(KGTV)- School leaders in a north county school district are trying to figure out how to address a legal petition filed by their teachers' union.The San Dieguito Union High School District Board of Trustees held an emergency closed-door meeting Tuesday at Earl Warren Middle School in Solana Beach.A few dozen students and some parents gathered outside the school to protest the district's plan to return to in-person instruction in January."Our teachers have taught us to stand up for what's right, and we see that the board is not listening to their needs, their concerns, they're putting their lives at risk, so we are here to support our teachers," said student Andrea Gately.Parent Julie Bronstein said distance learning is not ideal, but she doesn't think it's safe for kids to return when the virus is surging."Why can't we just wait a bit more, get ourselves out of the danger zone, get beyond the surge, make sure teachers are able to be vaccinated to the extent possible, and then reopen in a grander fashion," said Bronstein.Late last Tuesday night, the San Dieguito Union High School District Board of Trustees voted to give students the option to return to school one day a week on January 4th, then five days a week for in-person instruction on January 27th.Parents like Jane Woltman say students should have returned to class months ago."When they asked if kids wanted to go back full time in October, 80% of those parents said yes, yet we didn't go back then. We weren't in the purple tier then," said Woltman.Woltman has two kids at La Costa Canyon High School."I just think the social well being of kids is diminishing. Kids are losing engagement, and basically, this is a teaching model that was not intended to be long term," said Woltman.Friday, the California Teachers Association filed a legal petition on behalf of the local teachers' union to block the January return.Duncan Brown is a counselor at Diegueno Middle School and Oak Crest Middle School. He's also the president of the San Dieguito Faculty Association. He says the district's plan violates the governor's regional stay at home order."It goes against CDC guidelines, it goes against CDPH rules, most districts have reconsidered reopening plans, but San Dieguito continues to move forward," said Brown.Under the state's health mandate, schools that were already open for in-person instruction were allowed to stay open when the county fell back into the purple tier. The union is challenging the district's definition of what is considered an open school."All the instruction is done through small cohorts, and we believe the intent of the reopening plan was if grades were going through a reopening. For example, 9th and 10th grade were invited back, then under those kinds of understandings, 11th and 12th graders would be able to continue the reopening as well," said Brown.Parents who believe kids should be back in school say the union is just delaying things."I just think it's a stall tactic, and the union doesn't want to go back period. I don't think that's the voice of a lot of teachers who are afraid of ramifications if they speak up," said Woltman.The board president says the district's reopening plan follows the guidance issued by The California Department of Public Health and includes detailed protocols for distancing and ventilation.Teachers in high-risk groups for the virus or with childcare issues can continue teaching remotely until January 27th, but the district hasn't decided beyond that. 3529

Facebook announced Monday that it’s updating its hate speech policy to prohibit any content that denies or distorts the Holocaust.The company says it has already banned more than 250 white supremacist organizations and updated its policies to address militia groups and QAnon. (KGTV) -- The County is investigating complaints from neighbors that a business owner with a criminal history for fraud may have converted a former hotel into a drug treatment center without proper permitting.Residents living near the former site of the Tuscany Village Resort on Circle R Way in unincorporated Escondido say they started noticing people wandering trough their neighborhood this summer."The people that are staying there have told us they're getting treatment," said one neighbor, who asked not to be identified.The property was acquired in March by NSI Services, LLC, according to public records. The company identifies itself as a "drug rehab" in its incorporating paperwork."Our concern is the safety and well-being of our community with a gentleman who seems to have disregard for the law," the resident said.NSI Services is owned by Larry Burns, an entrepreneur with several aliases who served prison time for mail and wire fraud and has been charged with crimes in at least three states.Burns, who also goes by Lawrence Burzynski, did not respond to phone calls by 10News seeking comment Monday or Tuesday.Burns was once the president of the Escondido-based Crosby Centers and is listed as a director of the Crosby Clinic on its website. Neighbors say they've seen a Crosby Clinic van parked at the resort.The clinic advertises drug rehab services along with treatments for traumatic brain injuries and CTE, and attracted media attention for treating former NFL players. In 2015, the NFL Players Association issued a warning to players about Burns, urging players using his services to "exercise extreme caution."Burzynski "has accumulated numerous convictions for felony FRAUD related violations," the bulletin read. "He has been convicted in federal prosecutions in Wyoming, Colorado, California and elsewhere."The old Tuscany Village Resort is not zoned for drug rehabilitation or medical services. After complaints by neighbors, code compliance inspectors began investigating the property on August 7, according to a letter from County Planning and Development Services Director Mark Wardlaw.The owner "indicated they had not yet finalized their plans for the property" but "noted that he may use the property as a resort that may also provide brain injury and other medical treatments," the letter stated. The owner, who was not identified in the letter, said he did not intend to offer drug or alcohol treatments at the facility."We will continue to keep our code compliance case open until we have received all the information required to classify the use," Wardlaw wrote.Staff gave the owner a 0 citation on September 12 for improperly storing items in the parking lot. When a 10News reporter visited the property Monday, there was still furniture and other items in the parking lot.The owner has until October 9 to clean up the property, said County spokeswoman Tammy Glenn."We will continue to update residents in the area and work with the property owner to ensure compliance with County codes," she said.Late Tuesday, a man who identified himself as one of Burns' employees contacted 10News, saying the hotel was undergoing renovations and would open next year as a Bavarian-style spa. The man named Jeff said other than himself, no other Crosby Clinic employees were working at the property and the resort would not be used for drug treatment."They think because they see a Crosby van it's going to be drug and alcohol [treatment], but that's not the case," he said. ESCONDIDO, Calif (KGTV) -- A Palomar Water delivery man is being credited for saving the life of an elderly woman who fell and couldn't get up to call for help. On Monday, Marco Perea showed up to deliver water for his 88-year-old customer in Escondido. When he knocked on her door, he could hear her, but she wouldn't come to the door. After several attempts to get her to open the door, she was able to tell him that she'd fall on Sunday afternoon and hadn't been able to get up since then. Perea called 911 and paramedics and firefighters were able to make entry into the apartment. The woman was rushed to the hospital. Perea says the woman does have a caregiver, but only from Monday through Fridays. The woman's condition is still unknown. 755

FALLBROOK, Calif. (KGTV) - A motorcyclist suffered life-threatening injuries Friday when a tree fell on him during a period of high winds in Fallbrook.The tree that injured the motorcycle rider fell on South Mission Road and West Elder Street, according to North County Fire. The unidentified man was flown to Palomar Hospital. Another tree fell at De Luz Road and Patton Oaks Friday afternoon, shutting down De Luz for about two hours. San Diego County Roads crews assisted firefighters in clearing the street.
