(KGTV) -- The County is investigating complaints from neighbors that a business owner with a criminal history for fraud may have converted a former hotel into a drug treatment center without proper permitting.Residents living near the former site of the Tuscany Village Resort on Circle R Way in unincorporated Escondido say they started noticing people wandering trough their neighborhood this summer."The people that are staying there have told us they're getting treatment," said one neighbor, who asked not to be identified.The property was acquired in March by NSI Services, LLC, according to public records. The company identifies itself as a "drug rehab" in its incorporating paperwork."Our concern is the safety and well-being of our community with a gentleman who seems to have disregard for the law," the resident said.NSI Services is owned by Larry Burns, an entrepreneur with several aliases who served prison time for mail and wire fraud and has been charged with crimes in at least three states.Burns, who also goes by Lawrence Burzynski, did not respond to phone calls by 10News seeking comment Monday or Tuesday.Burns was once the president of the Escondido-based Crosby Centers and is listed as a director of the Crosby Clinic on its website. Neighbors say they've seen a Crosby Clinic van parked at the resort.The clinic advertises drug rehab services along with treatments for traumatic brain injuries and CTE, and attracted media attention for treating former NFL players. In 2015, the NFL Players Association issued a warning to players about Burns, urging players using his services to "exercise extreme caution."Burzynski "has accumulated numerous convictions for felony FRAUD related violations," the bulletin read. "He has been convicted in federal prosecutions in Wyoming, Colorado, California and elsewhere."The old Tuscany Village Resort is not zoned for drug rehabilitation or medical services. After complaints by neighbors, code compliance inspectors began investigating the property on August 7, according to a letter from County Planning and Development Services Director Mark Wardlaw.The owner "indicated they had not yet finalized their plans for the property" but "noted that he may use the property as a resort that may also provide brain injury and other medical treatments," the letter stated. The owner, who was not identified in the letter, said he did not intend to offer drug or alcohol treatments at the facility."We will continue to keep our code compliance case open until we have received all the information required to classify the use," Wardlaw wrote.Staff gave the owner a 0 citation on September 12 for improperly storing items in the parking lot. When a 10News reporter visited the property Monday, there was still furniture and other items in the parking lot.The owner has until October 9 to clean up the property, said County spokeswoman Tammy Glenn."We will continue to update residents in the area and work with the property owner to ensure compliance with County codes," she said.Late Tuesday, a man who identified himself as one of Burns' employees contacted 10News, saying the hotel was undergoing renovations and would open next year as a Bavarian-style spa. The man named Jeff said other than himself, no other Crosby Clinic employees were working at the property and the resort would not be used for drug treatment."They think because they see a Crosby van it's going to be drug and alcohol [treatment], but that's not the case," he said. (KGTV) — New undercover video appears to show signature gatherers pitching falsehoods to voters get them to sign petitions that would force the massive Newland Sierra development to a public vote.The County Board of Supervisors approved the project last month. It calls for more than 2,000 new homes on nearly 2,000 acres north of Deer Springs Road in Escondido. Opponents, backed by the exclusive Golden Door Spa, launched a signature drive to collect about 68,000 signatures from registered voters before Oct. 26. It would delay the project so the public can weigh in at the polls. On Friday, Newland released undercover video purportedly showing the signature gatherers making claims that the development would raise taxes, force people out of their homes, and encompass 430,000 acres. "What they're doing is basically putting in a bunch of homes, stores, casinos, hotels," one petitioner says in the video (the plan does not call for casinos or hotels).Steve Inscoe, who lives in Escondido, said signature gatherers told him that plans called for one million square feet of commercial space (it calls for 81,000), and that there was no plan to mitigate traffic (Newland Sierra says it will spend million on traffic improvements)."We are at a time when we need a whole lot of housing," said Inscoe, who supports the project.But the committee behind the petition says the real story is what's not in the video. Newland Sierra has deployed so-called truth teams that are allegedly the aggressors - an attorney for the committee says they even surround signature gatherers to block them from doing their jobs. It has led to confrontations, plus restraining orders and cease and desist letters from Vons/Albertsons. Rita Brandin, a vice president at Newland Sierra, said the signature gatherers are the ones who get confrontational."When a signature gatherer who is being paid says 'this project will raise taxes,' our truth teams can say 'that's inaccurate.' So because the signature gatherer is the one that signature by signature is making his paycheck, they get aggressive," she said.Newland Sierra sent the committee a cease and desist letter, reserving its right to litigate.In a response, Sean Welch, the attorney for the committee, warned Newland Sierra against any legal action. He noted that the signature gatherers are trained and that the First Amendment provides wide latitude for political expression. "It is beyond dispute that the Newland Sierra Project is extremely controversial, and that a large number of voters throughout San Diego County has long been opposed," Welch wrote. ENCINITAS, Calif. (KGTV) - Sheriff's Deputies are on the lookout for the man who jumped out of the bushes and confronted an Encinitas man with a rifle. The attack happened Friday morning on Fortuna Ranch Road when the victim was in his driveway. A neighbor tells 10News the man popped out of the bushes wearing a ski mask and camouflage clothing. He then pointed a rifle at the victim, threatening to rob or shoot him.  Deputies say, somehow, the victim was able to run to his neighbor's home and call 911. The gunman got away before law enforcement arrived, but it's unclear if he ran or drove away. With the gunman still at large, some neighbors are concerned for their safety. Crime Stoppers is offering a ,000 reward for any information leading to an arrest. ESCONDIDO, Calif. (KGTV) — One person is dead and a driver is at large following a hit-and-run collision in Escondido.A vehicle collided with a bicyclist on La Honda Road north of El Norte Parkway at about noon, according to the Escondido Police Department."The rider was wearing a helmet, and we are still investigating the cause as to what happened and how the car and bicyclist crashed," Lt. Scott Walters with the Escondido Police Department said. The cyclist was part of a larger group going southbound on La Honda Drive. Witnesses of the crash saw the 36-year-old victim from Vista fly off his mountain bike and die at the scene. Investigator said the driver of the car never stopped and continued going northbound on La Honda Drive. A short while later, investigators got a break in the case. The mangled car was spotted on the 600-block of Aster Street, just a half-mile away from the crash site. 10News spoke to neighbors watching the commotion, who said they did not recognize the sedan. The victim's identity was not immediately released.Police advised the public to avoid the area for about five hours after the crash. Access to Dixon Lake and Daley Ranch Recreation Areas was closed, but hikers and bikers were able to access Daley Ranch through Cougar Pass in north Escondido, police added. 1312
