When Bob Prebola saw a young white man riding a bike and putting up posters in his neighborhood, he and his wife took a close look and thought somebody was being racist. The picture is of a man, who appears to be Black, with his nose distorted to look larger or turned up.Prebola took down the posters near his house in Livonia, Michigan, and told 7 Action News, "the picture to me is highly offensive. WEST PALM BEACH, Fla. — There were plenty of Palm Beach County residents opposed to a mask mandate. Now some of them are suing to stop it.A lawsuit filed Tuesday in Palm Beach County court seeks injunctive relief to overturn the county's order.Attorneys representing Palm Beach County residents Rachel Eade, Carl Holme, Josie Machovic and Robert Spreitzer claim the new order requiring that masks be worn in public places infringes upon the constitutional rights of the plaintiffs.The 37-page lawsuit, filed by the Coconut Creek-based Florida Civil Rights Coalition, argues that the plaintiffs and other residents are having their "well-settled constitutionally protected freedoms" violated, including their "constitutional and human right to privacy and bodily autonomy."The lawsuit goes on to say that the county, having no authority to do so under Florida law, "has recklessly required countless American citizens and Florida residents," including the plaintiffs, "to submit to dangerous medical treatments with well-known risks and potential for serious injuries and death, including being forced to wear harmful medical devices like masks."Palm Beach County commissioners unanimously voted last week in favor of the mask mandate to help prevent the spread of the coronavirus amid a recent surge in cases throughout the county and state.The lawsuit takes aim at the "ridiculously vague" language of the order, which attorneys for the plaintiffs claim forces residents and visitors "to guess at the meanings and be subjected to punishment and criminal consequence."It also chastises the order's exemptions "because it arbitrarily and absurdly discriminates against anyone over the age of 2 years old, and countless citizens" who don't meet the "unlawful order's vague and ambiguous exceptions."The lawsuit berates county leaders for not clearly defining terms like "businesses or establishments" and "persons" as it is written in the order."Are non-citizens included?" attorneys wrote. "One is only left to guess, which is why the unlawful order is void for vagueness."Attorneys for the plaintiffs argue that a permanent injunction "will serve the public interest.""Millions of Palm Beach County residents and visitors are burdened by the over-reach of their local government in a fashion not before seen in the history of Florida," they wrote, adding that residents are "unduly burdened" by this violation of their rights. "The public has a strong interest in protecting their rights and ability to control their own bodies in the workplace and in public."Palm Beach County State Attorney Dave Aronberg said during a news conference Friday that commissioners do, in fact, have the constitutional authority to mandate masks."Obviously, those individuals who claim that they know the First Amendment have obviously never read the First Amendment," Aronberg said. "Because it is within the authority of the County Commission to put forward a mask ordinance. They have the authority under state law. They have the authority under the Constitution."The lawsuit seeks expedited consideration because the order is currently in effect. A written response by the county is required within 20 days of the filing.Several studies show that a mask or facial covering limits the wearer from spreading airborne droplets when speaking, sneezing or coughing. When COVID-19 forced businesses to reduce capacity, restaurants had to get creative. Many opened up outdoor space to dine.Now, with winter coming, restaurants are scrambling to figure out how to keep outdoor spaces comfortable.“We won a James Beard award here. I think what we’re known for is amazing food and service and great wine,” said Chef Jennifer Jasinski, owner of Crafted Concepts Restaurant Group. Rioja is one of the restaurants.“We’re just trying to plan. Hope for the best, plan for the worst,” Jasinski said.Like many restaurants across the U.S., Rioja is struggling with bringing business back and following physical distancing guidelines.“The order that let us increase our patio at each of our restaurants was a really big help over the summer. It got us to about 65 to 70% of our prior year occupancy,” Jasinski said.Outdoor space has been the saving grace for many.The National Restaurant Association Research Group conducted a survey of more than 3,500 restaurant operators from August 26 to September 1 nationwide.“Places that have table service, approximately three fourths are currently utilizing outdoor space which is a very large percentage,” said Mike Whatley, vice president of state and local affairs for the National Restaurant Association. “And it's making up an average of 44% of daily sales, which is very high by historical standards. Almost half of their money currently is coming from outdoor dining.” But outdoor space may present some challenges in the coming months.“Equipment for outdoor dining, especially when it gets cold, it gets expensive,” Whatley said. “What we found is that the average restaurateur is hoping to utilize their outdoor space two months more from this point moving forward.”“It’s absolutely terrifying. I feel like it’s 'Game of Thrones' and winter is coming and I’m scared. It’s not white walkers, I’m just scared of the occupancy,” Jasinski said. And she’s not alone.Many restaurants across the country are facing the same battle, and searching for solutions. The City of Chicago is reaching out to help by hosting a Winter Design Challenge, inviting the community to reimagine the winter outdoor dining experience for a prize.It’s similar to how Larimer Square in Denver, Colorado, where Rioja is located, was re-imagined, by letting the community have a say.“It wasn't just about the seating capacity, it was about the experience itself of being on the street and I mean really, it’s worked,” Jon Buerge said. Buerge is the Chief Development Officer at Urban Villages, the property management company in charge of Larimer Square, a prime example of the “Street-ery” concept.“This 'street-ery' concept is a new one where you block off a street in an urban area, and allow restaurants to take over some of that space. We’re seeing that in a number of jurisdictions,” Whatley said.“Some of the things that we've been exploring are tent systems that could be heated and, on a nice day, you can roll up the walls,” Buerge said. He said solutions really depend on the place.“Seattle has been slower to reopen. The people in Seattle have been less willing to go out and restaurants have been closed for longer. So it depends on the market, it depends on the weather, it depends on whether the people in these cities are ready to come out,” he said.As temperatures drop, restaurants are weighing the benefits and costs of seating diners outdoors.“There's all these hoops we have to jump through for less dollars,” Jasinski said. “I haven't heard of anybody else having any brilliant ideas that don't cost a ton of money.” 3588
While many hair salon and gym owners across the country understood why they had to shut down during the pandemic, those closures created a financial hardship. A hardship that some are finding difficult to overcome."Economically, it's been devastating to us. We opened up our gym three years ago and sort of like a little miracle. We took over an existing gym that was probably not fitting the community. We came in there with our life savings, we opened up this beautiful gym and we were becoming very successful," said John Pena, the owner of GYM NYC in New York City.Pena says their business was shut down for nearly six months. Now, he's finally excited to reopen. Pena applied for and received money from the Paycheck Protection Program but it only did so much. "There is no income coming in from the business, obviously. The extra 0 on the unemployment has really been a big help but that’s going away. I’ve been able to pay my bills and that's it," said Pena. Pena and other gym owners in New York are hoping for more government help for small businesses to help them get back on their feet."In general, I think there is a set of overhead expenses that I’m sure owners in any industry would tell you play a huge factor. Rent, utilities, payroll, insurance etc., and those are fixed costs that you sort of wonder whether they’ll be any concessions made," said Elvira Yambot, COO of Tone House.In Tennessee, the Shelby County Commission is offering small brick and mortar businesses ,000 each as part of the Beautiful Comeback Grant. "It applies to any business that is in the personal care contact industry. So right off the bat you'd think of barber shops, beauty salons, nail salons but you also think about people who work in the massage industry, as well," said Shelby County Commissioner Mickell Lowery.Gyms also qualify, along with any other business where close physical contact with clients is required."Even when they’re allowed to open they still have to incur additional costs because now they have to open under certain stipulations. You have to have either have PPE which we all have to have now, you have to have that, that's a cost you might have to have, disposable capes and that nature, maybe plexiglass between you and a client, things of that nature depending what type of work you’re doing," said Lowery. Commissioner Lowery hopes other local governments across the country are also able to give something back to small businesses."If you're going to tell businesses to shut down, you have to give me something back so I don't starve," says Pena. For Pena, he's concerned that not helping businesses reopen could have a devastating economic impact. "The quicker we can get back on our feet, the quicker we can get back and people can start walking around and feeling confident, because not making any money, not being able to feed your family is far worse than this coronavirus," said Pena. 2929
