SAN DIEGO (KGTV) - A man involved in a DUI hit-and-run crash that seriously injured a young boy in the South Bay started his sentencing hearing Wednesday for violating federal immigration laws.Constantino Banda Acosta, a Mexican national who had previously been deported from the U.S. at least 15 times in the past, has been in federal custody since March over federal criminal re-entry charges.He was transferred to federal custody after charges against him stemming from a 2017 crash were dismissed.Banda faced charges in the May 6, 2017, crash in San Ysidro that sent young Lennox Lake to the hospital with serious injuries, including head trauma.Banda was initially charged with drunk driving and hit-and-run after authorities said he ran a stop sign at Dairy Mart Road and slammed his pickup truck into the Lake family’s car as they were heading home from a Disneyland trip.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152.Following a mistrial, a judge dismissed the case against Banda in March, saying there was no clear evidence that showed he was behind the wheel at the time of the crash.Banda’s lawyers had argued that another man in the truck, Jorge Adame Ariza, may have been driving the truck after a night of drinking with Banda.Adame said Banda got into a fight with another man outside a Chula Vista restaurant before the crash. SAN DIEGO (KGTV) - A San Diego K9 police officer rescued toddlers after their father drove off Sunset Cliffs Saturday morning.He said he heard the first call go out of a suicidal man with twin two-year-old girls driving with the intention of careening off the Coronado Bridge.Law enforcement tracked his phone to Sunset Cliffs where a SDPD lieutenant watched him drive off the cliff at a high rate of speed.SDPD K9 Officer Jonathan Wiese said the man had his daughters in his lap during the crash and the truck landed upside down on top of a rock, which would have killed the girls had they been in the back seat.Wiese said his goal once he saw the truck was to get down to the family and get them all to safety."I could see him and he had one of the girls in his arms, and I have a two-year-old daughter at home so I imagined, what if that was my wife and kid down there? You're not going to stand there on the cliff and watch it happen," he said.Wiese said his heart was pounding as he thought of a way to get down the cliff-side. Then he remembered he had a 100 ft leash for SWAT missions.He grabbed it, took off his gun belt and looped it around his waist, "and by then four or five other cops had shown up so I pretty much threw the end of the leash to them and then I said hang on and I just jumped off."He said with teamwork, they lowered him down to the rocks below, where he slid his way into the water and swam, fully clothed to the father. By that time, he had both toddlers in his arms.Wiese's next goal was to get them out of the water. He said the truck acted as a break from the surf while he gathered his thoughts, and a memory hit from his time in the Marine Corps. "They taught you how to do water safety rescues and I had a little flashback of okay grab him under the armpit and push him so I swam and held them above water," bringing them to shore.He noticed one of the girls was alert while the other was limp. He said he did some 'rescue breathing' while officers above got him a backpack with supplies.They used the backpack and leash to hoist both girls up to a waiting ambulance.Wiese said while he sat with the father, waiting for a helicopter to come hoist him up, the man said "he was going to die and the girls were coming with him."SDPD Police Chief David Nisleit said he believed Wiese saved the girls' life, and was proud of Wiese's heroic actions."That's probably the most heroic thing I've seen in my 32 years," he said.He reminded us Wiese is the Officer of the Year, honored for a long list of heroic acts, including helping arrest the suspected Chabad of Poway shooter.This all happening as police fall under the nation's microscope."I didn't do the job to be liked every day, I didn't do it to become rich, I did it because I want to be out there making a difference and helping people, as cliche as that might sound, but I was just glad I could be there," Wiese said referring to protecting those toddlers.During the rescue he said he was focused, but it does take an emotional toll, "you just do what you have to do, but after everyone was safe, it hits you and you just want to go home and hug your kids that's for sure."Nisleit said the girls were in the ICU, but are expected to make a full recovery. 3251

SAN DIEGO (KGTV) -- A person is back in ICE custody and in isolation after they were taken to Sharp Chula Vista Medical Center to be evaluated for possible coronavirus symptoms.The individual was in the custody of U.S. Immigration and Customs Enforcement when officials determined the person needed to be taken to Sharp Chula Vista, the county said. SAN DIEGO (KGTV) - A San Diego company created technology for NASA's 2020 Mars rover, launching in July.The Perseverance is set to launch July 20, at 9:15 a.m. EST.NASA's been working on this project for more than a decade, drawing from past missions with hopes of finding evidence of past life on the red planet."It's a really exciting mission!" Mike Carpenter, VP of Engineering at KULR Technology said."We don't know for sure what they're going to find, but if they find any hard evidence of life that would be wonderful." Carpenter is thrilled to be a part of this mission, bringing a piece of San Diego to Mars.Carpenter said the company is known for it's technology that keeps batteries from exploding.For the rover, they created heat sinks that control the temperature around sensitive instruments. Specifically the heat sinks on Perseverance protect SHERLOC, a detector on the arm of the rover that looks for signs of past life.KULR sent similar tech to Mercury, but this is their first trip to Mars."It is the largest most sophisticated rover NASA has sent there," Carpenter said.According to NASA, Perseverance will be landing in the Jezero Crater, the site of an ancient river delta.The mission has four Science Goals:1. SAN DIEGO (KGTV) — A new lot meant to give people living in their cars and RVs a safe place to sleep and avoid citation is going largely unused.During Tuesday morning's wee hours, the lot across from SDCCU Stadium looked completely empty. San Diego opened the lot in mid-June, as the third safe parking lot for those who live in their vehicles. The newest one came a month after the council enacted an emergency ordinance that banned people from living in cars and recreational vehicles on public streets from 9 p.m. to 6 a.m. The city enacted the restriction after being inundated with safety concerns from residents who said people were camping in their beach front neighborhoods, leaving human waste, and trash. At Mission Bay on Tuesday, many who do live in their vehicles said they would prefer to stay near the coast, despite the threat of citation. "They don't know about it, and maybe it's not that convenient either," said Gary Parsons, who lives inside his Dodge Ram. "Inside I put in some carpet, and some shelving, and I sleep on the floor."Chris Enders, who lives in an RV with his wife and son, said they spend their nights on unchecked private property, such as parking lots near the beach. He said the Mission Valley location is not feasible."When you're getting five miles a gallon in gas, that's .75 just to get there, and then to get back that's another .75 so you just cost me ... for one day," said Enders.The lot requires all vehicles to be out by 7 a.m. daily. Ashley Bailey, a spokeswoman for the mayor, said the city and Jewish Family Service are working to bring more people to the lot."In partnership with Jewish Family Service, teams are continuing to conduct outreach and seek feedback to ensure everyone who wants to use this lot has the opportunity to do so," she said in a statement.
