SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation.The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. She told ABC10 News in part, “It's been rough to shut down business again when people were feeling normal and then we see the County of San Diego's Department of Health say that gyms are only point .4% of cases in San Diego and it's really frustrating as a business owner where we have these ebbs and flows- where we can be open and then we can’t.”Superior Court Judge Kenneth J. The three or four shifts they thought they’d get each week at La Puerta could instead be reduced to one, if that.“The hardest part is just the emotions and the mental health of the people working in the industry,” Powell said.It’s because San Diego County is in danger of falling into the state’s most restrictive purple tier of coronavirus restrictions, which would ban restaurants from serving indoors. That would be the latest setback in the region's push to return to normal amid the outbreak.“It feels like they're just playing games with us at this point, and it's getting frustrating,” Powell said.The twists and turns are taking a big toll, not just on day-to-day operations, but also when it comes to hiring in the future.“You're not going to hire people back, you're being extremely cautious,” said Ray Major, SANDAG’s chief economist.Major said restaurant owners have it especially hard. Not only do they have to be concerned with whether they can break even, but also if a future move into a less restrictive tier would only be temporary."We're really going to have to get into the orange or the yellow tier, and we're going to have to be able to stay there, and businesses are going to have to have the confidence that we're not going to shut them down again before they start rehiring people," Major said.SANDAG says the region's jobless rate was 13.3%, with 226,000 unemployed workers as of Sept. 5. SAN DIEGO (KGTV) -- It has been nearly two years since Denelle Mitchell’s husband took his own life. CAL FIRE Captain Ryan Mitchell died by suicide on November 5, 2017, at the Interstate 8 Pine Valley bridge. Denelle Mitchell did not want to talk about the day it happened, but the emotions she dealt with in the days and months after his death are hard to forget. “One of the first feelings I felt was ashamed or embarrassed at the type of way that he died,” Denelle Mitchell said. “It comes and goes in waves of being mad or sad.”Her husband was dedicated to his job — a job that was his passion.“He loved the acts of fighting fires. He loved the community… the brotherhood and sisterhood that they had,” Denelle said. But there were difficult days. “What comes with that is a lot of hard work, a lot of hours away from your home and your family and your friends.” What wasn’t obvious to many were struggles behind the scenes.RELATED: Veterinarian suicides on the rise: Student loan debt, compassion fatigue among factors in suicide increase“He did talk about his depression quite a bit and I lived it with him. I was there with him when we were going through some really hard times,” Denelle said. “Marriage can be hard, owning a home and renovating a home can be hard, having a kid — that’s a lot of life stresses.”There were also tough times at work. “The fire seasons were getting longer and harder,” she said. “There’s days where as a firefighter wife, they come home and they just are so exhausted — mentally, physically, and emotionally drained." The Firefighter Behavioral Health Alliance recorded 98 firefighter and EMT suicides so far this year. Jeff Dill, the founder of FBHA, said the number this year is on track to be higher than 2018. In 2018, there were 108 suicides. In 2017, the number was 120. A study by the Ruderman Family Foundation said depression among firefighters is nearly double the general population. Firefighters and police are at higher risk for depression, post-traumatic stress disorder, and suicide, according to the study.Denelle now focuses on raising their son, Aiden. She encourages loved ones to pay attention to those who may be struggling. “Don’t just let it go by the wayside. Don’t take no for an answer… try to research the signs,”Denelle said.Locally and statewide, action has been taken to ensure resources are available for first responders. Recently, the County Board of Supervisors approved the Captain Ryan J. Mitchell First Responder Behavioral Health Program, which will offer confidential mental and behavior health support by connecting first responders with a clinical professional.The governor also signed several bills that focus on improving protections for the state’s firefighters and first responders when it comes to mental health. AB 1116 (the California Firefighter Peer Support and Crisis Referral Services Act) establishes statewide standards for peer support programs. SB 542 (the Trauma Treatment Act) will provide “first responders with workers’ compensation while they recover from their mental health scars,” according to a news release from the governor’s office. “Bringing awareness to the topic makes it easier to talk about,” Denelle said. She said she is grateful that she did not have to go through this process alone. “I wanted to thank all our friends and family for the support, especially the Cal Fire community, Local 2881, and Chief Patrick Walker,” Denelle told Team 10. SAN DIEGO (KGTV) — In preparation for high heat expected this month, the county will close six parks.Officials close the parks every August as a safety measure for the typically high temperatures recorded at the sites.The following parks will be closed through Aug. 31:El Capitan Preserve, LakesideHellhole Canyon Preserve, Valley Center Mount Gower Preserve, Ramona Wilderness Gardens, PalaIn addition to the four parks, two more parks will continue to be closed throughout the summer until Labor Day weekend:Agua Caliente Regional Park, Anza BorregoVallecito County Park, JulianThe closures also give Department of Parks and Recreation staff time to perform much needed maintenance at the parks.There are still more than 100 other trails throughout the county to explore during the summer.
