TERRE HAUTE, Ind. — An upcoming rule change at the U.S. Department of Justice means federal inmate executions, which are currently carried out by lethal injection could happen by other means, such as a firing squad or electrocution.Currently, all federal executions are done via lethal injection unless a court specifically orders otherwise. The rule change gives the federal government greater flexibility to execute people by other means.The change states that federal executions are to be carried out by lethal injection “or by any other manner prescribed by the law of the State in which the sentence was imposed or which has been designated by a court.”According to the Death Penalty Information Center, all states that allow the death penalty authorize a lethal injection method. Nine states allow electrocution, seven allow lethal gas and three allow a firing squad. Most states that allow methods other than lethal injection do so only under the provision that the injection is found to be unconstitutional, unavailable or impractical.The DOJ rule change goes into effect on Dec. 24, before three more federal inmates are scheduled to be executed. Inmates are scheduled to be executed on Jan. 12, Jan. 14 and Jan. 15.If executions by other means will happen, it’s unlikely they will happen at the Federal Bureau of Prisons in Terre Haute, where federal executions typically take place. The DOJ notice states that the Terre Haute complex is equipped for carrying out executions only by lethal injection. TALLAHASSEE, Fla. — A Florida judge sided with a state teacher's union Monday in ruling that the Florida Department of Education could not require all brick and mortar schools to open by the end of the month or lose funding.Leon County Circuit Judge Charles Dodson ruled in favor of the Florida Education Association (FEA), in a lawsuit meant to stop the Education Department's order that would require all schools in the state to reopen for in-person classes by Aug. 31 or face loss of funding. The union filed their lawsuit shortly after the mandate was issued on July 6, claiming the order was in violation of the constitution's safe and secure public education guarantee.The FEA said Monday's ruling is a victory for schools all around the state of Florida."It is a pushback on reckless disregard on human life," said Randi Weingarten, the president of the American Federation of Teachers. "It is a pushback on politics overtaking safety and the science and the well being of communities."Fred Piccolo, a spokesperson for the governor's office, said the state intended to appeal the ruling."We intend to appeal this ruling and are confident in our position and in the authority of the Commissioner and the Governor to do what is best for our students," Piccolo said.The legal team for the FEA says the state can appeal, which would mean an automatic stay in the ruling given Monday. Ten people have died after a Florida nursing home failed to evacuate its residents, who suffered for days in oppressive heat with no air conditioning after Hurricane Irma, according to the Hollywood Police Department.A 93-year-old man died on Tuesday, and a 94-year-old woman died on Wednesday -- adding to eight who were found dead last week at the Rehabilitation Center at Hollywood Hills, or who died after being evacuated to a hospital.The exact causes of death have not been reported, but a number of the 141 residents who were evacuated were treated for heat-related issues. An ongoing criminal investigation is underway.Nursing home residents sweltered in hazardous conditions after Hurricane Irma, which felled a tree that knocked out the transformer powering the air conditioning system. Many were moved into the hallways, next to fans and spot coolers. One video obtained by CNN shows a naked woman sitting in the hallway on what appears to be a hospital bed.Despite multiple calls between the nursing home and state authorities, at no time did the nursing home report that their patients were in danger or that they needed to be evacuated, according to a report on Tuesday by Florida Governor Rick Scott's office. The state advised managers "multiple times" to call 911 if such a situation arose."Something they failed to do," the 159-page report said."This facility is failing to take responsibility for the fact that they delayed calling 911 and made the decision not to evacuate their patients to one of the largest hospitals in Florida, which is directly across the street," Scott said in a statement.Last week, the nursing home expressed its sympathy for the families of the deceased and said it is "fully cooperating with all authorities and regulators to assess what went wrong." A moratorium was imposed on the facility that prevents it from admitting any patients."This healthcare facility failed to do their basic duty to protect life," Scott said. (AP) -- Sheriff's officials in Florida say a 24-year-old South Carolina man is accused of invading the home of a WWE star near Tampa.Phillip Thomas II was arrested Sunday after officials say he entered the home of wrestler Sonya Deville, setting off a security alarm.Hillsborough Sheriff's officials say the 26-year-old victim, real name Daria Berenato, spotted Thomas on the property after the alarm rang and called 911 as she fled with a guest in a car.Arriving deputies found Thomas at the home with a knife, plastic zip ties, duct tape and mace.
