SAN DIEGO (KGTV) – Hate crime charges were filed against two men accused of assaulting a Black journalist who was covering a peaceful Black Lives Matter protest in Imperial Beach in June.The San Diego County District Attorney’s Office announced felony assault and battery charges, and hate crime allegations, were filed against 38-year-old Jeffrey Brooks and 32-year-old Henry Brooks Jr. in connection with the June 7 incident at a beach near Veterans Park.Warrants have been issued for the arrest of the two men.RELATED: Man says he was sucker punched at Imperial Beach protestThe DA’s Office alleged Brooks and Brooks Jr. were at the peaceful march in Imperial Beach when they began “verbally and physically antagonizing the protesters.”At one point, Brooks Jr. allegedly threw eggs at a group of protesters.“While recording the scene, the victim was sucker punched in the head by Jeffrey Brooks, causing him to fall backwards and hit his head on the ground,” the DA’s Office said in a news release.If convicted of all charges, Brooks faces three years in custody; Brooks Jr. faces six years.District Attorney Summer Stephan said, “Protecting our community from hate crimes is a priority for my office because hate erodes our right to equality and fairness, and it leaves an impact on the victim and everyone who shares the victim’s race. SAN DIEGO (KGTV) – Hospital beds are filling up quickly with available capacity at zero in Southern California.ICE Nurse Peter Sidhu is overwhelmed. The Los Angeles County RN says their hospitals are on the brink of their limits.“We’re having an influx of patients like I’ve never seen before,” said Sidhu. “We’re running out of space. We’re converting any and every room into a patient room.”He feels more protected after getting the vaccine Thursday but says being short-staffed is a whole other threat. Sidhu also serves as treasurer for the UNAC/UHCP nurses union. He says hospitals have been facing systemic nursing shortages since the early 2000s.“You’ll be lucky to even get a restroom break. You’re on your feet, you’re running, patients are being intubated,” said Sidhu. “We don’t have enough staff. We didn’t have enough staff to take care of our patients before we had COVID.”California groups counties into five regions as part of the new stay-at-home order. On Thursday, the Southern California region available ICU capacity hit zero, even though availability for San Diego County is about 16%. "I actually brought Mason and Annabelle when he was on deployment to Syria, and he was kind of bummed he wasn't coming," said Lindsey Stacy, referring to her husband Kenton.It was on that deployment when Kenton, a Navy EOD Tech, was critically injured by an improvised explosive device (IED). He was given just a two percent chance of survival but ultimately overcame the odds. "He's just made so many miraculous recoveries, and I'm praying there's more to come," said Lindsey.While Kenton's story has inspired thousands around the world, few know of his love for all things cartoons and superheroes. Their firstborn Logan was named after X-Men's Wolverine. "I always said he's this big tough guy but he's like a comic book and Star Wars nerd underneath!"So Lindsey put out the call for help to bring Kenton to Comic-Con."People were just so willing to help make this dream come true for Kenton," she said. SAN DIEGO (KGTV) — Governor Gavin Newsom said Friday that more than 670,000 doses of the new Moderna vaccine could be in the state as early as next week. Unlike the first Pfizer vaccine, it does not require ultra-low temperature freezers, so experts predict the rollout logistics will be much smoother. While the new vaccine is promising, the fight against the surge continues.The FDA's Emergency Use Authorization of Moderna's COVID-19 vaccine could not have come at a more dire time."[There has been a] 58% increase over the last 14 days, now over 3400 Californians [are] in our ICU's," Governor Gavin Newsom said in a social media COVID-19 update Friday.As more people get sick after Thanksgiving gatherings, space, staff, and resources in our hospital systems are dwindling. San Diego County's ICU capacity is now at 19%, while the Southern California region is 0%."When you see 0%, that doesn't mean there's no capacity, no one's allowed into an ICU," the Governor explained. "It means we are now in our surge phase, which is about 20% additional capacity that we can make available."Hospitals are now repurposing regular beds into ICU beds, postponing non-essential procedures, and moving around staff to accommodate the surge."We are still going to have accidents, unfortunately," Dr. Abisola Olulade with Sharp Rees Stealy said.
