SAN DIEGO (AP) — Marine Corps prosecutors were meeting Tuesday to try and save its cases against 13 Marines accused of crimes tied to a human smuggling and drug investigation after a military judge ruled it was illegal to make the videotaped arrests made during a battalion formation while leaders called them “a cancer” and “bad Marines.”Maj. Kendra Motz said prosecutors at Marine Corps Camp Pendleton were exploring their options, but she did not know what they were considering.The judge, Marine Col. Stephen Keane, gave prosecutors until Nov. 25 to offer a way to remedy the situation.When ruling Friday, Keane agreed with defense attorneys that commanders violated the rights of the accused when they pulled the Marines out of a morning battalion formation of 800 troops at Camp Pendleton July 25 and accused them of the crimes in front of their unit, 1st Battalion, 5th Marines.The actions amounted to unlawful command influence, Keane said. That is when commanders use their positions of power to affect a case and compromise the ability for a fair trial.If the prosecution cannot remedy the situation, the court would be left with only one option: dismissing the charges, he said.Defense attorneys for some of the Marines have asked for charges to be dismissed. They say the public display would make it difficult to find an impartial jury pool and guarantee a fair trial.The Marine Corps filmed the arrests. The video was obtained by the San Diego Union-Tribune.The Marine Corps said in a statement when the newspaper obtained the video that it was made to document the arrest “in an unbiased, non-editorialized manner.”The video is for official use only and would not be released, Motz said. SAN DIEGO (CNS) - A grand jury report released Wednesday found multiple gaps in institutional safety and training in the Child Welfare Services division of San Diego County's Health and Human Services Agency. The grand jury reviewed the workloads of social workers in the CWS division, as well as how CWS workers are trained to provide support and care to foster children and parents. The panel also looked into the effects of the state's Continuum of Care Reform Act, which required regional foster care systems to increase support for foster families and improve outcomes for foster youth. The grand jury found that most social workers are overworked and often spend as much or more time on administrative work than interacting with foster children and families, resulting in poor communication and coordination. CWS staff and foster parents also lack the proper training to offer trauma- informed care or support for victims of human trafficking, according to the report. RELATED: Team 10: Child maltreatment in foster careThe grand jury launched the study after the San Diego Union-Tribune reported last July on a lawsuit alleging multiple instances of abuse of foster children over a seven-year period. Through interviews with county officials and a review of current CWS practices, the grand jury received reports that nearly one-third of foster children were abused in some way in their foster homes. In addition, roughly 20% of all calls to the county's child abuse hotline were from foster youth. ``Even though foster families have 12 hours of initial training including an orientation and eight hours of continuing education/year, the grand jury believes increased training in trauma and parent education will decrease maltreatment in (the Resource Family Approval program) and kinship care,'' the report says. RELATED: Team 10: California department does not maintain data on all foster care deathsThe grand jury issued nearly 10 recommendations to the county to improve the foster care system and ensure the safety of foster youth, including an annual study of abuse and mistreatment and a dedicated oversight board to investigate cases of abuse in foster homes. Currently, cases of abuse in the county's foster youth system are handled by a group of protective service workers and records clerks. Those workers coordinate with local law enforcement to investigate abuse and mistreatment allegations. The panel also recommended that the county study both current workloads for its social workers and overall turnover rates to improve recruitment and retention efforts. The study should also focus on how to increase interaction between social workers, foster youth and their foster families, according to the grand jury. 2740

SAN DIEGO (CNS) - A 64-year-old taco truck owner was robbed at gunpoint Friday evening in the Linda Vista neighborhood.The victim was cleaning his truck at 6800 Linda Vista Rd. about 8:30 p.m. when the suspect walked up and demanded money, according to San Diego Police Department Officer Robert Heims.As the victim turned around, he saw the suspect pointing a gun at him and the suspect again demanded money, Heims said.The victim gave up an unknown amount of cash and the suspect ran off, last seen southbound in the 6800 block of Linda Vista Road, Heims said.The suspect was described as a 20-year-old Hispanic man, 5 feet 9 inches tall with a thin build, wearing blue jeans and a gray hoodie with a gray bandana around his face, Heims said.Anyone with information was asked to call San Diego Police Robbery Division detectives at 619-531-2299 or Crime Stoppers at 888-580-8477. 889

  

SAN DIEGO (CNS) - A gunman who allegedly tried to mug a man he met online under the pretense of buying a gold chain outside a Chula Vista Costco, was behind bars Wednesday, facing a robbery charge.Albert Molina, 30, was arrested Tuesday after a scuffle in which the 23-year-old alleged victim snatched away his gun, fired a shot and held him at gunpoint while calling 911, according to police.Prior to the confrontation, Molina and the other man had communicated via OfferUp, an online service that facilitates private sales of used goods, Lt. Dan Peak said.Meeting the seller outside a Costco store in the 1100 block of Broadway, Molina agreed to buy a gold chain and provided a money order to supposedly pay for it. The two men tried to cash the check together, but found it was no good, according to police.They went to Molina's car and were sitting in it when the seller asked Molina to return his chain, which Molina was wearing, Peak said, adding "the suspect refused and pulled out a gun."The two men wrestled over the gun, which ended up in the seller's possession as he fell out of the vehicle. Believing Molina was going to run him over, he fired a round in Molina's direction, then held him at gunpoint while summoning police.Patrol officers arrived shortly after 7:30 p.m. and took both men into custody. After being interviewed by detectives, the seller was released, while Molina was booked into San Diego Central Jail. Neither was reported to be injured. 1477
