(KGTV) - A new California law could let convicted killers out of prison, and San Diego County's district attorney said her office will fight it on a case-by-case basis.Senate Bill 1437 passed the state Legislature last year and went into effect on January 1. It narrows the definition of murder so that only people who are involved in a killing can be charged with that crime.Before the law, accomplices in a killing could also have been charged with murder."It may let murderers go free, because of how far it goes," said San Diego County District Attorney Summer Stephan.Stephan said her office will challenge some re-sentencing hearings based on the new law, although she said they don't know how many there will be.One possible case involves Kurese Bell, who He as convicted of murder in 2016 for his role in the robbery of a North Park marijuana dispensary.During the robbery, Bell and another man, Marlon Thomas, got into a shootout with a security guard at the dispensary. The guard shot and killed Thomas.The DA's office argued that Bell should face murder charges because his actions in the robbery led to the shootout and, ultimately, Thomas' death.Bell is currently serving a 65-year-to-life sentence.Stephan said criminals need to be held accountable for the crimes they commit and cause."It's really important that each offender is held culpable at the right level," she said. "That's what justice is about."Supporters of the new law say it is a vital part of California's efforts at criminal justice reform. They say the old law unfairly targeted young minorities.On its website, the group Restore California says the new law makes sentencing in California more "equitable." (KGTV) - The warmest ocean temperatures on record are making things interesting for San Diego’s fishermen.Local fisherman say they are seeing more game fish closer to the coast than even before.“2018 is a season that has been off the charts,” said Frank Ursitti, the owner of H & M Landing.Scientists recorded ocean temperatures at more than 80 degrees last week.Ursitti says his tours are lining in more dorado, yellowtail, yellowfin and bluefin this time of year than usual.  “Often time times anglers or recreational fisherman will have to venture 8 to 15 days at seas for certain kinds of fish,” said Ursitti, “but now some of anglers are venturing just 12 hours offshore for the fish of a lifetime.”Fisherman Magnum Scuro says they have all noticed the warmer waters, but he is curious for what may be it consequences next year.“There are some negative things that can happen with the warm water - it can kill the kelp,” said Scuro, “ (the) hot water is going to expose a lot of areas where there hasn’t been kelp so we can get to it, but there’s going to be be a lot of kelp that’s going to be gone.” 1151

SAN FRANCISCO (AP) — A ring-tailed lemur that was stolen from the San Francisco Zoo this week has been found.The 21-year-old male lemur named Maki was discovered missing shortly before the zoo opened to visitors on Wednesday. Investigators found evidence of a forced entry to the lemur enclosure.Someone called police Thursday evening to say that Maki was spotted in Daly City, a few miles south of the zoo.Police say the animal was found in the playground area of a church.Maki was found to be in good health and was transported back to the zoo.Detectives are still investigating the break-in.?? SAN DIEGO, Calif. (KGTV) - A former North County Boy Scout said he is one of hundreds of sexual abuse victims in a new lawsuit against the Boy Scouts of America.Matt, who only wanted to use his first name, joined the Boy Scouts when he was around 13 years old. He really loved the outdoor activities.“We had a lot of great trips… a lot of good camp outs,” Matt said. Roughly a year after he joined, things changed.“We had an assistant Scoutmaster that started to join us on trips,” Matt said. “He just started spending more time with kids and a lot of these bad things started to happen.”The new lawsuit alleging sexual abuse was filed on behalf of one former scout in Pennsylvania. The total number of alleged victims in this latest wave of accusations is more than 850, according to attorney Andrew Van Arsdale. Matt is one of them.“Our oldest [alleged victim] is in his late 80s. Our youngest is 14-years-old,” Van Arsdale said. Van Arsdale is one of the lawyers involved in the group “Abused in Scouting.” The group came together after hearing the Boy Scouts were potentially filing for bankruptcy. They began a campaign telling victims that they no longer have to be in hiding. “It’s time to come forward. It’s the right time now and the response was overwhelming,” Van Arsdale said. He said he is “100 percent” expecting more people to come forward. For Matt, time has not healed all wounds of what he said the assistant Scoutmaster did to him.“He had come at me on multiple times. I think the first time, I was able to get him away from me,” Matt said. He was able to get away the first time, but not every time. He specifically remembers a camping trip in Camp Pendleton.“I woke up and he had gotten his hands on my genitals and massaging me… I woke up and pushed him off,” Matt said. “I think I just really kind of put it at the back of my head and just tried to forget about it.” But he didn’t forget and he said other kids in his troop were also abused by this man. In a statement, the Boy Scouts of America said that they “believe victims” and that the organization has “taken significant steps over many years to ensure that we respond aggressively and effectively to reports of sexual abuse.” The full statement can be read here. For some, it’s too little too late. “They knew it was a problem for a long time,” Van Arsdale said.“Anytime you got kids with adults having access to kids, you better make sure those adults are reliable, good people. (KGTV) Firefighters continue to mop up after the Valley Fire tore through Lawson Valley, burning 17,665 acres.Messages of gratitude for the crews on the frontlines can be seen throughout the area.At least 30 homes and 31 minor structures were destroyed, but all evacuation orders and road closures were lifted on Friday.In much of the burn area, firetrucks have been replaced with utility vehicles.“I watched the flames start coming over the mountain, like fingers, like some creature,” said Seth Matteson who lives in Lawson Valley.He left his home as the fire started to spread Sept. 5, fearing the worst, but was thankful to come home and find his house on Prairie Drive still standing.“In the back it came right up to the house, and in the front it came right up to the house,” he explained.Just down the road, several homes and vehicles burned in the fire.“I’ve been through 8 hurricanes, and this is way scarier to me than that.
