SAN DIEGO (CNS) - The California Supreme Court on Monday upheld the conviction of a death row inmate found guilty of hiring another man to shoot and kill his fiancee in Alpine 20 years ago.Michael William Flinner applied for a life insurance policy for 18-year-old Tamra Keck, then arranged for his former employee, Haron Ontiveros, to kill her on June 11, 2000, according to the ruling.The killing occurred shortly after Flinner met Keck and began dating her.According to the ruling, Flinner named himself as the beneficiary in the insurance policy, and falsely alleged Keck was an employee at his landscaping business whose death would cause him to suffer financially. Prosecutors alleged Flinner arranged for Ontiveros to meet with Keck at a gas station, then direct her to his car in a nearby cul-de-sac under the guise of having engine trouble. Once there, he shot Keck in the back of the head.Separate juries convicted Flinner and Ontiveros of murder and conspiracy and found true special circumstance allegations of killing for financial gain and lying in wait. Jurors recommended capital punishment for Flinner and life imprisonment without the possibility of parole for Ontiveros.In the appeal, Flinner's counsel alleged his case was adversely affected by issues that included limited access to defense counsel, which was allegedly restricted by Flinner's relocation from the downtown San Diego jail to the jail in Vista. Flinner's defense attorney at the time claimed the distance to Vista and other limits on telephone communication would hurt the defense's preparation for trial. According to the ruling, the relocation was implemented because Flinner obtained the home addresses of the prosecutor and trial judge through another inmate.The state Supreme Court found the claims had no merit, as the trial court permitted increased communication between Flinner and the defense team at the defense's request.Another claim alleged juror misconduct by one panelist who sought to write a book about the trial. Flinner's counsel alleged her objectivity may have been compromised as a result. SAN DIEGO (CNS) - The San Diego County Board of Supervisors Wednesday gave final approval to a measure to reduce light pollution in two rural communities.The amendment to the county's Light Pollution Chapter ordinance covers the Julian and Borrego Springs Community Planning Areas. Both will now be considered "Zone C" to receive a Dark Sky Community designation, which limits the total amount of light per acre and has more restrictive standards for signage or nighttime sports.During their regular meeting on Oct. 28, supervisors approved the ordinance amendment on first reading, and also found it to be exempt from the state's Environmental Quality Act, as it does not affect land use or density.Taking effect in January, the ordinance will support Julian in becoming an International Dark Sky Community and update Borrego Springs' light pollution standards.According to the county, changes willinclude new lighting standards (for color type, levels and shielding) and sign illumination. The county will give existing developments 10-year grace period to come into compliance.Dark skies are important to astronomers for better viewing in rural communities, along with businesses that benefit from related tourism. SAN DIEGO (CNS) - SANDAG and Caltrans opened a southbound Interstate 5 auxiliary lane in the University City area.The new exit-only lane allows motorists to enter the freeway from Genesee Avenue and continue directly to the La Jolla Village Drive off-ramp without having to merge with freeway traffic.The approximately half-mile auxiliary lane is intended to improve traffic flow, reduce travel delays and increase overall safety in the area. Prior to its completion, the heavily trafficked southbound I-5 off-ramp to La Jolla Village Drive often caused congestion on the freeway, posing a safety risk to motorists.Construction for the I-5/Genesee Avenue Auxiliary Lane project began in July 2019 and required careful work alongside freeway traffic. The million project was made possible by the Road Repair and Accountability Act of 2017, which increased the state gas tax to fund state transportation projects.The auxiliary lane was constructed concurrently with the Mid-Coast Trolley project, which will extend Blue Line Trolley service from Downtown San Diego north to the University community when it opens for service in late 2021.The auxiliary lane runs beneath the Voigt Drive Trolley bridge, one of two locations where the future trolley will travel over I-5. 1278
