SAN DIEGO (CNS) - A San Diego-based telemarketer was fined nearly million by the Federal Communications Commission Wednesday for making more than 47,000 robocalls over a two-day period leveling false accusations against a local state Assembly candidate and manipulating caller ID information to appear as though a competitor was making the calls.Kenneth Moser and his company, Marketing Support Systems, were fined ,997,750 for making the calls on May 30 and May 31, 2018, about one week prior to the primary election, in which Philip Graham unsuccessfully sought to represent the 76th Assembly District.Shortly before the primary, a woman accused Graham of kissing her against her will in an Encinitas bar, triggering a sheriff's department investigation that concluded the claim was unfounded. Nichole Burgan, the woman at the heart of the allegation, later pleaded guilty to filing a false report.According to the FCC, the robocall messages repeated Burgan's claim and caller ID information was manipulated to make the calls appear as though they originated from another telemarketing company, HomeyTel, described as a competitor to Moser's company. As a result, HomeyTel received "a multitude of angry complaints" from people who received the calls, as well as a cease-and-desist letter from Graham, according to the FCC.The agency said 47,610 robocalls were made during the two-day period, with multiple calls sometimes sent to the same recipients. The calls violated the Truth in Caller ID Act prohibiting manipulation of caller ID information -- otherwise known as spoofing -- with the intent to defraud, cause harm or wrongfully obtain anything of value, according to the FCC. 1697

SAN DIEGO (CNS) - An East Village couple was behind bars Wednesday for allegedly subjecting a 3-year old child to torture and sexual abuse over a several-month period while caring for the toddler at their home, San Diego police reported.Officers arrested Marcos Javier Ramirez, 27, and 25-year-old Vennesia Ruiz in the Midway area on Tuesday evening, SDPD public-affairs Lt. Shawn Takeuchi said.Ramirez and Ruiz had been entrusted by an acquaintance to care for the child when the abuse allegedly began last October, Takeuchi said. Three months later, the toddler's mother began to suspect that there was abuse occurring and notified the police, the spokesman said.Ramirez was booked on suspicion of lewd acts with a minor, forcible sex with a foreign object, torture and child cruelty, according to jail records. Ruiz was being held on suspicion of two counts of the latter charge. Both were scheduled for arraignment April 6.Takeuchi, who declined to specify the child's gender, described the suspects as "a couple" but said he did not know if they are husband and wife. He also said he was unsure what circumstances led the toddler's mother to hire them as care providers. 1183

SAN DIEGO (CNS) - A young man accused in a series of San Diego-area gang-related killings and attempted slayings pleaded not guilty Monday to murder, attempted murder and conspiracy charges.Ismael Betancourt, 20, is charged in the Aug. 1, 2019, shooting death of 57-year-old Marco Magana in Mountain View, the Feb. 8 shooting death of 19-year-old Leah Posey in Southcrest, and two attempted murders that allegedly occurred on July 24, 2019 and Feb. 8.San Diego police announced Betancourt's arrest last month in connection with the April 8, 2018, shooting death of 55-year-old Lowry Rivers in National City, which occurred when Betancourt was 17. Rivers' killing is not listed in the latest complaint, and it's unclear whether Betancourt is being tried in juvenile court regarding that crime or whether additional charges are pending in his current case.In addition to the murders and attempted murders, Betancourt is charged along with six co-defendants with conspiracy to commit a crime, for what prosecutors allege was a plan to kill rival gang members. The overarching conspiracy includes the July 12, 2019, shooting death of 20-year-old Joaquin Ruiz, who was shot in a vehicle in Bay Terraces by assailants who opened fire from another vehicle. The four defendants charged with that slaying have been arrested and pleaded not guilty. Two of those defendants, Ethan Apan, 28, and Kevin Herrera, 26, are also charged in the murders in which Betancourt is charged. The complaint charges Apan in Marco Magana's murder and Herrera in Leah Posey's murder.Betancourt is being held without bail and his next court date is a Dec. 22 readiness conference. 1656

SAN DIEGO (CNS) - A report released Thursday by the International Boundary and Water Commission found a significant presence of wastewater in border channels in the Tijuana River Basin impacting San Diego. In the report, "Binational Water Quality Study of the Tijuana River and Adjacent Canyons and Drains," scientists from the United States and Mexico collected samples from of seven transboundary channels. The sampling and laboratory analysis for the study were performed from December 2018 to November 2019. The findings indicate the presence of treated and untreated domestic and industrial wastewater. The scientists analyzed 267 different parameters in water and 204 parameters in sediment for pathogens, metals, industrial organics, pesticides, as well as conventional parameters typically found in wastewater. Of the parameters tested, 131 were not detected and 136 had detectable levels.Parameters that exceeded standards in both countries at all monitoring sites are those associated with the presence of wastewater, including ammonia, biochemical oxygen demand, chemical oxygen demand, oils and greases, phosphorus, nitrates, methylene blue active substances and coliform bacteria.Data analysis indicates that the parameters which exceeded standards had originated as uncontrolled sewage spills from Tijuana. Disposal of solid waste or trash contributes to the presence of certain parameters exceeding the standards, such as the organic compound DEHP. Commonly used in the manufacture of plastics, DEHP exceeded applicable standards at all monitoring sites and could have leached from plastic accumulated in the canyons and Tijuana River. The results showed that certain parameters of concern -- Hexavalent Chromium and the pesticides DDT and Aldrin -- were either not detected or found in very low amounts below the limits established in both countries' applicable regulations. Likewise, metals such as copper, nickel and zinc, which are commonly used in the metal plating industry, were detected at levels within applicable standards in both countries. The report also includes recommendations related to control of industrial wastewater discharges in Tijuana, increased resources and assistance for wastewater collection and treatment systems in Tijuana, and continued joint water-quality monitoring and field inspections to detect and respond timely to wastewater flows. 2389
