SAN DIEGO (KGTV) -- A new report by the California State Auditor says some law enforcement agencies are using automated license plate readers without legally required oversight procedures, which could leave drivers vulnerable to a host of privacy concerns including data breaches and even blackmail.The Electronic Frontier Foundation called the audit a “damning assessment of how California law enforcement agencies use this mass-surveillance technology.”Nearly every local law enforcement agency in San Diego County uses the automated readers, although none were audited in the report released Wednesday. In survey responses to the state, nine local agencies confirmed use of the camera systems; Oceanside Police Department did not respond to the survey. An automated license plate reader (ALPR) can be mounted at intersections or on patrol cars. It scans license plates to figure out if a vehicle is connected to a crime. The images are then stored in databases and “reveal the daily patterns of vehicles that can be linked to individuals and their activities—most of whom have not engaged in criminal activity,” the audit notes. The report looked at four agencies in depth: Fresno Police Department, Los Angeles Police Department, Marin County Sheriff’s Office, and Sacramento County Sheriff’s Office. It found concerns with the way those agencies are storing images on third-party servers, and a lack of oversight to ensure people with access to the databases don’t run searches for personal use or blackmail.“A member of law enforcement could misuse ALPR images to stalk an individual or observe vehicles at particular locations and events, such as doctors’ offices or clinics and political rallies. Despite these risks, the agencies we reviewed conduct little to no auditing of users’ searches,” the report concluded.None of the four agencies was fully in compliance with a 2016 law requiring detailed written policies on automated license plate reader (ALPR) systems, according to the report.“In general, we determined that the law enforcement agencies we reviewed must better protect individuals’ privacy through ensuring that their policies reflect state law,” said California State Auditor Elaine Howle in a letter to the governor. “In addition, we found that these agencies must improve their ALPR data security, make more informed decisions about sharing their ALPR data, and expand their oversight of ALPR users.”The San Diego Police Department has 27 license plate readers attached to police vehicles. SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. SAN DIEGO (KGTV) - A homeowner in Clairemont hopes surveillance video is the key to tracking down the intruder who climbed straight through his window, before making off with some family heirlooms.Just off Balboa Avenue around 1:30 p.m. Monday, a man is seen ringing the doorbell at the home of Jeff Howell. After minutes of ringing and knocking, the man is recorded heading for the backyard, where he peers into the patio door and grabs a chair. He then pries open a locked window, steps onto the chair and into the home.MAP: Track crime happening in your neighborhood"Just a sense of violation," said Howell.The man is then seen on the phone, possibly with a lookout."You can hear him discussing 'it's safe now' or 'somebody just went by,'" said Howell.Moments later, the man heads straight for the bedroom closet, dragging out a small safe, before carrying it out the front door.By the time Howell saw his text alert, the intruder was gone. The man was in the home for about 15 minutes. Inside the safe: authentication documents for artwork and family heirlooms belonging to his 11-year-old son, including a silver spoon given to him at birth and something from his rodeo-competing great-grandfather, who has passed."He had a prize-winning, silver belt buckle. SAN DIEGO (KGTV) - A plan to essentially force 16 Lemon Grove teachers to resign was approved Tuesday night in a 3-2 vote. The Lemon Grove School District informed the teachers that it would move in a different direction at the end of this school year. The teachers were at the district for two years, the end of their probationary period. Any more time and they would become permanent. The district says it will replace those positions with new teachers for next year. "Our governing board believes that each child deserves the very best," the district said in a statement. "We will continue to provide that to you in Lemon Grove School District.""Why aren't we maintaining the teachers that have been here and have built relationships with our children? Built relationships with our parents? With our community," parent Rosa Carney said. Angela Vento, who has four children in the district, said her 9-year-old son Joshua was upset when he found out his teacher would be let go."She's always there for him," Vento said. "He has epilepsy and she helps him through that."Two teachers who asked to remain anonymous said the district gave them a choice of resigning, or being terminated with a non-renewal status.
