SAN DIEGO (KGTV) -- A judge has ruled that the government can continue waiving environmental laws to proceed with construction of a U.S.-Mexico border wall.Judge Gonzalo Curiel issued the ruling Tuesday afternoon. The ruling allows 14 miles of border wall to be built southeast of San Diego.The ruling comes one day after the Washington Post reported that President Trump will visit border wall prototypes in mid-March. RELATED: President Trump to visit San Diego, inspect border wall prototypesIn early February, ABC News reported that the Center for Biological Diversity filed a lawsuit against the U.S. Department of Homeland Security to protect endangered butterflies. Environmentalists claim the Quino checkerspot butterfly and a number of other species could be in danger if construction of the border wall continues. “We intend to appeal this disappointing ruling, which would allow Trump to shrug off crucial environmental laws that protect people and wildlife,” said Brian Segee, a senior attorney at the Center for Biological Diversity.“The Trump administration has completely overreached its authority in its rush to build this destructive, senseless wall. They’re giving unprecedented, sweeping power to an unelected agency chief to ignore dozens of laws and crash through hundreds of miles of spectacular borderlands. SAN DIEGO (KGTV) - A Marine was honored Monday at Camp Pendleton for his bravery mid-September when he saved a choking baby.Private First Class Jonathan Lewellen was on leave after graduating boot camp before starting combat training. He was upgrading his phone at the Liberty Station Verizon store when he heard a mother screaming her son's name."She wasn’t hysterical but she was panicked," Verizon Store Manager Cecil Silva said. "He [Lewellen] looked and his instincts just kicked in, like he literally jumped over a desk we had, jumped over the railing, ran through the bushes and just attended to the baby."Lewellen asked the mother if he could help, then performed CPR, and scooped mucus out of the baby's throat."The baby was pretty pale, started getting a little blue-ish," Silva said he called 9-1-1 and was asked to stay on the line, saying several others calling couldn't hold a connection due to bad cell service."Once the ambulance was here they were just like, you’re lucky this guy was here," Silva said both parents were shaken from what happened. He added he has nieces and nephews of the same age and admired how Lewellen had the training and response to provide aide."That just shows, you never you never just turn that part of you off. Good people are just good people," he said, calling him a hero."I did what I was trained to do I don't think I'm a hero more than anyone else would be," Lewellen said. SAN DIEGO (KGTV) – A Lemon Grove man was charged Wednesday with aiming a laser pointer at a San Diego Police helicopter as a demonstration moved through Hillcrest last weekend.Rudy Alvarez, 24, was charged with aiming a laser pointer at an aircraft hovering over the protest on June 6, according to the Department of Justice.A federal complaint alleges Alvarez shined a laser at the SDPD aircraft at about 8:30 p.m. in the area of the 500 block of University Ave. During that time, a large demonstration was moving through the area, investigators added.Alvarez was located multiple times over the next hour in the crowd, before police identified him on G St. just before 10 p.m. and arrested him without incident.Detectives say they found a high-powered gray metal laser pointer in his front left pant pocket."Aiming a laser pointer at or near an aircraft could cause distraction or blindness to a pilot and the consequences could be devastating," said U.S. Attorney Robert Brewer. "We support the Constitutional rights of free speech and assembly, but it is our duty to protect the public and law enforcement from danger."Alvarez's bond was set at ,000 and his next hearing was set for June 23. 1205

SAN DIEGO (KGTV) — A recent bout with the flu nearly turned deadly for a San Carlos man when it took an unexpected turn.Five weeks ago, the usually healthy 58-year-old Dave Truby came down with the flu."Fever, nausea, inability to sleep ... body soreness," said Dave's brother, Mike.Mike his brother says Dave tried to fight through it. Some five days later, Dave went to an ER, but left because of the wait for beds. That same night at home, his brother found him in bad shape."Literally shaking in a fetal position," said Mike Truby.At the hospital, Mike received some devastating news. His brother's kidneys were failing, and the MRI showed brain damage from a massive stroke. "The brain wasn't getting clean blood. It was shutting down. The whole body was shutting down. They said it didn't look good," said Mike.Loved ones and friends braced for the worst."I said my prayers and breathed deep," he said.Those prayers were answered in gradual fashion. His kidneys started working and Dave started responding."The last two weeks, he moved his head, blinked, and mouthed words. Wheeled my mom into the hospital room a week ago, and he looked up and mouthed, 'Mom.' Gives us a lot of hope," he said. "You never think the flu is going to impact your life in a possibly terminal way."Much of his prognosis remains uncertain, but Mike is optimistic, though he's still a bit in shock over how this came about.Two recent studies suggest the flu can trigger strokes and lead to a prolonged risk lasting months. In Dave's case, he will survive his stroke. "Very thankful and very grateful. My brother has always been a stubborn, forceful man ... SAN DIEGO (KGTV) — A man who was convicted of robbing a Chula Vista bank and fleeing the scene on a Lime scooter was sentenced on Monday to nearly five years in prison.Mario Daniel Haro, a 32-year-old United States citizen who lived in Rosarito, Mexico, was sentenced to 57 months in prison and must pay restitution for robbing the Chase Bank at 2121 Olympic Parkway in October 2019.In February, Haro admitted to entering the bank, telling a bank teller he had a gun, and handing the teller a threatening note, reading “I have a GUN! Give me all money. NO INK Packages."The teller complied with Haro's demands, officials said, and gave him about ,000. Haro then fled the scene on a Lime electric scooter.“Unfortunately this defendant failed to take advantage of his second chance and committed an additional violent crime,” said U.S. Attorney Robert Brewer. “As this case demonstrates, individuals who reoffend will be investigated, arrested and convicted and usually the sentence will be longer.
