SAN DIEGO (KGTV) -- Police are investigating after a man was shot several times at a party in Paradise Hills early Sunday morning. According to police, the incident happened on the 2400 block of Hopkins Street just after 2 a.m. Police say the 30-year-old was attending a party at a nearby home when an unknown suspect or suspects shot him several times. Party guests reportedly took the man to the hospital where he underwent surgery. Police say the man is expected to survive his injuries. At this time, police say there is no information on the suspect in the shooting. 580

SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. SAN DIEGO (KGTV) -- Police Monday identified the suspect who reportedly threatened officers with a knife before being shot in the Midway District last week. According to police, Ryan Bowers, 23, was shot by Officer Matthew Steinbach after raising a knife toward officers. Police responded to the 3100 block of Cauby Street just before 10 p.m. January 3 after a caller said Bowers cut his own throat with a knife before it was taken away. According to police, that’s when Bowers pulled a knife out of his jacket and raised it toward officers. The officers drew their weapons while telling Bowers to back up, which he refused to do. “Fearing for his safety, one officer fired his weapon at the male striking him at least once,” police said. Officers administered medical aid to Bowers until paramedics arrived and took him to the hospital with life-threatening injuries. 1036

SAN DIEGO (KGTV) - Police have identified a man who was fatally shot in the Midway District this week, prompting a standoff with the suspect of the murder in North Park.San Diego Police received a report of the shooting just before 11 a.m. Sunday in the rear parking lot of the 24 Hour Fitness at 3675 Midway Drive. Police arrived to find 27-year-old Alexander Mazin of San Diego suffering from a gunshot wound to the torso.Despite medial aid at the scene, Mazin died at the scene.RELATED: Fatal shooting leads to standoff between police, suspect in North ParkFollowing the shooting, police were led to the intersection of 30th Street and Upas St where an hours-long standoff began.Once SWAT teams entered the apartment, however, they did not find the suspect — identified as 41-year-old Ernesto Castallenos Martinez. SAN DIEGO (KGTV) - On Monday afternoon, two brothers were sentenced in connection to the deadly freeway shooting of a Navy sailor who stopped to be a good Samaritan.Edson Acuna and Brandon Acuna learned their sentences following the 2018 shooting death of Navy sailor Curtis Adams. Edson Acuna was given a term of life without the possibility of parole plus 25 years to life plus 27 years and four months. He was ordered to pay ,000 in restitution and pay for associated fines. “He's going to be in prison for the rest of his life until he takes his last breath and I think that will give him time to pay these from prison wages,” the judge told the courtroom.Edson Acuna was convicted by jury of first degree murder while Brandon Acuna pleaded guilty to voluntary manslaughter. On Monday, Brandon Acuna was sentenced to 13 years in prison.Prosecutors argued that they burglarized a car outside of a Mount Hope home which led to a shootout with the homeowner. They tried to get away but a blown-out tire caused them to stall on the freeway. Adams stopped to help but Edson Acuna shot him after thinking that he was the homeowner from the shootout earlier in the night.Harvey Liberato and Susana Galvan were also in the brothers’ car and have entered plea agreements.The judge concluded the hearing by telling the courtroom that he hopes both men reflect in the years to come on the magnitude of the loss that their actions caused. 1441
