SAN DIEGO (KGTV) — Still many unanswered questions after alleged Poway synagogue shooter appeared at his readiness hearing in San Diego Superior Court.The Deputy District Attorney, David Grapilon, said he doesn't know if this will be a death penalty case and can't tell 10News how the 19-year-old legally obtained the gun used during the shooting.In the state case the shooter faces one count of murder, three counts of attempted murder and a count of arson against an Escondido mosque."We have still not received recordings of the witnesses, we expect that there's going to be firearms analysis which will be crucial for this case, we also expect that there's going to be computer evidence involving my client's computer which is going to be very relevant in this case," Public Defender John O'Connell said.The evidence is already extensive, more than 700 pages handed over from the Deputy District Attorney to the defense. More evidence includes surveillance video of the shooting from the time he entered to the time he left the synagogue."The Sheriff's Department did a pretty exhaustive investigation along with the FBI, and allied agencies and there's a lot of statements of witnesses that we're taking," Grapilon said. He added those statements will be redacted when turned over to the defense.While the shooter's family was in federal court two days ago, no one was in the gallery Thursday.10News went to the family's neighborhood to see how they're faring. SAN DIEGO (KGTV) -- Several asylum seekers had their first immigration hearing before a San Diego judge Tuesday afternoon. Six migrants from Honduras and one from Guatemala were scheduled to appear for their first hearing. The group is among roughly 240 people waiting in shelters in Tijuana under President Trump's new policy. Robyn Barnard is an immigration attorney with the group Human Rights First. She's representing two men from Honduras. She met with her clients Tuesday morning after they crossed into the United States at the San Ysidro Port of Entry. "One of my clients is a leader in his church. I think he relies on his faith. He brought us all together to pray before they presented at the port, which was a very touching moment," said Barnard. The judge granted her motion to allow her clients to be interviewed by the Department of Homeland Security Officials before being returned to the shelter in Mexico. She said they fear for their lives there."That's because one, they are asylum seekers, they're not Mexican nationals, they don't feel like they would be able to go seek protection from authorities because they are seen as migrants and foreigners," said Barnard. Barnard said her clients have family in the United States ready to accept them while their claims are processed. "They've received verbal slurs for being migrants in Mexico. They are staying in a shelter because they can't afford to pay for housing. They don't have any right to work in Mexico, and the shelter has started receiving threats as a result of sheltering these asylum seekers," said Barnard. Barnard said her clients were supposed to meet with DHS at the Port of Entry in San Ysidro sometime Tuesday, but as of five p.m she had not received an update on their status. Their next immigration hearing in San Diego is scheduled for August 6th. "They've got eyes wide open about the process, and they're hopeful that they will have their chance to be here in the United States while they fight their case." 2009

SAN DIEGO (KGTV) — Some University City residents are upset over the city's lethal methods to curb the squirrel population at Nobel Athletic Area park. Many see the park as an escape from the neighborhood's concrete jungle. "One of the joys of being here is to watch the wildlife in the morning-- the rabbits and the squirrels especially," resident, Tracy Benson said. But that began to change once Benson started seeing more green boxes on the ground, similar to water irrigation units.RELATED: Chula Vista seeks public input on future bayfront parks in online survey"There is a hole back here, and in this hole is where the bait is placed. So the idea is the animal eats the bait, comes out, and essentially dies," Benson said. The more of these boxes the animal lover saw, the fewer squirrels she ran into on her walks.10News contacted the City of San Diego to get answers. A spokesman explained that the green apparatus is a "bait box." It helps manage what they call an "overabundant squirrel population."The City's Parks and Recreation Department began using them a few years ago to stop the squirrels from damaging their athletic facilities, landscaping, and eroding the hillside. While Benson understands the need, she believes the method is too cruel.RELATED: San Diego crews work to repair road after massive water main break in North Park"Poison has no place in a public community like this," Benson said. The facility caters to young children and includes an off-leash dog park, both could potentially be affected by the poison nearby. Instead of bait boxes, Benson suggests educating the public by putting up more signs around the park."[The public] are going to have an understanding that if they feed the animals, they actually do more harm than good. The city adds, if they do not control the squirrel population in this way, the effects go up the food chain. There will be more coyotes and snakes, animals that would be dangerous to park users. Still, Benson says there must be another way."I think that is upsetting, and I don't think that is the measure that should have been taken to properly control the population of squirrels," Benson added.The city says they periodically place the bait boxes in their parks when needed.  2491

  

SAN DIEGO (KGTV) — SeaWorld San Diego's next thrill ride has been given the all clear by the state.The California Coastal Commission Wednesday approved the park's request for a dive coaster called Mako, set to open at the park next year. The roller coaster is already being billed as the "tallest, fastest, and longest dive coaster in California," and the only floorless dive coaster in the state.The San Diego City Council gave the 153-foot ride unanimous approval last April, allowing SeaWorld to exceed the city's 30-foot height limitation in coastal zones.RELATED: SeaWorld San Diego brings back its popular annual SoCal PassSeaWorld says construction on Mako should begin in the next few months.The ride, announced in January, will be constructed by Switzerland-based Bollinger & Mabillard. Riders will climb more than 150 feet into the air, suspended on a 45-degree angle at the crown of the ride as their feet dangle underneath.Then the drop, plummeting riders 143-feet facedown at speeds eclipsing 60 miles per hour.RELATED: SeaWorld San Diego rescue teams release seven sea lions after weeks of careMako will cover nearly 2,500 feet of track. Floorless cars will hold 18 riders at a time in three six-person rows. SeaWorld will build the attraction next to the Journey to Atlantis ride, where a parking lot currently sits.As an educational add, the ride will also focus on shark awareness and conservation and include a partnership with a shark conservation organization.Mako is set to debut following the park's Electric Eel ride and Tidal Twister coaster opened this summer.
