SAN DIEGO (KGTV) -- A Team 10 investigation discovered a North County deputy was found deceptive to a question on a polygraph exam before he was employed with the San Diego County Sheriff’s Department.A transcript from a separate case involving the deputy, which is currently working its way through the federal court system, revealed this new information.According to the transcript from that case, Deputy Kyle Klein denied ever being associated with a white supremacist organization during a polygraph exam. The polygraph exam report indicated he was being deceptive to that question, the court transcript said.Klein is being sued for allegedly using excessive force against a North County man.The lawsuit filed by Thomas deLeon III alleges that in December 2016 he was thrown to the ground and repeatedly punched and kicked in the area of his head, face, neck and spine."Looked like he got beat up, like a whole bunch of guys punched him in the face," said deLeon's sister Marlene deLeon.Marlene said physical injuries aside, her brother is suffering emotionally. He was not up for an interview for this story, but his sister said wanted to tell his story. She said since his 2016 encounter with deputies he struggles to leave the house."What did he do to deserve that?” she still questions. "Why did he get beat up? Then, suddenly and without warning, Thomas was violently slammed to the ground, his head hitting the asphalt/concrete,” his suit states.A bystander at a nearby fast-food restaurant captured the incident on camera, but the video doesn’t begin until deLeon is already on the ground."He produced his identification, a brief conversation took place and the next thing was he was thrown to the ground,” said deLeon family attorney Brian Cline.Cline said deputies claim at some point Thomas deLeon resisted arrest and that’s why things got aggressive.DeLeon's lawsuit filed against the county, the sheriff and arresting deputies and others claims once on the ground Thomas deLeon was handcuffed, offered no resistance, and then violently beaten."If you've ever seen a professional fight at the point where they stop the fight because it’s gotten too violent, this is where it started and then they continued,” Cline said.The Sheriff's Department wouldn’t discuss the case with Team 10 saying the department can’t comment. SAN DIEGO (KGTV) — An infectious disease expert at San Diego State University says early research suggests the COVID-19 pandemic could cause a spike in another, more deadly respiratory disease: tuberculosis.An estimated one in four people on the planet is already infected with TB without knowing it. The bacterium that causes the disease can lie dormant for years, even decades, waiting for the right moment to strike.San Diego State University professor Dr. Faramarz Valafar says SARS-CoV-2, the virus that causes COVID-19, could be just the right pathogen to trigger more TB cases to activate, both worldwide and in the U.S. And the symptoms of COVID-19 could help spread the TB bacteria more efficiently.“COVID-19 could act as a vehicle for transmission of tuberculosis,” he said. “This is a significant public health risk.”In the early 1900s, TB was the number one cause of death in the U.S. Today, it remains one of the top 10 causes of death worldwide with about 1.5 million deaths each year, although deaths in the U.S. are now rare. There were 515 deaths in the U.S. in 2017, the most recent data available.Although the tuberculosis is mostly curable and preventable with antibiotics, some strains have become drug-resistant.“I believe it's naive to think that because there is not much tuberculosis here in the United States, it’s going to remain that way,” said Valafar. “We now have a vehicle for the transmission of all sorts of tuberculosis strains from around the world to the United States.”The CDC estimates up to 13 million people in the U.S. have latent TB. Studies have shown the disease can activate when the immune system is weakened, including by HIV.“If COVID-19 comes in and keeps the immune system busy or overburdened, then my first worry is that tuberculosis in those people could activate,” he said.A small study out of China that has not yet been peer-reviewed suggests people with latent TB are at a higher risk of developing severe COVID symptoms. Other experts have raised concerns about the pandemic could exacerbate TB infections.Valafar said his second worry is that the symptoms of COVID-19 could help spread tuberculosis. SAN DIEGO (KGTV) -- A San Diego Sheriff's Department employee has been removed from duty after reportedly sharing a vulgar image.Although 10News hasn't seen the image, it was described as a vulgar image depicting George Floyd. The department says the image was shared electronically and was brought to the attention of leaders by a member of the department. The employee hasn't been identified."We were so disgusted that an employee may have shared such a vulgar image that we took immediate action," the department said in a statement to 10News.The department says the employee was removed from their official duties and had their peace officer authority removed."The Sheriff's Department does not tolerate any acts or actions by its employees that are a detriment to our core values. She said people saw the post and took screenshots of it.She’s now suing the man she says posted the photo, her ex-boyfriend William Ashley Oliver III."This pretty much consumed my life,” she told Team 10 investigator Adam Racusin.That’s L.S describing how one social media post of her naked body wrecked her sense of security. 10News is not naming the woman, but instead using the initials L.S. as they appear in her lawsuit against Oliver to protect her identity.“He was threatening for so long to do it that I didn't think he'd really do it,” she said.Their relationship started as most do: Girl meets boy, they fall in love and move in together. "I felt like I really got to know him fast and fell in love fast,” she said.Just like many relationships, everything was great until it wasn't. Unlike the typical breakup story, here's where this takes a different path.L.S. said she moved back to California in October of last year, about eight months after the relationship started.Oliver came to visit in late November, but things did not go well, she said.She said her ex-boyfriend became aggressive."He smashed my laptop in two, he smashed my brand new iPhone on the ground until it was shattered, and was calling me really horrible things,” she said.According to the lawsuit she filed, before leaving, Oliver took L.S’s passport and jewelry from the bathroom sink.A few days after that incident, while Oliver was still in San Diego, he began sending harassing text messages and copies of private photographs to L.S. to make it clear that at some point in their relationship he illegally accessed her computers and cell phones and stole sexually explicit and private digital photographs without her consent, the lawsuit stated."The pictures that he had were never sent to him they were taken before I ever met him," she said.According to the lawsuit, Oliver texted her: “Posted all your naked pics to the industry whore boards.” It said he also wrote among other things: “Your pics are getting blasted on services Moxy.”The lawsuit says L.S.’s pleas for Oliver to stop had no effect on him. SAN DIEGO (KGTV) - A young man was trapped in his car after a crash on southbound Interstate 15 at I-805 Monday afternoon.The solo-vehicle crash happened about 1:30 p.m. The man went off the freeway and into a tree, leaving his car a mangled wreck.San Diego Fire Captain Steve Salasz described the rescue as a “complicated effort”.Several firefighters used saws to free the man, whose foot was stuck in a floorboard.The man, who was alert and talking during the rescue, was taken to Scripps Mercy Hospital for treatment.There was no word on his condition but Salasz described his injuries as “severe”.Investigators did not release the cause of the crash. 662
