SAN DIEGO (CNS) - A judge took under submission today a motion by the federal government to dismiss a lawsuit filed by the cities of Imperial Beach and Chula Vista and the Port of San Diego, alleging that the International Boundary and Water Commission is violating the Clean Water Act by not doing more to prevent Tijuana sewage from flowing into San Diego area waters.The federal government maintains that the IBWC isn't legally responsible for the sewage flowing into U.S. waters from Mexico.But the plaintiffs claim that since the IBWC oversees a flood control channel that redirects the Tijuana River on its way to the Pacific Ocean, as well as water- capture basins in five canyons along the border, the agency is responsible for the sewage that gets through those systems.RELATED: Imperial Beach businesses hurt by sewage & runoff related closuresImperial Beach Mayor Serge Dedina, who has led the fight to against the IBWC since his city was hit with millions of gallons of raw sewage in February 2017, said it was heartening to hear U.S. District Judge Jeffrey Miller say he might go to the South Bay to see first-hand how the situation is being handled.Dedina said the plaintiffs got a fair hearing. SAN DIEGO (CNS) -- Hundreds of thousands of San Diegans are expected to cast their ballots in person today, Election Day, with over 1 million ballots already received.The San Diego County Registrar of Voters said more than 1.1 million ballots have been received and nearly 60,000 residents have voted early in-person as of Monday, well more than double when compared to this point in the 2016 presidential election.Of the 1.95 million registered voters in the county, 1,114,627 had already turned in their ballots as of election eve. SAN DIEGO (CNS) - An 18-year-old man was shot twice in the stomach during an armed robbery early Thursday morning in a Mission Beach parking lot, police said.Two 18-year-old men were in a car leaving a party at the Bahia Resort Hotel, 998 West Mission Bay Drive, when they were approached by two men on foot in a public parking lot on Gleason Road at around 12:30 a.m.One of the men on foot pulled out a gun and pointed it at the pair in the car while demanding items from them, San Diego Police Department Officer Robert Heims said. The victims got out of the car and the man with the gun stole a chain necklace from one of the victims.The other victim tackled the gunman and was shot twice in the stomach, the officer said.The suspects fled in an unknown vehicle and the victim who had his necklace stolen drove the gunshot victim to a hospital for treatment of his wounds, Heims said. Jerry Brown today appointed a former Del Mar councilman to the 22nd District Agricultural Association Board of Directors and reappointed two other San Diego County residents to the panel.Brown named Del Mar resident Donald Mosier, 74, to a four-year term on the board that governs the Del Mar Fairgrounds on behalf of the state via a nine-member board of directors. The governor appoints each member of the board to serve a four-year term.The District Agricultural Association is a subdivision of the California Department of Food and Agriculture, charged with holding fairs and exhibitions that highlight "various industries, enterprises, resources, and products of the state," according to the CDFA.The governor reappointed attorney Frederick Schenk, 65, and Lisa Barkett, 59, who have served since 2011.Mosier is the Climate Action Plan facilitator for the city of Del Mar and is a member of multiple governing boards, including the Del Mar Community Connections Board, the American Association for the Advancement of Science and the Climate Action Campaign Board of Directors. SAN DIEGO (CNS) - Authorities reached out to the public today for information about an Egyptian man who was found dead under potentially suspicious circumstances off the coast of Mission Beach.The body of 37-year-old Haitham "Max" Elshayeb was floating about two and a half miles from shore when a fisherman on a boat spotted it shortly before 10:30 a.m. Oct. 10, San Diego police said.The body, dressed only in surfer-style shorts, didn't show any obvious signs of traumatic injuries, Lt. Anthony Dupree said. A possibly suspicious circumstance, however, was a chain wrapped around the dead man's waist, though it might have been used simply as a belt or style accessory, the lieutenant said.Homicide detectives were called in to investigate the fatality "out of an abundance of caution," and the death has been classified as suspicious, Dupree said. A ruling on the cause of Elshayeb's death remained on hold this week pending completion of postmortem exams.Police hope to contact people who had contact with Elshayeb in the days and weeks leading to his death, Dupree said.Anyone with information about the case is asked to call San Diego County Crime Stoppers at (888) 580-8477.
