SAN DIEGO (KGTV) — A class-action lawsuit against the University of San Diego wants the school to refund students some tuition fees following the move to virtual learning.The lawsuit, filed by two students, claims the college owes students some of their tuition and fees back due to the switch to virtual learning.The suit says that when the school switched to virtual learning in Spring 2020, students were still charged full tuition even though "USD could no longer provide the promised hours of instruction." The lawsuit claimed that USD also increased its tuition on top of that."Similarly, students paid fees for services and access to facilities and equipment over the full semester. Though USD provided these services and facility/equipment access for only part of the semester, and could not provide them for the full semester, USD demanded that students pay fees for the entire semester," lawsuit documents state.A spokesperson for USD told ABC 10News they have not been notified of or served with the lawsuit.The lawsuit is seeking a "prorated portion of the tuition, fees and other related costs, proportionate to the diminished value of online classes and the amount of time in the Spring 2020 and following semesters when USD ceased in-person classes, campus services and access to campus facilities, continuing through to such time as USD reinstates in-person classes" for the two students who filed the lawsuit and "all others similarly situated." 1470

SAN DIEGO (KGTV) — A 20-year-old woman claims she was sexually assaulted for about 20 minutes during a Lyft ride in June.She's identified as Jane Roe in a civil lawsuit filed by Estey & Bomberger, LLP on Thursday. Roe tells 10News she has a disability and is unable to drive, she relies on Lyft to get to and from UCSD and around San Diego on a daily basis."I would use Lyft every day for about a year and a half," said Roe. "I would use it about 2-3 times a day."In June, Roe says she was using Lyft to travel from her father's home to her mother's, a 32-minute ride on the Interstate 5 that would forever change her life.RELATED: San Diego women reported in Uber, Lyft sex assault cases"He just asked me inappropriate questions," Roe said, referring to her driver. "He was commenting about inappropriate behaviors that he likes to do."Roe said the driver then told her to sit in the front passenger's seat, and out of fear she complied."The man.. he started touching me.. he groped my vagina, he groped my inner thighs, my thighs, my hamstrings," Roe said. She said the assault lasted between 15 and 20 minutes."I was kind of in a state of shock," Roe said. But Roe and her attorney, Mike Bomberger, say Lyft has been unresponsive."One of the things we don't know is what happened to the driver," Bomberger said.Roe and Bomberger allege that Lyft is not doing enough to keep passengers safe."Lyft fails to cooperate with police when there's an assault. SAN DIEGO (KGTV and CNS) - The office of District Attorney Summer Stephan will soon have a new tool to better document injuries to victims of domestic violence. Her office announced on Tuesday, May 7 that 35 cameras will be purchased to aid in investigations, thanks to a ,000 grant from a California Office of Emergency Services.According to Stephan, these cameras can produce high-quality photos, which will then assist how evidence is presented in court. "These cameras can help us preserve and document evidence -- including evidence of strangulation -- which is predictive of homicide, and allows us to move forward with prosecutions and fight this persistent crime in San Diego County," said Stephan.According to a recent crime report from the San Diego Association of Governments, in 2017 there were more than 17,000 domestic violence incidents reported in San Diego County. Stephan said there has been a 20% increase in the number of domestic violence cases submitted to the District Attorney's Office over the last five years. Plus, the District Attorney's Family Protection Division has 21 pending murder cases. 11 of those cases involve the murder of an intimate partner. In addition to the new cameras, Stephan's office is currently working on nine other initiatives to bring awareness to and combat domestic violence. These initiatives include a new countywide strangulation protocol, forensic exams, and recognizing the link between homelessness and domestic violence. 1508

SAN DIEGO (KGTV) - A Clairemont woman says she came home to a break-in and heartbreak.On Friday afternoon at the Balboa Arms condos, Terri Harrison's adult daughter discovered a ransacked home.The intruder likely ripped a window screen before reaching in and unlocking the window.Missing from a bedroom was her daughter's laptop. In the master bedroom, a lock box was emptied of personal documents and some six pieces of jewelry, including a set of pearls belonging to her mom.Both her mother and father passed away two year ago."You wear something that's hers, you feel like she's close to you again ...
