were not immediately returned Thursday. 1630

SACRAMENTO, Calif. (AP) — California had a near-record number of daily coronavirus deaths as pandemic cases strained hospitals and reduced normal intensive care space to a record low. Yet Gov. Gavin Newsom said Wednesday that there are hints residents may be heeding medical officials’ increasingly desperate calls for caution during the holidays. The transmission rate has been slowing for nearly two weeks. The rate of positive cases reached a new high of 12.3% over a two-week period but was starting to trend down. Yet the state's worst surge is taking a horrendous toll that threatens to only worsen if people gather during the holidays. 650
