SAN DIEGO, Calif. (KGTV) - A third gender option will be available for California drivers licenses and ID’s starting in 2019. The law, SB 179, was signed by Governor Jerry Brown in October. It will allow people to apply for a ‘non-binary’ gender marker if they do not identify as either male or female. “For me, it was surprising to see this change,” said Al Johnson, a transgender activist and member of Trans Family Support Services. Johnson is non-binary and uses pronouns they/them. But with that surprise, came excitement. “Not only does it mean we’re being recognized by society and the people around us but were also being recognized by government entities as valid and real people,” they said. Johnson says they know people who plan on changing their gender to non-binary, but so far, they have not decided to do it on their own license. “I’ve definitely considered it, but in the end I don’t think I’m going to,” they said. “I just came out to my parents and in my personal life I’m trying to navigate that.” The DMV’s website is encouraging those who want to apply for the change to schedule an appointment as early as January 2, 2019. 1154

Whether for convenience or for price, third-party repair shops are the choice for many customers. Unfortunately, some Apple users with the latest phones say they're not able to go to third-party shops. Four years ago, Christopher McQueen said he found the perfect niche business. “People are always breaking their phones, late at night,” McQueen said.He is the owner of Mobile Cell Doctors. Any brand, any phone, any version. He will come to you and fix your phone.“To be able to fix your phone in 10 minutes, versus a 3-hour fiasco at Apple, it was a need that was definitely there,” McQueen said. He said he can fix any hardware problems, except on the most recent iPhone models - iPhone 8, 8 Plus and X.Just recently, iPhone 8 user Lucas Peckham went to McQueen to get his broken screen replaced. His choices were 0 with McQueen or 9 at the Apple Store. He chose the cheaper, more convenient option.Peckham said everything was flawless until one morning, he woke up to a phone with a frozen screen. He could not swipe, touch, type, or do anything with his device. Peckham said it happened after his phone automatically updated overnight, installing the Apple 11.3 Software.McQueen said he was suddenly inundated with calls from all of his previous iPhone 8 customers. “It’s been a nightmare,” McQueen said. He said he had fixed about 100 iPhone 8’s in the last six months. He suggested to his customers, to do what they hoped to avoid by going to him in the first place - go to the Apple Store. But Peckham said, when he showed Apple the problem, he was told, because he previously used a third-party repairman, they could not repair it. Instead, he had to replace it with a brand new screen for 0 - or buy a whole new phone. “I totally felt screwed,” Peckham said. With no other option, Peckham said he gave in, spending six hours at the Apple Store, and paying up the 0. “It was basically a way for Apple to create kind of a monopoly on the iPhone screen,” Peckham said. Last month, California became the 18th state to introduce a “Right to Repair” Bill, which would require electronics manufacturers to make repair information and parts available to owners and third-party repair shops.McQueen hopes this legislation passes, so mom-and-pop business owners like him also get to have a piece of the pie. “I would love to fix those,” McQueen said. “But until they release the software to run the phones that would allow third-parties to work on those devices, we can’t fix them.”10News spoke to Apple, who said they do work with Authorized third-party dealers that are not Apple Stores. SAN FRANCISCO (AP) — Archaeologists have confirmed a long-time suspicion of historians and say that famed Alcatraz prison was built over a Civil War-era military fortification.SFGate reports researchers have found a series of buildings and tunnels under the prison yard of Alcatraz Federal Penitentiary, which once held Al Capone.A study published in "Near Surface Geophysics" says archaeologists used ground-penetrating radar and terrestrial laser scans and historical maps and photographs.They found fully buried structures, ammunition magazines and tunnels.Historians believe workers built over existing structures when the prison was built in the 20th century.Alcatraz first came to the attention of the U.S. government after it wrestled control of California from Mexico in the 1840s.Its location in San Francisco Bay made it attractive for military fortification purposes. 886

SAN DIEGO (KGTV) -- Dozens of civilian police officers working on San Diego County military bases continue to worry about how they will pay back thousands of dollars the federal government says they owe after a payroll glitch resulted in them being overpaid. Michael Neil, a retired Brigadier General and attorney who also served as commander at Camp Pendleton, says if the officers were indeed paid what they were initially offered they had no reason to suspect anything was wrong. "To me, it's an offer and acceptance and I have a real difficult time seeing the federal government being entitled to get any of the money back," he said. According to the Department of Defense Finance and Accounting services, the Navy mistakenly paid the officers the rate for San Diego  "city" instead of "county". The error began in 2008 but wasn't caught until 2016.Last year, thousands of National Guard soldiers who mistakenly received bonuses and other payments had their debts forgiven. Neil thinks these officers have a stronger case.  In the meantime, Neil also thinks the officers should reach out to lawmakers.Congressman Darrell Issa's office sent this statement to 10News.  1223

SAN DIEGO (KGTV)- It was a battle over workers rights at a rally downtown Thursday. Assemblywoman Lorena Gonzalez directly addressing the group against her proposed Assembly Bill. Assembly Bill 5 would affect any independent contractor including Uber and Lyft drivers, yoga teachers even hairdressers. The group at Thursday’s rally was made up mostly of adult entertainers. “I’ve been doing fine I like the freedom to educate myself and if someone’s going to stop me from that I want to do something about that and voice my opinion," one woman told 10News. The bill would make many independent contractors full time employees, forcing employers to provide overtime, health care and sick leave. Assemblywoman Gonzalez rebutted the group today. "There’s nothing in the law that says an employee has to work from 9 to 6. Any employer can tell you to work two hours, one hour, any hours you choose. There’s nothing in the law that says an employer can’t be flexible.”Some say they don’t want it because they prefer the flexibility and freedom to decide hours that comes with independent contracting. 1104
