A man in Colorado who was sentenced to more than 300 years in prison for child sex crimes in 2015, is now walking free after his conviction was thrown out on a technicality.Michael Tracy McFadden, 46, was convicted for 19 counts of sexual offenses, including a habitual sex offender against children, according to KKCO. McFadden was released from the Arkansas Valley Correctional Facility on Tuesday.In June, the Colorado Court of Appeals found that McFadden's right to a speedy trial was violated when the judge in the case granted a continuance. When the court ruled that his statutes were violated, they threw out his conviction."Frankly I'm completely appalled with the decision," District Attorney Dan Rubenstein told KREX. "I find it offensive that our justice system would allow this to happen."Rubenstein explained to KREX that speedy trials are broken down into two categories: constitutional and statual.Constitutional speedy trials have no timeframe, depending on the case. However, in Colorado, statutory speedy right trials require a time frame of six months.Rubinstein told reporters, “Because the error here was that he shouldn’t have been tried longer than six months from the last time he waived speedy trial, there was no remedy for that, and therefore there is no ability to retry him." "The justice system completely failed in this situation. A crowd of about 250 protesters on the University of North Carolina at Chapel Hill's campus knocked over the controversial Silent Sam Confederate statue, according to the university.A video and pictures from a student shows the statue coming down on Monday as students chant "I believe that we will win." Video footage from WRAL-TV shows protesters putting up poles and banners around the statue during daylight. By nightfall, video from WRAL shows the statue falling down and students cheering. Protesters could also be seen kicking Silent Sam's head and putting dirt on the statue. 591

A former model has come forward with an allegation that President Donald Trump sexually assaulted her in his VIP suite at the U.S. Open tennis tournament in 1997.Former model Amy Dorris told The Guardian that the then-real estate tycoon "shoved his tongue down my throat" and then grabbed her buttocks and breasts despite her denial of his advances.According to The Guardian, Trump's personal lawyers denied the accusation "in the strongest possible terms." Several people close to Dorris, including her mother, her friend and a therapist, told the newspaper that Dorris had told them of the alleged assault either immediately after the incident happened or in the years since.Dorris also provided The Guardian with several photos of her, her then-boyfriend Jason Binn and Trump at the tennis tournament.The White House has not yet responded to media requests for comment about The Guardian's report.According to the newspaper, Dorris was in New York in 1997 with Binn, a friend of Trump's. I had no money, nowhere to go. We were going from event to event and it was overwhelming," Dorris told The Guardian. "People spend years around people who have abused them, that's what happens when something traumatic happens, you freeze."The allegation is just the latest assault allegation made against Trump in recent years. Trump is currently facing two lawsuits regarding assault allegations, and several women came forward prior to the 2016 election to formally accuse Trump of assault. During that election cycle, a video leaked in which Trump boasted about sexually assaulting women.Dorris considered coming forward in 2016 with her allegation but decided to remain silent for her family's safety. A brawl broke out during a sentencing Wednesday afternoon of a former daycare owner accused of reckless homicide in the death of a 7-week-old baby in her care.37-year-old Claudette Mitchell was being sentenced for charges related to the death of a 2-month-old child that died while in Mitchell's care last August at "WHO'S LUVIN YOU" daycare. Mitchell ran the daycare out of her home on Milwaukee's northside. A criminal complaint says Mitchell told police she put the baby down for a nap and when she checked on her about an hour later she was unresponsive and had scratches and blood on her face. Court documents show the baby suffered multiple fractures to her skull and bruising all over her body. Forensic investigators believe the baby died of blunt force trauma to the head.  Mitchell received a sentence of 42 months, and upon release, 48 months of supervision. Following the sentencing, an altercation broke out between 50 members of Mitchell's and the victim's families and friends according to the Milwaukee County Sheriff's Office.Additional deputies and district attorney investigators were called to the room to restore order. Authorities say additional security had been in place prior to the altercation but Mitchell's loved ones did not comply with deputies’ orders to remain in the courtroom while the victim’s family was being escorted out. 1407

A Florida motorcyclist is asking for the public's help in finding the driver who smashed into him in an apparent road rage incident. The crash happened at 5 p.m. on Sunday in Sarasota, according to the Sarasota County Sheriff's Office.The motorcyclist, Darin Hendrickson, said he was taken to the hospital for a hyperextended knee, possible fractured ribs and severe road rash. Hendrickson said he was traveling when a car brake checked him. In a cell phone video, recorded by a witness, Hendrickson could be seen changing lanes and driving alongside the Mazda when he motioned for the car to pull over, swinging his arm towards the vehicle.   721
