(KFTV) - Former NFL player Steve Weatherford is putting his best foot forward to help Feeding San Diego this holiday season.The Super Bowl Champion Punter donated more than ,000 to help fund a school pantry for a full month."I feel like it's an honor and a privilege to team up with Feeding San Diego and leverage my blessings to let them know we have some food for you and we also care," he said as Weatherford helped distribute food at Central Elementary on December 20th.Feeding San Diego's school pantry program runs distributions at 40 schools across the city. They focus on giving families fresh food, as opposed to processed packaged items.Weatherford says that's one of the reasons he was drawn to the program."Being in fitness and being a professional athlete, I understand you're only going to be able to perform as well as the fuel you put inside your body," he says.Weatherford also brought his daughters, Carney and Aurora, to help volunteer at the distribution."I've got five kids," he says. SAN DIEGO, Calif. (KGTV) -- Health officials in San Diego are warning people to avoid water contact at all coastal beaches and bays amid rain sweeping through Southern California. The San Diego County Department of Environmental Health issued the general rain advisory Thursday afternoon. According to the department, the urban runoff caused by the rain can cause bacteria levels to spike significantly in ocean and bay water, especially near storm drains, creeks, rivers and lagoon outlets. RELATED: Check today's forecastThe runoff could contain bacteria from animal waste, soil and decomposing vegetation. The department says water contact such as swimming, surfing and diving should be avoided during rain and for 72 hours after the rain stops. A beach closure will also remain in place for the shoreline of Tijuana Slough National Wildlife Refuge and Border Field State Park due to sewage-contaminated flows from the Tijuana River. The water contact closure includes all beaches from the south end of Seacoast Drive to the international border. 1058

San Diego is weighing major new rules that would ban people from living in their cars near schools and homes.The proposal would block anyone from living in their cars within 500 feet of a school or residence, and also prohibit them from living in their cars on most other city streets between 6 p.m. and 6 a.m.San Diegans living in their cars have had free reign since a judge ruled in August that its current laws were too vague. That's led to concerns from some residents in beach areas, who say they have seen people drinking in cars, as well as urinating and defecating on neighborhood streets. "I used to feel very safe walking around throughout La Jolla, Pacific Beach and everything, and there's a lot of times I don't feel as safe as I used to," said Sarah Bonesteel, a Crown Point resident. The issue of in-car living has grown along with San Diego's high housing costs. The car is one of the last pieces of shelter a homeless person may possess, Mayor Kevin Faulconer noted Tuesday. At a news conference, the mayor announced that the city would open an additional parking lot for people to legally sleep in their cars. It will be in the overflow lot across from SDCCU Stadium, providing access to housing and other services."The goal for every person or family staying here will be to access resources to get back into long-term housing," Faulconer said. Meanwhile, the city's Public Safety and Livable Neighborhoods Committee will consider the citywide restrictions Wednesday. Ann Menasche, a senior attorney with Disability Rights California, called the proposed rules draconian and said the fault is with the city. "They created the crisis by the policies of the city, and now they want to blame the victims of the crisis for the crisis itself," she said. SAN FRANCISCO — A California appeals court has upheld an order requiring Uber and Lyft to treat their California drivers as employees instead of independent contractors, less than two weeks before voters will be asked to exempt the ride-hailing giants from the state’s gig economy law. The two companies have more than 400,000 drivers in California alone. Treating Uber and Lyft drivers as employees would guarantee benefits such as overtime and sick leave.Uber and Lyft had appealed an August ruling by a San Francisco judge, but the appellate ruling found "no legal error" and allowed the earlier ruling to stand. The legal fight started after state lawmakers passed a law that says companies can classify workers as contractors only if they perform work "outside the usual course" of the company's business. Thursday's decision won’t have any immediate impact because it doesn’t take effect for at least 30 days, well after the Nov. 3 vote on Proposition 22.Uber and Lyft, along with DoorDash, have heavily bankrolled the ballot measure.Proposition 22 on the California ballot this fall asks voters to create a special designation for drivers of app-based companies to be excluded from the new state law. 1216

SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. Cushinberry’s past convictions include rape in 1995, sexual battery in 1997, and recently, felony robbery in San Diego.His next court appearance is on December 19th. 2407
