SAN DIEGO (KGTV) -- Neighbors are concerned after they say a registered sex offender moved into their Rancho Bernardo community, just feet away from an elementary school playground.Anthony James Morgan, 32, was convicted of possession of child pornography and lewd and lascivious acts with a child in Tennessee in 2013.Neighbors say they became concerned after Morgan moved into a townhouse in their neighborhood weeks ago. According to records on the Megan’s Law website, Morgan lives on the 17000 block of Caminito Baya, about 100 feet away from a playground at Westwood Elementary School.According to the Safe Task Force, which monitors local sex offenders, Morgan’s living situation is legal because of the California Supreme Court.In 2015, the court tossed out blanket restrictions on where sex offenders may live. The ruling came after sex offenders said the restrictions made finding housing impossible for them.  Authorities say while probation or parole agents can implement living restrictions, due to the fact that Morgan is no longer on parole or probation, he is now allowed to live wherever he wants.Neighbors say the rule doesn’t make sense. “I think the rules definitely need to be changed when it comes to sexual predators,” said Linda Vasquez.Vasquez added that she is relieved to hear that Morgan will be moving out of the area in April. “I’m very happy for that. We don’t need that in a neighborhood full of children.”The neighborhood is particularly sensitive to the sex offender issue. Neighbors say registered sex offender John Gardner was spotted at this mother's home - less than 500 feet from Westwood Elementary - in the years before he murdered two teens, including Chelsea King.Father Brett King helped lead a successful fight for tougher laws, including stricter punishments for sex offenders.  When he learned about Morgan's living situation, he told 10news: "As a society, we have lost our common sense ... SAN DIEGO (KGTV) - On the edge of Balboa Park, parkgoers arrived Wednesday to a fresh layer of graffiti across a popular playground area.Joanne Schara leads a boot camp class at Bird Park at Upas three times a week. After a year of working out there, the things that drew her are now awash in graffiti. "It's just sad to see. You come here because you want a happy space. People bring their kids. People bring their pets. Its beautiful," said Schara.The tagging is everywhere, from the tables and benches and the wall wrapping around the playground area to utility boxes and graffiti on the ground."Doesn't give a good image at all," said Schara.Cathy Lea has lived in the neighborhood for 40 years and takes her dogs to the park twice a day."When I see the graffiti, it's disheartening," said Schara.Lea says every few days, there is more graffiti. On the concrete wall that surrounds the park, there are countless layers of tagging that have been painted over, only to be tagged again."That's not what this park is about," said Lea.On the Nextdoor app, some longtime neighbors posted the current graffiti is the "worst they've ever seen." Lately the graffiti has started to creep into areas previously untouched, including the playground set and the nearby rocks. As the tagging spreads, so does the frustration."It's not the kind of message we want to be sending in North Park," said Lea.Several neighbors have posted on the city's Get It Done app to get it cleaned up. SAN DIEGO (KGTV) -- Police Wednesday identified the Border Patrol agents and suspect they say knocked an agent off his ATV before being shot.Agents Micah Owens and Brandon Brandt reportedly shot the suspect, Francisco Javier Gutierrez-Alvarado, during the incident.Alvarado was taken to the hospital with non-life threatening injuries and no agents were seriously injured, police say.RELATED: Man shot by Border Patrol after knocking agent off ATV with rock, authorities sayDuring an initial investigation, authorities learned that a Border Patrol agent was on patrol on an ATV in the area of Spooner’s Mesa when he was hit with a rock and knocked off the vehicle by Alvarado.The suspect rode away on the ATV and was chased by several other agents before losing control and crashing into a fence.During the chase, both agents reportedly shot at Alvarado, striking him at least once. Alvarado is being charged with assaulting a federal officer. The San Diego Police Department is handling the investigation. 1019

SAN DIEGO (KGTV) — More than half of the San Diego-based breweries that participated in a fundraiser to help Camp Fire victims say they've completed their donation on time, according to research by the 10News team.In December, Sierra Nevada brewing asked breweries across the nation to brew "Resilience IPA" as a way to make money for the Butte Strong Fund.Sierra Nevada offered to provide the recipe and work with suppliers to get the ingredients donated. All the local brewers had to do was brew and sell the beer, and donate 100% of the proceeds to the fund.According to Sierra Nevada's Resilience IPA website, more than 1,400 breweries across the country signed up. That includes 43 in San Diego County.Sierra Nevada asked the brewers to finish selling Resilience IPA by April 30 and complete their donation by May 14.In an email sent to brewers on May 21, Sierra Nevada said that nearly half of the breweries still hadn't completed their donation.10News reached out to all 43 breweries in San Diego that took part in the effort to see if they're living up to their end of the fundraiser. We also asked how much money they were able to donate.Of the 43 San Diego breweries we called or emailed, 29 told us they had finished their donation and sent in a check. Those breweries sent more than 7,000 combined. Three breweries told us they haven't been able to finalize their donation. Eleven breweries have yet to respond to our questions.For Societe Brewery CEO Doug Constantiner, helping Camp Fire victims was personal."One of my really good friends lost his house in the fire," Constantiner says. "When we saw the email come through, there was no question about it. We knew we were on board and signed up right away."Societe brewed 20 barrels and raised ,000."I think people really got the message what the Resilience IPA was brewed for and were willing to put their dollars behind it, knowing it was going to a good cause," says Constantiner.San Diego-based AleSmith Brewing made a smaller, two-keg batch, but still raised ,400. "I can honestly never think of another time that another brewery's tap handle was on here at AleSmith," says Quality Supervisor Peter Cronin.He hopes that the breweries that haven't been able to finalize their donation will send the money soon."I'm hoping they didn't just use a big brewery's name, a quality brewery's name to market it a little bit," says Cronin. " And I hope they would donate the money from that beer.
