(AP) — A jury on Monday recommended the death penalty for a Southern California man convicted of killing a family of four with a sledgehammer and burying their bodies in shallow desert graves.Jurors in San Bernardino made the recommendation for Charles "Chase" Merritt, 62, in a case that puzzled investigators for years after a couple and their two young sons vanished from their home in 2010. Their bodies were found three years later.Merritt supported his head on his fists and closed his eyes as the verdicts were read. He also spoke briefly to his attorney.He was convicted this month of the murders of his former business associate Joseph McStay, McStay's wife Summer, and their 4- and 3-year-old sons, Gianni and Joseph Jr.Merritt had pleaded not guilty and his lawyers didn't offer witnesses during the penalty phase of his trial, insisting he is innocent.San Bernardino County Superior Court Judge Michael A. Smith set a Sept. 27 hearing to formally sentence Merritt. He thanked the jurors after the verdicts were read, saying he knew the decision was "extremely difficult."Authorities said they believed Merritt killed the family as McStay was cutting him out of his business making and selling custom water fountains. When the family disappeared, there were no signs of forced entry at their San Diego County home and their car was found parked at a strip mall near the Mexico border.For years, no one could figure out what happened to them. In 2013, their bodies were found in shallow graves in the desert after an off-road motorcyclist discovered skeletal remains in the area. Authorities also unearthed a rusty sledgehammer that they said was used to kill the family.Merritt was arrested the following year. Authorities said they traced his cellphone to the area of the desert graves in the days after the family disappeared and to a call seeking to close McStay's online bookkeeping account. Merritt also had referred to McStay in the past tense during an interview with investigators.Authorities concede the case against Merritt largely focused on circumstantial evidence and that questions remain about what happened at the McStay home.During the trial's penalty phase, prosecutor Britt Imes asked jurors to consider any possible motive for the killing of two young boys, whether they could have been witnesses to the murder of their parents or simply victims of callous killings."There is no motive that can be ascribed to the killer of a 4-year-old and a 3-year-old that passes muster," he said.Merritt's attorneys didn't call any witnesses during the penalty phase, instead appealing to any lingering doubts jurors may have had about killings they say their client didn't commit."From the very beginning, this case screamed doubt," defense attorney Raj Maline told jurors. "This case is filled with unanswered questions."California has not executed anyone since 2006. Voters approved a ballot measure to speed up executions in 2016, but Gov. SAN DIEGO (CNS and KGTV) - A San Diego County Superior Court judge ruled Monday in favor of conditional release for a sexually violent predator known as the "Bolder than Most'' rapist.Judge David M. Gill made the controversial decision for Alvin Ray Quarles, 56.Some of those who were in the courtroom when the decision was announced were visibly upset, 10News reporter Jon Horn said. One person yelled, others were in tears.Last fall, Gill ordered that Quarles be released, a decision that prosecutors, along with county Supervisor Dianne Jacob, requested Gill reconsider. Since that time, the agreement to rent the residence in Jacumba Hot Springs has fallen through, and Gill allowed for further argument toward a possible reconsideration of his decision to release Quarles. Gill heard testimony during a closed-door evidentiary hearing last week, which was kept under wraps due to privacy concerns over the potential disclosure of Quarles' psychiatric reports. Quarles' victims and their supporters have argued against the order to keep the hearings private, including by staging a protest on the steps of the downtown San Diego courthouse where the hearings were held. Quarles was dubbed the "Bolder than Most'' rapist because of the way he attacked his victims, at knifepoint, sometimes forcing the women's husbands or boyfriends to watch. He pleaded guilty in 1989 to committing more than a dozen sexual assaults in the mid-to-late 1980s and was sentenced to 50 years in prison.Prior to Quarles' release from prison, the District Attorney's Office filed a petition to have him civilly committed as a sexually violent predator. In 2014, Quarles was committed to the Department of State Hospitals to undergo sex offender treatment. In September 2016, Quarles petitioned the court to be granted release through the Conditional Release Program for sex offenders.Quarles will return to the hospital where he has been held until it's determined where he will be placed. SAN DIEGO (CNS) - A collective of conservation organizations filed lawsuits Thursday against San Diego County and its board of supervisors for approving a controversial housing development in the Otay Ranch community, with the groups claiming that the development endangers wildlife and the development's future residents. The project known as Adara was approved last month with a 3-2 vote and involves construction of more than 1,000 homes and a commercial village core, along with an elementary school, fire station, sheriff's office, trails, electric vehicle charging stations, solar panels and more than 700 acres of open space and parks. Environmental groups contend that its location, between the city of Chula Vista and rural community Jamul, is home to several endangered and protected plant and animal species and is at exceptional risk for wildfires. Plaintiffs include the Center for Biological Diversity, Preserve Wild Santee, the California Chaparral Institute, Endangered Habitats League, California Native Plant Society and the Sierra Club. ``Building houses in this fire-prone place will put people at risk, and it'll wreak havoc on golden eagles and other wildlife,'' said Peter Broderick, an attorney with the Center for Biological Diversity. ``By approving this sprawl project, officials have put both homeowners and wildlife in danger. They've dealt a big setback to sustainable development in San Diego County.'' In their complaint, the plaintiffs referenced county data identifying ``22 special-status plants and 28 special-status wildlife species'' on the project site. They also allege that the area is especially prone to wildfires, which was noted by Supervisor Dianne Jacob in her dissenting vote on the project. The complaint states the area ``has burned at least 17 times in the last 100 years'' and is ``at serious risk for fast-moving, wind-driven fires.'' The site's steep terrain would make suppressing fires difficult, and homeowners would only have one evacuation route available, according to the plaintiffs. Peter Andersen, chair of the Sierra Club's San Diego Chapter, called the project ``a fire trap that endangers all East County residents, contributes to severe traffic jams and destroys multiple species' habitat,'' while Richard Halsey of the California Chaparral Institute said ``History has shown that during a wind-driven wildfire, developments like this one in a known fire corridor can and have been destroyed by embers flying a mile or more ahead of the flame front. The claim that a development like this is fire safe ignores everything we have learned during the destructive 2017 and 2018 firestorms.'' 2662

  

SALT LAKE CITY (AP) — Former Disney Channel actor Stoney Westmoreland has been charged with six felony counts after authorities said he tried to have sex with a 13-year-old boy.Prosecutors say the 48-year-old Westmoreland was on the dating app Grindr when he found a profile operated by a police detective in Salt Lake City, near the location of the show "Andi Mack."A message left with Westmoreland's agent, Mitchell Stubbs, was not immediately returned.Charging documents say Westmoreland was arrested Dec. 13 after he took a car to meet the boy so they could go back to his hotel room.Charges filed Friday include attempted exploitation of a minor and enticing a minor.Westmoreland has been dropped from his role as the grandfather of the teenage title character in the Disney show.Westmoreland's other acting credits include "Scandal" and "Breaking Bad." 866
