Read more about the case in the Team 10 report below. SAN DIEGO (KGTV) - A local doctor is accused of sexually assaulting patients who were under anesthesia. In an exclusive interview, 10News investigative reporter Jennifer Kastner spoke to a former patient who says he was abused. She also sat down with the accused doctor for an interview. The doctor was cleared to return to work and denies any abuse.Edward Braun of Alpine is the former patient. He says he found out when Scripps Mercy Hospital in Hillcrest called him and said that a nurse had reported the allegations. “I’m sad. I can't believe somebody would do this,” Braun tells 10News. Braun details the day he got the life-changing call from Scripps Mercy, notifying him that he may have been sexually assaulted by his anesthesiologist, Dr. Robert Stephens, while Braun was under anesthesia for surgery. “I was stunned. I was shaking,” he adds. “What I was accused of never happened,” Dr. Stephens tells 10News. He says he doesn't even remember Braun's surgery. “Given that I've done 5,000 plus surgeries, only the remarkable ones stand out and that entire day was thoroughly unremarkable,” he adds. However, it doesn't end with that day and that patient. The allegations are from 2017 and are detailed in a report published by the California Department of Public Health. In the report, three nurses came forward, and mentioned multiple patients. One nurse claimed to have witnessed the anesthesiologist's hand "underneath the sheets on four other occasions" when patients were "under general anesthesia". The report reveals that the nurse who allegedly witnessed Braun's assault claimed that the doctor's hand was under Braun's blanket, by Braun's groin. “She tried to pull the blanket off and he pulled it back and then she yanked it off and saw what he was doing,” says Braun. “I was still under anesthesia, unconscious when it happened,” he adds. “I have never been inappropriate with any of my patients, nor would I ever be,” says Dr. Stephens. We ask, “Why would three nurses falsely accuse you of something so egregious?” “It's speculation and I don't want to speculate. I don't see any benefit of me speculating in that respect,” he responds. According to the state report, the doctor said he sometimes may have had his hand "under the drapes" to "check EKG leads" and "monitor leads". In the report, it appears the nurses were the ones who got in trouble for not immediately and appropriately reporting what they allegedly witnessed. However, there's no mention of any corrective action for the doctor. “[The nurses] report something and they get reprimanded for it? That's not right,” Braun tells us. The hospital sent 10News the following statement: “Patient safety is a top priority at Scripps. While we are unable to comment on pending litigation, we can share that following allegations of improper conduct, the Medical Staffs of Scripps Mercy Hospital, Scripps Green Hospital and Scripps Memorial Hospital, Encinitas suspended Robert Stephens, M.D., and initiated a hearing before an arbitrator. After five full-day evidentiary sessions, the arbitrator found that, while the initial action was reasonable, the suspension was no longer reasonable and Dr. Stephens should be permitted to return to work. Subsequently, the parties reached a confidential agreement. After the agreement was reached, Dr. Stephens voluntarily resigned his Scripps Medical staff memberships and all clinical privileges.” Dr. Stephens says the arbitrator reviewed all the records and witness testimony. “[The arbitrator] ruled that not only was their story changing on that side but that their witnesses were not credible [and] their witnesses were not believable [and] I was credible and honest,” he explains.San Diego Police have an active criminal investigation, according to a Deputy District Attorney who's involved in the case. That DA confirmed that prosecutors have fought all the way up to the California Supreme Court to get records from Scripps Mercy Hospital, but have so far been unsuccessful. The DA agreed that his office is putting up a more aggressive fight than what's typical, but he wouldn't comment further about why. “I put my life in this guy's hands to take care of me and he abused his power,” says Braun. Last month, Braun sued Dr. Stephens, Scripps Health and Anesthesia Service Medical Group for assault, battery and negligence, among other complaints. Anesthesia Service Medical Group is Dr. Stephens’ former employer. It sent 10News the following statement: “ASMG was shocked and saddened to learn of the allegations made against Dr. Robert Stephens, a former employee of ASMG. From the moment ASMG learned of these allegations, Dr. Stephens has not provided care to any ASMG patients. Dr. Stephens was hired after very extensive background and credentialing checks, and up until the time these accusations were made, there was nothing to indicate that Dr. Stephens might present a risk to patients. ASMG is committed to hiring only those physicians who will provide the highest level of patient care, and will aggressively defend itself against any claim that it negligently hired or negligently employed Dr. Stephens.” “The initial allegations are very catchy and they do pack a punch but they aren't the truth,” says Stephens. TUCSON, Arizona — A Tucson, Arizona man who had been in an altercation fired a gun at a police officers, hitting one of the officer's belt. The belt prevented a bullet from entering his body.That man, 51-year-old Roy King, was in a bar with his wife and family when an argument started. King's stepson, who was at the bar, called 9-1-1.During the argument in the bar, King allegedly pulled out a handgun and threatened two people. King then headed to his home.Tucson police officers went to the home in response to the 9-1-1 call and found King's vehicle in the driveway. When the officers approached the car, King started to yell at them from the backyard. He still had the handgun.During the confrontation between King and two officers, gunfire was exchanged. One of the rounds fired by King hit an officer's duty belt. The belt stopped the bullet from injuring the officer.King then went inside his home and called 9-1-1. Additional TPD officers went to the home and were able to talk King into coming outside. He was not injured and was taken into custody.Roy King was booked into Pima County Jail on two counts of aggravated assault with a deadly weapon. One for the incident at the bar, and one for the incident at the home.The incident is still under investigation. 1310

Two leading Democratic senators want answers from Aetna Chairman and CEO Mark Bertolini after a former medical director admitted under oath that he never read patients' medical records.Ron Wyden of Oregon, the ranking member of the Senate Finance Committee, and Patty Murray of Washington, the ranking member of the Senate Health Committee, fired off a joint letter to Bertolini this week, saying the medical director's comments raise serious concerns about Aetna's claims review process and whether the insurance giant has broken federal law. They asked the company to respond to the letter by March 20."Using medical records is a fundamental responsibility of health insurers when they review health claims," Wyden said in a statement. It adds to a series of significant allegations leveled by unidentified current and former colleagues, including that he casually dispensed prescription drugs.Jackson and the White House have continued to deny allegations of misconduct, and Jackson's defenders in the White House said Monday that the episode involving Mrs. Pence was simply a dispute between two doctors with a strained relationship and that he had acted appropriately.According to copies of internal documents obtained by CNN, Pence's doctor accused Jackson of overstepping his authority and inappropriately intervening in a medical situation involving the second lady as well as potentially violating federal privacy rights by briefing White House staff and disclosing details to other medical providers -- but not appropriately consulting with the vice president's physician.The vice president's physician later wrote in a memo of feeling intimidated by an irate Jackson during a confrontation over the physician's concerns. Even though Jackson is responsible for caring for Trump, he intervened in the situation involving Mrs. Pence, leading to "an inadvertent disclosure of SLOTUS' medical information in a situation where ultimate discretion was of utmost importance," according to the memo, which does not describe the information disclosed.Jackson asked for several reports on her condition from the physicians who initially treated her at Camp David, though the physician noted it was done "without malicious intent to circumvent their medical knowledge."Jackson then shared information with the senior medical providers involved in the matter, and according to the memo, briefed "multiple parties" on Trump's White House staff "without specific consultation from the physician to the vice president," prompting the concerns that he disclosed Mrs. Pence's private information. He made an order to call in the on-duty specialist at Walter Reed and made plans for her evacuation from Camp David, according to the memo, though he later denied doing so in a private meeting with the physician.On September 11, 2017, Pence's physician briefed Ayers about "this breach of her patient information" under the federal law known as the Health Insurance Portability and Accountability Act, or HIPAA, by disclosing information to various parties. The physician was later directed by Mrs. Pence to tell Ayers to relay the information to Kelly, after the second lady expressed concerns about the potential her medical information was disclosed."Dr. Jackson stated that it is not always possible to adhere to HIPAA at the White House," the memo said. The memo said that Jackson asserted to the physician that "he must be involved" in medical issues at Camp David and Walter Reed because they are "presidential assets" -- even if those medical issues don't involve the First Family.The White House has pushed back against previous suggestions that Jackson may have violated the privacy law while serving as a physician to the President. "Dr. Jackson's record as a White House physician has been impeccable," press secretary Sarah Sanders said at a press briefing last week. "In fact, because Dr. Jackson has worked within arm's reach of three Presidents, he has received more vetting than most nominees."But Jackson's behavior towards his colleagues -- particularly people who worked for him in the White House medical unit -- has also come under sharp scrutiny. According to the memos, the physician had two contentious meetings with Jackson.In one meeting, the physician wrote, Jackson "expressed anger" that White House officials -- including Kelly -- were aware of the physician's concerns over his involvement in the medical situation involving the second lady, the memo said.The next day, Jackson had another tense encounter with the physician, according to the memo. Jackson said that Kelly was "good with him and everything" -- and Jackson urged the doctor to let the matter go. Two police officers were shot Wednesday evening in Louisville amid protests following an announcement that the two officers involved in fatally shooting Breonna Taylor would not be criminally charged, Louisville Metro Police Chief Robert Schroeder confirmed.The officers are in "very serious condition," but they're expected to survive their injuries, Schroeder told reporters. One of the officers needed surgery following Wednesday's incident.
