INDIANAPOLIS —  When educators lose their licenses due to misconduct, that doesn’t necessarily mean they can no longer work with children in Indiana.Todd Boldry, a teacher and basketball coach in Knox County schools, was arrested and charged for child seduction. The state revoked his teaching license in 2013 when Boldry voluntarily surrendered it in exchange for prosecutors dropping the criminal charges.Boldry went on to work with teens as a basketball coach for Indiana Dawgz, a travel team in northwest Indiana.While schools have to perform background checks when hiring, there’s no standard procedure for non-school sports teams, churches, volunteer groups, and other organizations.“It would surprise me very little,” said Mike McCarty, a former detective and owner of Safe Hiring Solutions, a Danville company that runs background checks on school employees.“Most volunteer organizations that work or serve with children, it’s a policy issue, it’s not a law issue,” McCarty said. “There’s no standard requirement and there’s no standard for what a background check is."McCarty said many groups make the mistake of relying on the state’s sex offender registry before hiring.“These registries can be terribly outdated, and they vary from state to state,” he said. “It’s very easy to be a convicted sex offender but not be required to register as a sex offender based on plea agreements or a reduction in sentence.”Some educators who lost their state licenses after they were convicted of crimes against children were not on the sex offender registry.Bruce Ryan was convicted in 2011 of sexual misconduct with a minor after an inappropriate relationship with a student at Charles A. Tindley School, but he’s not on the sex offender registry.Former MSD of Wayne Township administrator John Maples was convicted in 2013 of disseminating matter harmful to minors.Maples lost his educator license, but he’s not on the sex offender registry.Similarly, ex-IPS counselor Shana Taylor, accused of having sex with students, lost her state license, but is not on the sex offender registry after pleading guilty to three felony counts of dissemination of matter harmful to minors.Since 2012, the Indiana Department of Education has revoked or suspended the licenses of 108 educators including teachers, counselors and administrators.The top reason – child seduction.ISTEP impropriety, sexual misconduct with a minor, battery, child pornography and child exploitations were among the other reasons for educators losing their licenses to work with children.Under state law, the Indiana Department of Education automatically and permanently revokes licenses after certain offenses, such as child molesting, child solicitation, child exploitation, sexual misconduct with a minor and rape. 2791

INDIANAPOLIS -- 14 offenders at the Indiana Women's Prison are now enrolled in a year-long program that will teach them how to create web applications.The non-profit "Last Mile" is offering the software engineering training. Governor Eric Holcomb joined members of the first class on Thursday, along with Last Mile board members, including rapper and entrepreneur MC Hammer, to kick off the program."I've been in and out of DOC a few times in my life in the past, so I know firsthand about some of the stumbling blocks that exist. Therefore, when I heard about this program, it just really inspired me to apply, because I want to be a success," said Stacy Jennings, a Last Mile participant.Fifty women applied for the program but only 14 were selected.The idea is to arm the women with the skills needed to knock down barriers and land a job once their time behind bars is done.Business and community partners will offer internships."What I hope to get is a new beginning. The opportunity to be able to support myself, be financially stable and also help others to know it's never too late to keep moving forward," Jennings said. Introduction on coding in the Indiana Women's Prison starts on Monday. The women will be in class about 30 hours per week.Indiana is the second state in the nation to launch "Last Mile."  1365

Issues of race relations has become a major campaign issue in this year’s presidential election, with the issue getting pushed to the forefront following the Memorial Day death of George Floyd while in Minneapolis police custody.During Thursday’s presidential debate, President Donald Trump declared himself the “least racist person in this room” after he decried the Black Lives Matter movement.“The first time I ever heard of Black Lives Matter, they were chanting ‘pigs in a blanket,’ talking about police,” Trump said. “‘Pigs in a blanket, fry them like bacon.’ I said that is a horrible thing. And they were marching down the street. And that was my first glimpse of the black lives matter. I thought it was a terrible thing.“As far as my relationships with all people, I think I have great relationships with all people. I am the least racist person in this room.”Both Trump and former Vice President Joe Biden had a spirited exchange about Biden’s record on race relations. Trump confronted Biden for his support of the Crime Bill in the 1990s while a US Senator.“I said not since Abraham Lincoln has anybody done what I've done for the Black community,” Trump said. “You have done nothing other than the crime bill which put tens of thousands of black men, mostly, in jail.”While there are sections of the bill Biden continues to back, including an assault weapons ban and the Violence Against Women Act, Biden has shied away from backing mandatory minimum sentences for drug crimes.“It was a mistake,” Biden said. “I've been trying to change particularly the portion on cocaine. That is why I've been arguing that we should not send anyone to jail for a pure drug offense. They should be going into treatment.”During the discussion on race, Biden attempted to make a personal appeal to Black voters.“I never had to tell my daughter, if she's pulled over, make sure she puts both hands on top of the wheel and don't reach for the glove box, because someone may shoot you,” Biden said. “But a Black parent, no matter how wealthy or how poor they are, has to teach their child, when you are walking down the street, don't have a hood on, make sure that if you get pulled over, yes sir, no sir, hands on top of the wheel, because you are the victim whether you are a person making 0,000 a year or someone who is on food stamps. The fact of the matter is, there is institutional racism in America.”While Trump has previously said that he does not believe there is institutional racism in America, he said that no one has done more for Black Americans in recent history.“Nobody has done more for the Black community than Donald Trump,” he said. “If you look, with the exception of Abraham Lincoln, possible exception, nobody has done what I've done. Criminal justice reform, Obama and Joe didn't do it. I don't even think they tried. They might have wanted to do it, but if you had to see the arms I had to twist to get that done, it was not a pretty picture, and everybody knows it, including some very liberal people that cried in my office -- two weeks later they are out saying, we have to defeat him.” 3120

  

INDIANAPOLIS -- Jared Fogle is now asking for  million as remuneration for a “conspiracy” to rob him of his fortune he says was orchestrated by judges, the U.S. attorney’s office, FBI investigators and the attorney general of the United States.   Fogle’s latest filing was entered by the court on Monday. In it, the former Subway pitchman – now serving more than 15 years on charges of child porn and sexual conduct with a minor – alleges federal Judge Tanya Walton-Pratt, who sentenced him to prison, two members of the 7th Circuit Court of Appeals, an Illinois U.S. district court judge and both of his lawyers undertook a “scheme to defraud” Fogle by tricking him into pleading guilty to a false charge.READ | Full?Fogle?plea agreementIn addition to his wrongful imprisonment, Fogle claims he suffered at least million in damages. The suit asks the government to grant him threefold damages as remuneration in the sum of million.The claim – which purports to outline a sprawling RICO case involving fraudulent search warrants, bogus charges and ill-gotten advice from attorneys to agree to pay .4 million in restitution to Fogle’s juvenile victims (at least million of which Fogle had already paid prior to his sentencing) – is the latest attempt by Fogle to get out of the plea he entered in November 2015.Previous such attempts – an apparent “sovereign citizen” defense rejected in November, the demonstrably false claim that Judge Pratt was “biased” because of her two teenage daughters at the time of the sentencing (she had none), and the argument that he pleaded guilty to an “unconstitutional” charge of conspiracy –  have so far been unsuccessful. In addition to this most recent filing, Fogle also has two open civil cases against Pratt and the U.S. government arguing he should be released.Fogle is joined in the RICO case claim by two other defendants: James Nathan Fry and Frank Edwin Pate.Pate, a former resident of Bonham, Texas, was sentenced to 210 months in federal prison in November 2015 for wire and mail fraud in connection to a foreign currency trading scheme and ordered to pay .8 million in restitution.Fry was sentenced in October 2013 to more than 17 years in prison and to pay million in restitution for his role in a .65 billion Ponzi scheme, according to the Star Tribune in Minneapolis.Pate and Fry are asking for million and 4 million in restitution, respectively, from judges, FBI agents, assistant U.S. attorneys and IRS employees connected to their cases.In all, the three men’s combined complaint targets 34 defendants and asks for 3 million in damages to be paid to Fogle, Pate and Fry.At least part of Fogle’s motivation behind the RICO suit may have been made clear Wednesday, when he filed a motion to dismiss in his civil suit against Pratt claiming that, because he has filed a RICO suit naming her as a defendant, the entire U.S. District Court for the Southern District of Indiana is now a “conflict of interest” forum.Fogle is currently serving his sentence at the federal correctional institute in Englewood, Colorado.
