The governor's plan outlined options to pay for wildfire damage, including helping utility companies if they're at fault, and spreading costs among everyone, including tax payers."The state has suffered from their neglect," Newsom said taking aim at utility companies. He wants the California Public Utilities Commission strengthened, to hold utility companies accountable while passing wildfire damage costs to customers. (AP) — A California affiliate of the National Rifle Association has asked a U.S. judge to block a new law requiring background checks for anyone buying ammunition.The California Rifle & Pistol Association asked San Diego-based U.S. District Judge Roger Benitez to halt the checks and related restrictions on ammunition sales.Voters approved tightening California's already strict firearms laws in 2016. The restrictions took effect July 1.The gun owners' association challenged the ammunition background checks in a lawsuit filed last year and on Monday asked for an injunction, alleging it violates the Second Amendment right to bear arms.RELATED: New ammunition law requires background checksThe lawsuit has been joined by out-of-state ammunition sellers and California residents, including Kim Rhode, who has won six Olympic shooting medals and is trying to become the only person to win seven medals at seven consecutive Games."The scheme purports to funnel everyone seeking to exercise their Second Amendment right to acquire ammunition into a single, controlled source, an in-state licensed vendor, for the purpose of confirming purchasers' legal eligibility to possess ammunition and to keep track of all purchases," lawyer Sean Brady wrote. "While making sure dangerous people do not obtain weapons is a laudable goal for government, California's scheme goes too far and must be enjoined."The motion raised concerns about identification requirements and high rates of denials among ammunition buyers undergoing the new background checks. Moreover, the system blocks out-of-state ammunition vendors from the California market, the motion argues.RELATED: Study: Tougher gun laws lead to fewer firearm-related deaths among childrenThe judge is expected to decide in early August whether to order a halt, though any such decision is almost certain to be appealed.Benitez in October rejected the state's attempt to throw out the lawsuit. He allowed opponents to proceed on arguments that the ammunition restrictions impede interstate commerce and are pre-empted by federal law.The measure "criminalizes all of those (ammunition) transactions with merchants conducting business in other states," he wrote in a preliminary ruling that the restriction "significantly burdens interstate commerce."He also preliminarily supported the argument that the new state law conflicts with a federal law allowing gun owners to bring their firearms and ammunition through California.RELATED: Southern California town of Needles wants to be a sanctuary -- for gun ownersThe California law "criminalizes bringing ammunition into the state that was purchased or obtained outside the state," he wrote.Benitez earlier this year struck down California's nearly two-decade-old ban on high-capacity ammunition magazines. That triggered a week-long buying frenzy before he stopped sales while the state appeals his ruling.The impending ammunition background checks sparked a surge in sales as firearm owners sought to beat new requirements, including that dealers report the brand, type and amount of ammunition to the state Department of Justice.Gun owners who already are in the state's background check database would pay a fee each time they buy ammunition, while others can buy longer-term licenses if they do not have certain criminal convictions or mental health commitments.Gov. Gavin Newsom has criticized Benitez's lifting of the state's ban on magazines holding more than 10 bullets, saying he is confident it will be reinstated by the 9th U.S. Circuit Court of Appeals.Attorneys with San Francisco-based Giffords Law Center to Prevent Gun Violence anticipated that Benitez is likely to block the ammunition restrictions, but the law would eventually be upheld on appeal."Unfortunately this may be the one judge in the country" willing to rule that "people should be able to buy unlimited quantities of ammunition without background checks," staff attorney Ari Freilich, who directs the organization's California legislative affairs, said prior to the filing.Gun owner groups have been pinning their hopes on a more conservative U.S. Supreme Court. But the center's litigation director, Hannah Shearer, said there are unlikely to be the kind of conflicting lower court opinions that would prompt the justices to weigh in.She said courts have upheld ammunition licensing laws in other states and she expects the 9th Circuit would do likewise. 4465

  

SACRAMENTO, Calif. (AP) — California Gov. Gavin Newsom has signed legislation banning two dozen toxic chemicals from being used in cosmetics — making the state the first in the nation to prohibit the use of the hazardous ingredients for that purpose. The Toxic Free Cosmetics Act bans 24 chemicals starting in 2025. It was authored by Democratic Assemblymember Al Muratsuchi, who called it a landmark bill. He says the chemicals are known to cause cancer, reproductive harm and hormone disruption. The chemicals banned are known to cause cancer, reproductive harm, and hormone disruption, Muratsuchi said. All the chemicals have already been banned by the European Union, but California is the first U.S. state to prohibit the materials.Another piece of legislation signed by Newsom requires companies to disclose possibly harmful ingredients being used in personal care products. 888

(AP) — California lawmakers on Tuesday moved to cap annual rent increases statewide for most tenants as a limited housing supply in the country's most populous state continues to drive up the cost of living while pushing more people to the streets.The California Senate voted 25-10 to cap rent increases at 5% each year plus inflation for the next decade while banning landlords from evicting tenants without just cause. Democratic Gov. Gavin Newsom says he will sign the bill into law, but first it must survive a final vote in the state Assembly where the California Association of Realtors is pushing to defeat it. Lawmakers must act by Friday.California's largest cities, including Los Angeles, Oakland and San Francisco, have some form of rent control, but a state law passed in 1995 has restricted new rent control laws since that year. In most places, landlords can raise rents at any time and for any reason, as long as they give advance notice.In Pomona, about 30 miles (48 kilometers) east of Los Angeles, Yesenia Miranda Meza says her rent has jumped 20% in the past two years. Monday, she marched with other tenants through the halls of the state Capitol chanting: "Once I've paid my rent, all my money's spent.""I'm a rent increase away from eviction, and that's with me having two jobs," she said "So if this (bill) doesn't go through and I get another rent increase, I really don't know what I'm going to do. I'm either going to be homeless or I'll have to cram into a room with a whole bunch of other people."Opponents have likened the proposal to rent control — a more restrictive set of limitations on landlords. California voters overwhelmingly rejected in a statewide ballot initiative to overturn the 1995 law last year.California Association of Realtors President Jared Martin said the group's 200,000 members strongly oppose the bill because it will "reduce the supply and quality of rental housing." It's an argument echoed by Republican Sen. Jeff Stone, who said developers would have no reason to build new housing if they can't make money off their investment."We'll see even a greater housing crisis because of the low supply of housing," Stone said. "Either this will force our constituents to join a 60,000 homeless population that we see in the LA area, or they will simply just move to another state."But supporters say the bill includes lots safeguards to prevent that from happening. The rent caps don't apply to new construction built within the last 15 years — a provision that prompted the California Building Industry Association to drop its opposition.Plus, the caps don't apply to single family homes, except those owned by corporations or real estate investment trusts. And duplexes where the owner lives in one of the units are also exempt."We all desperately want to build more housing. It was a very important aspect of this bill," Democratic Assemblyman David Chiu said.But even some Democrats who voted for the bill on Tuesday signaled they didn't like it, a sign the bill is not guaranteed to pass. Sen. Steve Glazer, a Democrat representing a district in the San Francisco Bay area, cited a 2018 study by Sanford University showing landlords under rent control are more likely to nudge tenants out by spending less on maintenance."Any time you reduce rate of return on an investment, you make that investment less attractive, and this is true even if new investment is exempted for 15 years as this bill does," he said.But Carolyn Wilson, a 71-year-old Sacramento resident, said she needs help now. She said her rent has increased about 0 each year and her landlord just gave her a 60-day notice to move out for on reason."All I do is get up on the computer looking for some place to go," she said.
