SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation.The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. She told ABC10 News in part, “It's been rough to shut down business again when people were feeling normal and then we see the County of San Diego's Department of Health say that gyms are only point .4% of cases in San Diego and it's really frustrating as a business owner where we have these ebbs and flows- where we can be open and then we can’t.”Superior Court Judge Kenneth J. Medel stated that he would have a ruling by 5 p.m. on Friday. If not, he said he would issue his decision on Monday. 1916

SAN DIEGO (KGTV) -- Less than a day after announcing that two students have contracted coronavirus, San Diego State University officials confirmed Thursday that two more students tested positive for the disease.Thursday's announcement raises the number of coronavirus cases on SDSU's campus to four since kicking off the fall semester this week.Officials said the two new cases are unrelated to the previous cases, and that the two students had only been to the campus to see testing at the Student Health Services. The two unidentified students are "recovering well and are away from campus," according to officials.RELATED: SDSU begins 2020-21 school year with mostly virtual classes"The two students did not interact with any SDSU employees or spaces, outside of the Student Health Services Outdoor COVID-19 Test Collection Booth, and were not in any other spaces utilized by the campus community," said Libby Skiles, Ed.D., SDSU Student Health Services Director.On Wednesday, the university confirmed two students had tested positive and that both students live off-campus. SAN DIEGO (KGTV) — Local leaders say it's going to cost millions of dollars to prevent toxic waste from flowing into the Tijuana River Valley, but it's a bill they are willing to pay. Dozens of local leaders and federal agencies came together this morning with a common goal, to prevent the massive amounts of sewage from flowing into our San Diego County beaches. "427 million gallons of sewage has hit our water and our beaches just this year alone," says Port of San Diego Commissioner, Dan Malcolm. During today's meeting, leaders were given possible solutions on how to tackle the problem. "To divert sewage and wastewater flow away from the Tijuana River Valleys, so that it can either be treated or diverted to outflow pumps, that would pump the water far out in the Pacific Ocean," says Mayor of Coronado Richard Bailey.The costs are estimated up to 0 million. Local leaders say sewage isn't the only contaminate in the water. A chemical test was done that showed things like herbicides, arsenic, and lead are also flowing into the sea. "The time of talk is over," says Serge Dedina, Mayor of Imperial Beach. "The time of actually doing things and preventing sewage and toxic waste from reaching our beach is now."Local leaders say the next plan of action is to ask Congress for help with funding. Mayor Kevin Faulconer and Mayor Serge Dedina will be visiting Mexico over the next few days to talk about solutions to the waste in the Tijuana River Valley. 1475
