DEL MAR, Calif. (KGTV) -- A plan meant to increase safety along Del Mar's famous coastal bluffs is being met with deep resistance by residents, surfers and walkers.North County Transit District says it has obtained grants to fund building a fence to protect the train tracks on the bluffs. It would aim to end 100 years of people illegally crossing the tracks to get down to the beach or take in the views.The district says it would help prevent erosion and increase safety - six people have been hit by trains in Del Mar in the last two years. "They put a fence up there it's not going to stop me," said Chris Gable, a longtime Del Mar surfer. "I understand it's a safety hazard since they're upping the frequency of the trains, but I don't think it's going to go over well."Del Mar Mayor Dwight Worden said the fencing is an overreaction. He said a better plan is to increase education, signage, citizen enforcement, and to build protected legal crossings. Residents and surfers say people would cut through or climb the fence, and that could trap them if a train comes - and that the fence could cut off an escape route in the event of a wildfire. (KGTV) - The Flower Hill Promenade in Del Mar is helping restaurants in its parking spaces by creating extra outdoor dining space.Milton's, a restaurant and deli in the shopping center, opened up a new outdoor area by covering up parking spaces with turf and tents and setting tables and chairs. That area opened up this week after new health orders forced restaurants to close their indoor dining areas due to rising coronavirus case numbers.Owner Barry Robbins says that they are also working on building a lounge area with a big-screen TV. With fans not allowed at the Del Mar horse track this season due to the pandemic, Robbins is hopeful their proximity to the race track will attract horse racing fans."We want to create a lounge, and put up a tv, and show the races there," he said. "Then you'll have more a night time venue with music, which we've never done before."Rose Javin, the General Manager at Flower Hill Shopping Center, says the outdoor dining spaces are an investment in their clients. Another restaurant in the Flower Hill Promenade, Cucina Enoteca, also recently rolled out turf and put up tents to create a comfortable outdoor setting for their customers. They are currently working with a third client to see if they can help them."The shopping center has put up the money to do all this and create this area for the tenant," Javin said. "We're a family here, and we want our tenants to thrive and survive."Robbins says they were hard-hit by the pandemic. When restaurants were allowed to reopen, Robbins says they invested thousands of dollars in putting up glass dividers inside the restaurant. Still, they were only open for two weeks before they had to shut their indoor area again.Robbins says having the outdoor space is a relief."It means sleeping at night. I was so scared," he said. DENVER – Colorado has joined a lawsuit involving 18 states, several cities and counties and the U.S. Conference of Mayors aiming to block the Trump administration from putting a citizenship question on the 2020 U.S. Census.But the state is doing so without the representation of its attorney general’s office and will have the governor’s chief legal counsel, Jacqueline Cooper Melmed, represent the state in the proceedings.Gov. John Hickenlooper’s office signed on to the first amended complaint in the lawsuit on Monday. New York Attorney General Eric Schneiderman and a host of other states originally filed the lawsuit last month in the U.S. District Court for the Southern District of New York.Hickenlooper, a Democrat, broke with Colorado Attorney General Cynthia Coffman, a Republican, in filing the suit.Coffman in early April announced that she and the attorneys general for Oklahoma and Louisiana supported the new citizenship question, saying that U.S. Secretary of Commerce Wilbur Ross was “within his authority to find that the need for accurate citizenship information outweighed the fears of a lower response rate.”But in joining the suit, the governor’s office argued otherwise.“We have a responsibility to Colorado to see that every person is counted,” Hickenlooper said in a statement. “Our action seeks to ensure the census is being used for its intended purpose under the Constitution. (KGTV) - SANDAG will start a million project in September, hoping to stabilize Del Mar cliffs that support railroad tracks.Geologist Dr. Pat Abbott says this winter and spring have been rough for bluffs, "in the past few months with a lot of rainfall, we've seen cliff collapses galore in Del Mar."SANDAG says they're going to install pillars and repair drainage structures, "put in steel beams, tie backs, bits of concrete walls, to start to stabilize some of the beach cliffs," Abbott added.The nine-month long project stretches from Seagrove Park to Carmel Valley Road."I think it's a wonderful idea, it's better to do it now, get it behind us, before something happens and a train goes off the side of the cliff," neighbor Lynn Kunkle said.Abbott calls it a Band-Aid, "there's no easy way to get out of this...You have tall sea cliff standing here, ocean waves beating at the bottom, rains soaking into the ground you have trains going by better than 50 a day."Each of those factors eroding the cliff side. Down on the beach lies an example of the fight between amn and mother nature. A concrete drain's side sticks out past the eroded cliff by about two feet. Abbott said the same will happen with this project.A seawall has another negative effect, keeping sand from replenishing the beach below. The Coastal Commission made a compromise with SANDAG when they approved the project. SANDAG will build more beach access for pedestrians.Abbott says we need to think long-term, "let's just do a Band-Aid now like the one proposed here, pass it on to the next generation as if it will be simpler for them to solve than it is for us."SANDAG is planning for the long-term, saying they are still looking into options to move the railroad.
