SAN DIEGO (CNS) - A transient who allegedly overpowered a woman in the East Village, dragged her into some bushes and sexually assaulted her before running away pleaded not guilty Tuesday to three felony charges, including assault with intent to commit rape.Gary Ryan Cushinberry, 51, who is on felony probation for robbery and failing to appear in court, was ordered held without bail.Late on the evening of Nov. 5, Cushinberry allegedly grabbed a 26-year-old pedestrian walking by herself in the 400 block of 13th Street, pulled her off the sidewalk and assaulted her before fleeing.Detectives identified Cushinberry -- a recent transplant from Indiana who has been living on the streets of San Diego -- as the alleged perpetrator by means of ``several tips and leads,'' Lt. Jason Weeden said.Cushinberry was arrested last Friday about 6:45 a.m. in the 200 block of 17th Street.When Judge Jay Bloom ordered the defendant to stay away from the alleged victim, Cushinberry said ``I don't know the woman,'' according to Deputy District Attorney Martin Doyle.The prosecutor said Cushinberry has a criminal past from Indiana that is still being looked into.Cushinberry -- who is also charged with two counts of digital penetration by a foreign object, faces 21 years in prison if convicted, Doyle said.A readiness conference was set for Dec. 3 and a preliminary hearing for Dec. 5. 1391

SAN DIEGO (CNS) - County health officials announced Thursday that flu activity remained steady over the last week but confirmed flu cases are still three times what they were at this time last year.The county's Health and Human Services Agency confirmed only 36 flu cases over the last week, bringing the county's 2019-2020 flu season case total to 335. The county had confirmed 109 cases at this time last year.Only two residents have died due to flu complications since the county's flu season started July 1. At this time last flu season, the county had not recorded a flu death.County health officials expect flu cases to spike as the year approaches the holiday season and gets deeper into autumn and winter."The holiday season is right around the corner," said Dr. Wilma Wooten, the county's public health officer. "With family and work gatherings coming up and people taking part in holiday activities, now is the time to get your flu shot to make sure you avoid getting sick and spreading the virus to others."County health officials and the U.S. Centers for Disease Control and Prevention strongly advise the annual flu vaccination for everyone 6 months and older, especially in demographics with a heightened risk of serious complications like pregnant women, people with chronic medical conditions like lung disease and people age 65 or older.Residents can take precaution against contracting the virus by frequently washing their hands, cleaning commonly touched surfaces and avoiding contact with sick people. SAN DIEGO (CNS) - A woman was injured by a hit-and-run driver early Sunday while walking on the curb line of a street in the Midway District.The victim was walking at 2:56 a.m. in the 3800 block of Camino Del Rio West when an unknown vehicle struck her and fled the scene, according to Officer S. Foster of the San Diego Police Department.She was taken to a hospital for treatment of her injuries, Foster said.The Traffic Division of the police department is investigating the hit and run. 497

SAN DIEGO (CNS) - Authorities Wednesday released the name of a 19-year-old man killed last week in a shooting at Linda Vista Recreation Center.Nam Nguyen of San Diego was shot by an unidentified assailant about 4:45 p.m. Friday during a fight between two groups of young men near a basketball court at the city recreation facility in the 7000 block of Levant Street, according to police.Paramedics took Nguyen to a nearby hospital, where he was pronounced dead, Lt. SAN DIEGO (CNS) - Murder and other felony charges were filed Wednesday against a 20-year-old probationer who allegedly fired a gunshot toward his brother, missing him but inadvertently killing a next-door neighbor asleep in his bed.Manuula Save is accused in the Saturday morning death of Michael Walker, 38, who was shot about 1:45 a.m. by a bullet that traveled through a bedroom wall in the defendant's apartment and into the victim's unit in the 13400 block of Midland Road. Walker was hit once in the abdomen and died at a hospital about an hour later.Save faces life imprisonment if convicted of murder, shooting into an inhabited dwelling, assault with a semi-automatic firearm and being a felon in possession of a firearm.RELATED: Man killed by stray bullet in Poway apartment complex, suspect arrestedDeputy District Attorney Kristie Nikoletich said the shooting stemmed from a verbal argument and physical fight between Save and his older brother. "The defendant retrieved a firearm and fired in the direction of his brother to scare him and show his brother that he wasn't scared of him," Nikoletich said. But that bullet ended up going through a wall and striking a sleeping neighbor, Michael Walker. His grieving widow, Christina was inside the courtroom Wednesday, crying throughout the proceedings. 10News spoke to her earlier this week. "I'm just seeing this hole in his stomach, and then I look over, and there's a hole in my wall," Christina Walker said on the phone. She said he was sleeping in the guest room that night, so his snoring would not wake her up — A move that would place him right in the path of that stray bullet, and kill him hours later. Save then allegedly hid the 9mm firearm, which he was not allowed to possess due to a previous hit-and-run conviction involving the death of an elderly woman, Nikoletich said. Save was sentenced to probation in that case, she said.Nikoletich said Save was charged with murder due to "the defendant's conscious disregard for human life."Save, who's being held in lieu of million bail, is due back in court Aug. 29 for a readiness conference. 2145
