SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.'' The letter also notes Ayala's previously reported statements about killing people.``The deputies had no other option available to them as they Ayala could stab them immediately and seriously injure or kill them,'' the letter reads.Katra has been employed by the San Diego Sheriff's Department for 18 years, McGillicuddy for 12 years and Nulton for 10 years. 2096

SAN DIEGO (KGTV) -- San Diego leaders returned from their trip to Mexico City on Wednesday night. The three-day trip focused on building stronger border relations. The trip comes a week after President Trump threatened to close the border if congress didn't come up with an immigration deal or if Mexico didn't stop migrants heading north. The delegation included San Diego and Imperial Beach mayors, Kevin Faulconer and Serge Dedina and former mayor Jerry Sanders. Several city council members from various cities also attended meeting with top Mexican officials. A big topic of conversation was the ongoing Tijuana sewage issue. Impeiral Beach Mayor, Dedina, says the conversations were positive and promising. Dedina says plans to fix the issue include reapairing the water plant that's currently spilling the sewage, taking all of the water out of the Tijuana River Valley and putting an earth-fill dam on the Mexican side to stop the sewage from getting to the beaches. San Diego leaders say the trip was productive and explained that the end goal was to find solutions to enhance the region for the benefit of both countries. 1142

SAN DIEGO (KGTV) -- A frustrating mystery is plaguing commuters in Carmel Valley.A seemingly perfectly good brand new lane meant to ease traffic to the 56 has been coned off for months. The project adds a third lane on southbound Camino del Sur from around Highland Village place to Highway 56. Greg Agius, who commutes that way, says it's been coned off for months. A city staffer told him it would be complete by the end of August, but on Monday it was still inaccessible to drivers. RELATED: San Diego road repairs are ahead of scheduleAgius, who also bikes in the area, said it is making for a tight merge that has led to near fender benders. "It's backing up my commute," he said. "I've actually over the last three to four months had maybe half a dozen close calls."The lane is meant to lighten the congestion in Carmel Valley, which is getting increasingly congested as more housing is built. Developer Lennar hired contractor MGI to add the lane as part of its approval for area housing projects. RELATED: San Diego projects receive funding due to controversial gas tax"This is the one that baffles me the most because it's more dangerous what they've done with the cones than if the cones weren't here," Agius said. The problem rests with the traffic light at the intersection. It doesn't stretch far enough over to be visible to all cars in the new lane. Caltrans Spokesman Ed Cartagena gave an example of cars next to a semi-truck.They wouldn't be able to see the traffic light if not in front of them. Cartagena said it needs to be extended before anyone can benefit from the new asphalt. He also noted recent other work on the lane, above and below ground, including removal of an electric box ten inches above ground.  Either way, Cartagena said the new light should be installed by the end of the week, clearing the way for the lane to open. A city spokesman said the contractor had delays in obtaining the signal pole and mast-arm for the traffic light. SAN DIEGO (KGTV) — A 42-year-old man was arrested and charged with sexually assaulting a woman in her Talmadge apartment before stealing her car.Friday, San Diego Police arrested Leonard Derrick was arrested and charged with burglary and sexual assault.On March 22, the victim ran to a neighbor's home and reported she had been sexually assaulted. SAN DIEGO (KGTV) -- A driver apparently lost control of his SUV and crash landed on the roof of a University City home early Tuesday morning.The crash happened at around 1:15 a.m. in the 3000 block of Pennant Way, according to San Diego police.Bill Crane told ABC 10News that after he heard a loud crash, he came out of his home and saw the male driver in his yard and the Jeep Cherokee Laredo on top of his next-door neighbor’s house."I was asleep at the time and I heard this crash, and I came out and I looked around and saw a guy kind of wandering near behind me, by what's left of the tree, and he was just kind of stumbling and I couldn't figure out what the hell that was. Because you usually don't think of a car being on someone's roof. So, when I finally figured that out, I went in to get my phone, and came back out and called 911, and he was gone,” Crane said.Crane called 911 to report the crash, and he then called the woman who lives in the house. However, Crane said the woman initially didn’t believe her.Crane added, "I called her twice and she said, 'What, a car on my roof? I'm not going out there, I can't believe that.’ It is pretty unbelievable.”ABC 10News learned the woman was asleep at the time and never heard the crash. She believes the SUV was coming down Pennant Way, somehow veered on a resident’s front lawn and launched onto her garage.A towing service used a crane to remove the Jeep from the roof of the home’s garage.There is no word on how much damage the home sustained, but inspectors said the house was structurally sound despite the wreck.No one was hurt in the crash.As of late Tuesday morning, police have not tracked down the SUV's driver. 1692
