SAN DIEGO (CNS) - A power outage left nearly 3,200 homes and businesses without electrical service Thursday morning in Del Dios, Rancho Bernardo, Rancho Penasquitos and San Pasqual.The blackout, which initially affected 3,173 utility customers, began shortly before 6:30 a.m., according to San Diego Gas & Electric. By midday, repair crews had restored electrical service to all but 209 of the affected addresses, SDG&E advised. Those customers were back on line in the late afternoon.The cause of the outage was under investigation, according to the utility. 575

SAN DIEGO (CNS) - A jury awarded million Friday to the widow of a retired San Diego Police Department criminalist who committed suicide after he was accused of a 1984 murder.The attorneys alleged the investigation was begun improperly by San Diego police homicide detectives, driving her husband to suicide.The verdict was the result of a federal lawsuit alleging wrongful death and civil rights violations filed by Kevin Brown's widow, Rebecca, against the city of San Diego and its police department. Jurors are due back in court Tuesday to consider punitive damages.Brown, 62, was suspected in the murder of Claire Hough, who was strangled and found dead at Torrey Pines State Beach in 1984. Brown hanged himself at Cuyamaca Rancho State Park in October of 2014, which his lawyers said was a result of the homicide investigation, as well as the seizure of numerous items of sentimental value from his Chula Vista home.Rebecca Brown's attorneys alleged now-retired SDPD Detective Michael Lambert misled a judge when securing an affidavit for a warrant to search and seize property at Brown's home. The affidavit was secured on the basis of Brown's sperm cells, which were found on a vaginal swab of Hough, though Rebecca Brown's attorney, Eugene Iredale, said those cells were most likely transferred onto the swab via accidental cross-contamination.Iredale told jurors that lab techs at the SDPD crime lab often used their own semen as reference samples when conducting testing for the presence of semen.Other DNA evidence found on Hough's clothing pointed to another suspect, Ronald Tatro, who was previously convicted in several other rapes and assaults on women. Tatro, who died in 2011, was matched to several blood stains and a pubic hair found on the girl's clothing, Iredale said.Despite Tatro's DNA being far more prominent on the swab, Iredale said Lambert used Brown's sperm cells and evidence that Brown had frequented strip clubs in the 1980s to suggest he worked in concert with Tatro in the killing.However, no such connection between the men was ever discovered, nor was Brown ever connected to the murder.Brown, who suffered from anxiety and depression, was "obsessed with getting his property back," Iredale said, yet was unable to secure their return over the course of several months.Iredale said the prospect of spending time in jail while fighting to clear his name and the property seizure was enough to push Brown to suicide.The attorney said Lambert was aware Brown was suicidal and held onto his property "because he knew it would cause pain and hurt, because he felt he was going to break him down, he was going to crack the case."Deputy City Attorney Catherine Richardson argued at trial that Lambert relied upon DNA experts when he wrote the affidavit and was not given all the information he needed.The attorney said Lambert asked about contamination when presented with the evidence of Brown's DNA, but was told by his sergeant that contamination was not possible. She also said Lambert was not informed that SDPD lab techs sometimes used their own semen for testing until months after the search warrant was secured.Richardson said the items from Brown's home had to be seized in order to prove or disprove a possible connection between Tatro and Brown, which would have dated back more than three decades, and that a rigid investigation was needed to prove there was no favoritism toward an SDPD employee."If he hadn't investigated (Brown), then the police would have been accused of covering up for one of their own," Richardson told the jury in her opening statement. 3615

SAN DIEGO (CNS) - A wrongful death lawsuit was filed Monday on behalf of the family of a 24-year-old woman who died last fall at the Las Colinas Detention Facility in Santee.Elisa Serna died Nov. 11, 2019, a few days after she was booked into the county jail.Earlier this year, the sheriff's department said Serna died from complications of drug abuse, with a contributing factor of early intrauterine pregnancy.The lawsuit filed in San Diego federal court alleges jail staff were aware of Serna's substance abuse and subsequent withdrawal symptoms, but did not provide her with treatment. Though Serna was fainting, had low blood pressure, was vomiting regularly and displaying odd and incoherent behavior, jail staff "ignored the obvious signs of medical distress" and "failed to provide proper medication as Elisa's condition was worsening," the complaint alleges.Sheriff's officials could not immediately be reached for comment on the suit, which names San Diego County and Sheriff Bill Gore as defendants.Plaintiffs in the suit include Serna's parents, Michael and Paloma Serna; her husband, Brandon Honeycutt, and a minor child referred to as S.H.The sheriff's department has come under fire recently over a spate of deaths among county jail inmates, which were referenced within the complaint.The lawsuit cited news reports indicating the county had the highest jail mortality rate among the state's largest counties, and said prior deaths from inmates suffering from withdrawal symptoms should have made jail staff aware of the potentially fatal consequences of those symptoms.The suit also alleges staff are inadequately trained and in-custody deaths at county jails are not being properly investigated."Even though inmates are dying or suffering catastrophic injuries at an alarming rate at San Diego County jails, the medical and correctional staff whose actions or inactions cause the deaths are not investigated; not informed of their failures; not given further training or remedial instruction; and are not monitored or closely supervised after these adverse events," the lawsuit alleges. 2111

  

SAN DIEGO (CNS) - A man who was operating a panga boat carrying several undocumented immigrants when it capsized off the coast of southern San Diego County earlier this year, killing two men aboard, was sentenced today to nearly seven years in federal prison.Julio Cesar Murillo-Arce, 42, pleaded guilty earlier this year to federal charges stemming from the Feb. 3 boating accident off the coast of Imperial Beach.He was sentenced to 78 months in prison in connection with the boat fatalities, and an additional five months for violating the terms of his supervised release stemming from a separate maritime alien smuggling conviction last year, according to the U.S. Attorney's Office.According to court papers, Border Patrol agents spotted the boat in the early morning hours of Feb. 3. It began experiencing engine trouble about 150 yards off the coast, prosecutors said, then eventually became inoperable.Prosecutors say Murillo-Arce told the others aboard not to identify him as the boat's captain, then dove into the water.The boat was capsized by a large wave, sending all six occupants into the sea. Four were able to make it to shore, but Ramon Ponce-Rodriguez and Modesto Rodriguez-Ballesteros did not.Ponce-Rodriguez was pronounced dead on arrival at a hospital, while Rodriguez-Ballesteros was initially hospitalized in critical condition and died Feb. 4.The surviving occupants of the boat told investigators that the boat's captain abandoned the vessel and swam away, despite being told some of the people aboard could not swim. The boat's occupants -- or someone else on their behalf -- paid between ,000 to ,500 each to be smuggled into the United States from Mexico, according to the criminal complaint.``This is yet another tragedy that never should have happened,'' said U.S. Attorney Robert Brewer. ``This defendant and others like him care only about their bank accounts and their own safety. SAN DIEGO (CNS) - An April 30 trial date was set today for a North Carolina man accused of raping and murdering a 79-year-old woman in her Normal Heights home more than 31 years ago.Kevin Thomas Ford, now 62, was arrested in June and charged with murder and a special circumstance allegation of murder during a rape in connection with the May 20, 1987, death of Grace Hayden.Investigator Tony Johnson of the San Diego County District Attorney's Office was reviewing the cold case in May when he decided to submit a single fingerprint found on Hayden's stove to a national database.He found a match: a print submitted by police in connection with Ford's 2015 arrest on charges of communicating threats, authorities said.The fingerprint allowed San Diego detectives to issue a warrant for Ford's arrest in July.RELATED: Man pleads not guilty in 1987 rape, murder of San Diego womanThe case is expected to get pre-assigned to a judge next month. 950
