SAN DIEGO (CNS) - A young man accused in a series of San Diego-area gang-related killings and attempted slayings pleaded not guilty Monday to murder, attempted murder and conspiracy charges.Ismael Betancourt, 20, is charged in the Aug. 1, 2019, shooting death of 57-year-old Marco Magana in Mountain View, the Feb. 8 shooting death of 19-year-old Leah Posey in Southcrest, and two attempted murders that allegedly occurred on July 24, 2019 and Feb. 8.San Diego police announced Betancourt's arrest last month in connection with the April 8, 2018, shooting death of 55-year-old Lowry Rivers in National City, which occurred when Betancourt was 17. Rivers' killing is not listed in the latest complaint, and it's unclear whether Betancourt is being tried in juvenile court regarding that crime or whether additional charges are pending in his current case.In addition to the murders and attempted murders, Betancourt is charged along with six co-defendants with conspiracy to commit a crime, for what prosecutors allege was a plan to kill rival gang members.The overarching conspiracy includes the July 12, 2019, shooting death of 20-year-old Joaquin Ruiz, who was shot in a vehicle in Bay Terraces by assailants who opened fire from another vehicle.The four defendants charged with that slaying have been arrested and pleaded not guilty. Two of those defendants, Ethan Apan, 28, and Kevin Herrera, 26, are also charged in the murders in which Betancourt is charged. The complaint charges Apan in Marco Magana's murder and Herrera in Leah Posey's murder.Betancourt is being held without bail and his next court date is a Dec. 22 readiness conference. 1656

SAN DIEGO (CNS) - As the Valley Fire burned for a fifth straight day, blackening thousands of acres in rural eastern San Diego County, California Attorney General Xavier Becerra issued a consumer alert today warning that charging excessive prices for goods and services is illegal during a state of emergency.The state's price gouging law holds that it is unlawful to raise the price of items more than 10% after a state of emergency has been declared.Violations of the price gouging statute could carry penalties of up to one year in county jail and/or a ,000 fine. Civil enforcement actions could also include up to ,500 per violation and other monetary penalties.As of midday Wednesday, the Valley Fire had burned more than 17,000 acres and was 11% contained. It was one of many blazes ravaging the state, including the El Dorado Fire in San Bernardino County and the Creek Fire in Fresno, Madera and Mariposa counties.``Multiple fires burning throughout the state have forced evacuations for thousands of California residents. During this difficult time, they shouldn't have to worry about whether they're being illegally cheated out of fair prices,'' Becerra said.``Our state's price gouging law protects people impacted by an emergency from illegal price gouging on housing, gas, food and other essential supplies. SAN DIEGO (CNS) - Mayor Kevin Faulconer today signed an emergency executive order that allows restaurants throughout the city to operate outside effective immediately.Notable parts of the order include allowing restaurants to establish sidewalk cafes and use private parking lots for dining.Restaurants must still comply with county and state ordinances, including following ADA requirements for sidewalk cafes. Businesses also can’t have live music or allow customers to vape.Indoor dining will be closed for at least the next three weeks after the county remained on the state's monitoring list for three consecutive days, leading all indoor operations to be halted at a variety of businesses, including restaurants, where county health officials say many of the recent outbreaks occurred.RELATED: San Diego to close some businesses as COVID-19 cases spikeLast month, Faulconer proposed waiving fees and permits to allow businesses to expand into parking lots, sidewalks and on-street parking spaces, a move intended to maximize social distancing for employees and customers by stretching operations into outdoor spaces.In a statement announcing the executive order, Faulconer said, "Given that the state's new shutdown order has an immediate impact on local businesses, this action will provide relief while the city is finalizing a new ordinance for council approval that will cut fees and streamline permits to make it easier for businesses to operate outdoors."The San Diego City Council is expected to consider an ordinance regarding the permit regulations at a meeting next week.“It will reduce fees, it will wave and streamline permits,” said Faulconer. “It will allow for outdoor dining plazas, and it will allow businesses, in addition to operating in parking lots and sidewalks, to safely expand operations into on-street parking.”“It’s really a lifesaver for these businesses,” said Benjamin Nicholls, the Executive Director of the Hillcrest Business Association. “I’m hearing relief, I’m hearing that the mayor turned out to be the partner that the restaurant community wanted him to be.”Nicholls has been pushing the city also to allow dining in parking lanes. He said that could be an answer for restaurants that don’t have enough sidewalk or parking lot space, like in Hillcrest and North Park.RELATED: San Diego County added to California's 'monitoring list,' certain businesses told to shut downHe is thrilled that the council will consider approving the proposal to include parking lanes next week.”Putting it in the parking lane can really save some of these businesses,” he said.Also Tuesday, Poway City Councilmembers voted unanimously to approve a proposal by Mayor Steve Vaus to buy outdoor picnic tables.The tables will be used by restaurants in need to help them move business outdoors. Vaus plans to use funding from the CARES Act to purchase the tables.Vaus added that no permits will be required to use the tables on sidewalks or in private parking lots and that they are expected to be distributed this week.Once restaurants are finished using them, the tables will be moved to local parks in Poway.“I think this is kind of a no brainer win-win type of situation I would love to see more picnic tables in our parks eventually, and so that's a great thing. And to do every little thing that we can to help our local businesses,” said Deputy Mayor Caylin Frank. 3398

  

SAN DIEGO (CNS) - NASA astronaut and UC San Diego graduate Kate Rubins arrived aboard the International Space Station Wednesday, where she and two Russian cosmonauts will conduct research over the next six months.Rubins, Sergey Ryzhikov and Sergey Kud-Sverchkov launched from Kazakhstan in the Soyuz MS-17 spacecraft and arrived at the station's Rassvet module at 1:48 a.m. PST following a two-orbit, three-hour flight, according to NASA.The trio joined Expedition 63 Commander Chris Cassidy of NASA and Roscosmos cosmonauts Anatoly Ivanishin and Ivan Vagner, who have been aboard the complex since April. Ryzhikov will become the commander when Expedition 64 begins Oct. 21 and Cassidy, Vagner and Ivanishin will depart for Earth.The spaceflight marks the second for Rubins and Ryzhikov and the first for Kud-Sverchkov, who will live and work aboard the outpost for six months, conducting research in technology development, Earth science, biology, human research and more. NASA says research conducted in microgravity will help prepare for long-duration missions to the Moon and Mars, in addition to improvements for life on Earth.According to NASA, Rubins became the first person to sequence DNA in space during her first spaceflight in 2016.She earned her bachelor's degree in molecular biology from UCSD in 1999, and a doctorate in cancer biology from Stanford University's Medical School Biochemistry Department and Microbiology and Immunology Department in 2005. 1477

  

SAN DIEGO (CNS) - A man who ambushed a janitorial worker at a Little Italy coffee shop at knifepoint, tried to sexually assault her and stole her SUV, was sentenced today to 14 years in state prison.Christopher Merron, 28, was also ordered to register as a sex offender for life.The attack occurred around 4:30 a.m. last Oct. 14 as the victim was cleaning the coffee shop in the 1700 block of India Street. Merron pushed the woman into a back room, took her car keys and threatened her with a knife, according to police and prosecutors.Following a struggle, she was able to break free and run out of the building, said San Diego police Lt. Jason Weeden.The assailant fled in the woman's 1998 GMC Jimmy. Merron was arrested in Mission Valley the next day and the victim's SUV was recovered, Weeden said.Merron pleaded guilty in January to assault with intent to commit a sex offense, robbery and sexual battery charges and admitted a knife-use sentencing enhancement allegation. Other charges, including kidnapping with the intent to commit a sex offense, attempted oral copulation, false imprisonment with force and auto theft, were dismissed at sentencing. 1165
