VISTA, Calif. (KGTV) - Neighbors in the 700 block of Lemon Avenue in Vista say they were stunned as they watched a landlord pull out a pistol and start shooting at his tenant.Neighbors tell 10News there have been screaming matches at the home in the past. They say the landlord had been trying to evict a tenant who was living in the garage. The neighbors did not wish to share their names out of fear for their family's safety.The watch commander said they received a 9-1-1 call around 6 p.m. when the first shot was fired. Deputies arrived and investigated, then left when they couldn't find the landlord.Around 7:50 p.m. the landlord returned and, according to the watch commander, fired several shots at the tenant.Neighbors said it sounded like fireworks. They said they saw the landlord cocking his pistol, they believed it jammed.A video provided to 10News by neighbors shows deputies with rifles drawn approaching the home.They arrested the landlord and his associate.Details on the man, the associate, the tenant and the charges are not currently known. 1070
VISTA (KNSD) - A Carlsbad man who allegedly drugged and sexually assaulted a 16-year-old girl and raped a woman he met online was charged Wednesday with 17 felony counts.Michael Fangman, 47, faces between 20 and 25 years in state prison if convicted of charges involving the minor, identified only as Jane Doe 1, and the woman, identified only as Jane Doe 2.Fangman was arrested shortly before 8:25 a.m. last Friday at his home, Carlsbad police Sgt. Reid Shipley said.Carlsbad police have been investigating since March when they received the first report of sexual assault. The 16-year-old girl contacted police on March 18 and alleged that she had been sexually assaulted by Fangman, who she had met online, Shipley said.The criminal complaint includes allegations that between March 11 and March 16, Jane Doe 1 was sexually assaulted and was given heroin by Fangman during that timeframe. He faces 14 counts related to Jane Doe 1, as well as three pertaining to Jane Doe 2, including forcible rape.According to the deputy district attorney, Benjamin Barlow, all of the alleged acts took place in Carlsbad in the month of March of this year. The judge ordered a no contact order with Jane Doe 1 and Jane Doe 2. (KGTV) - The mother of a 14-year-old girl sexually assaulted by a San Diego Deputy filed a civil lawsuit citing negligence and invasion of privacy.Deputy Timothy Wilson pleaded guilty to lewd acts on a minor and two counts of unlawfully taking computer data. He’s serving jail time. The victim’s mother, Jennifer Tanis, says Wilson accessed her daughter’s police file 44 times. He was able to get her home address, videos, and pictures of her daughter. She tells 10News she’s suing the county, not for money, but change. Currently, all deputies are allowed to access police files, but she thinks the only person who should have access to them is the lead investigator.She says the county failed her.“There was no system in place to protect my daughter, her story or the pictures they took of her during the investigation," Tanis said.Tanis is pushing for change not only in the county but the entire country. She reached out to Congressman Mike Levin’s office for help. San Diego County has said they have the capability of making police reports private, but only in some cases. Neighbors tell 10News that a husband was arrested for shooting his wife and the two had a troubled history. A suspect in this case was arrested Saturday night by members of the San Diego Sheriff's Homicide Unit. Deputies report that he has been identified as fifty-seven-year-old Andrew Thomas Smith of Vista and he has been booked for murder at the Vista Detention Facility. He is being held without bail. The victim's family has been notified of her death. Deputies report that she has been positively identified as Jean Moore Smith, a fifty-nine-year-old resident of Vista and she was Andrew’s wife. He describes years of verbal abuse that neighbors say the wife directed at her husband and their son. “I would just hear her yelling. She was putting them down, degrading them [and] calling them idiots,” adds Margulies. Neighbors say the adult son may have developmental challenges. Minster saw him just after it all went down. “He had some marks on his face.
