SAN DIEGO, Calif. (KGTV) - A former assistant at a local nursing home is accused of raping a disabled patient. In a story that you'll first see on 10News, Team 10 investigative reporter Jennifer Kastner discovered the patient was a stroke victim who uses a wheelchair. What may have happened behind the walls of the Paradise Hills nursing home is difficult to process. An accusation of rape seemed to have slid under the radar for almost a year, until now. It was a few months ago when 10News was tipped off about Reo Vista Healthcare Center, which touts being named one of Newsweek's top nursing homes and having a Medicare 5-star rating.This week, San Diego Police confirmed that detectives referred the case to the District Attorney's office, which is charging 26-year-old Ariel Chavarin-Camargo with forcible rape and a "lewd act upon a dependent adult by a caretaker". He is now sitting in a South Bay jail. According to state documents, it happened last February to a 58-year-old woman who uses a wheelchair and was living in the nursing home after suffering from a stroke and panic disorder. The documents report that the morning after the alleged assault, she reportedly came "crying" to a nurse, claiming that the night before, when she was returning from the kitchen and on her way back, "one of the CNAs (Certified Nursing Assistants) stated that one of her breasts was exposed." According to the documents, he “followed her and he exposed his private parts to her". She reportedly said, "the CNA raped her" for up to three minutes. A forensic exam reportedly found male DNA in her private area. According to the documents, when he was later questioned, he suggested that she came onto him but admitted "it happened” and “there was penetration". He reportedly said, "I feel bad. It happened so fast." Prosecutors believe that man is Chavarin-Camargo. He resigned after the reported rape. The administration of Reo Vista Healthcare Center sent 10News the following statement on Tuesday."We are grateful to local law enforcement and the District Attorney’s Office for successfully prosecuting this individual for their crime. Our team took immediate steps last February to suspend the individual, to notify, and to fully cooperate with authorities. We take all matters regarding patient safety and the conduct of staff seriously. Moreover, the actions of this individual do not reflect the values we hold at our facility. (KGTV) -- Three people are dead following a crash on Interstate 805 in University City.The California Highway Patrol says the crash happened in the northbound lanes of I-805 at Miramar Road around 4:30 p.m.According to CHP, the crash happened after a wrong-way driver drove onto the road at a high rate of speed."Through the investigation, we will try to determined where this individual, if they got on the freeway the wrong way, where they got on," CHP Officer, Jake Sanchez said. Hector Puga was on his way to Los Angeles when the car in front of him combusted. He somehow managed to escape the crash and flames. "All I can do is hold onto the steering wheel and run over everything that exploded," Puga said. He escaped with just a flat tire and broken windshield.10News also spoke to a pair of sisters who had just finished up a fun day of shopping at UTC Mall when hopped into their car. Minutes later, they endured a near-death experience. "It was like a scene from a movie," she said. "All the cars were stopping. There was smoke. Fire. Loud noise. As soon as I look up in front of me, that car other there was flying and tumbling down the freeway."They said the driver of the flipped over SUV managed to crawl out of the car.  The survivors carried him to the shoulder, where an ambulance later picked him up. SAN DIEGO, Calif. (KGTV) - A proposal to build a four-story, 48 unit apartment complex in Carmel Valley has riled some neighbors, to the point where hundreds of them have now signed a petition asking the San Diego City Council to abandon the project.The complex would be at 10211 Rancho Carmel Drive, just off the 15 Freeway near Ted Williams Parkway. It's less than a half-acre. Right now, a two-story parking structure sits on the plot of land.Plans from developer New Pointe Communities say they would build the complex on top of the parking garage, essentially creating a six-story building.People who live in the nearby Provencal community say it doesn't fit the neighborhood. They've started an online petition to stop it."That’s pretty tall, and that just doesn’t fit in" says Eric Von Waldner, who signed the petition."It’s going to take away our view, take away our privacy. There will be balconies looking right at us. I just don’t like the idea of it," he adds.Von Waldner says neighbors worry the added units will overwhelm the area's electrical, water and sewage grid.They also say it will cause traffic headaches at the signal light on Rancho Carmel Drive and Provencal Place."You got Starbucks over there. You got people that live in my community. If you add 48 more units, it’s going to be crazy," says Von Waldner.They plan to send the petition to District 5 City Councilmember Mark Kersey, asking for a new plan. The Council already has an agreement with New Pointe to sell the land.“A number of residents have contacted me about the proposed project on Rancho Carmel Drive, and I continue to welcome feedback from my constituents. Any redevelopment plans for the site will go through an extensive public process with numerous opportunities for input from the community,” Kersey said in a statement to 10News.According to Eric Edelmen, the chair of the Carmel Mountain Ranch Community Council, the developer still has to submit a formal proposal to the city. They also have to ask for the area to be re-zoned to allow the extra units.Right now, Edelman says the land is only zoned for eight units.He says the last time they heard from New Pointe was at a November 14th meeting. San Diego, CA (KGTV)- Some high school students in the Grossmont Union High School District will return to partial in-person learning starting on September 29.Sixty-eight percent of parents surveyed districtwide wanted their high school students to return to an in-person, blended learning model, while 32 percent wanted their students to stay in full-time distance learning from home.The district is moving forward with both options.Starting Tuesday, some students will be back on campus with limitations."Students have to be divided into smaller groups," said Theresa Kemper, the district's superintendent.If parents chose the blended learning model, their student has been assigned to Group A, Group B, Group C, or Group D, based on factions like students per household, transportation needs, and course schedule."They each will come to school one day a week," she said.The group placement determines which day the students will come to campus; they will be learning from home the rest of the time.The district created a roadmap for reopening, which includes five levels."We want to make sure that we're really confident with new routines that have been established, we want to make sure the county health conditions are continuing to improve," said Kemper.All schools in the district have been operating at Level 1, which is strictly distance learning.Level 2 begins next week and allows students to learn on campus one day a week, with 25 percent of the campus population, in class sizes of eight to twelve students."Our Special Education academies and alternative schools are also starting at Level 2, but will attend two days a week instead of one," she said.All students will be screened and have their temperatures checked before entering the classroom, teachers, and staff will be tested for COVID-19 regularly, and everyone will be required to wear facial coverings.The schools will also be deep cleaned each day, and students will be physically distanced from one another."If everything looks good, after about two weeks, we could potentially announce going to the next level," said Kemper.By level five, students will be back on campus five days a week.Kemper said the district is taking a cautious approach and has plans in place if a school needs to jump back a level at any time."If we change from two days a week to one day a week, then we already got a plan in place, and it's easy to transition to that," she said. SAN DIEGO (KGTV): A new study shows that young adults are seeing a spike in deaths from liver disease related to binge drinking. It's especially dangerous in California, where high alcohol content drinks are popular.The study, published this month in the British Medical Journal, says that the number of 25- to 34-year-olds who died annually from alcohol-related liver disease nearly tripled between 1999 and 2016, from 259 in 1999 to 767 in 2016, an average annual increase of around 10 percent.It cites binge drinking as a leading cause, because of rising rates of alcohol consumption between 2002 and 2012.It's especially bad in California, which the study says was among the top five states for those types of deaths.Local experts say the kind of alcohol we drink may be to blame, as craft beers tend to have higher concentrations of alcohol."If someone was having highly concentrated alcohol, then they're consuming more drinks per hour," says Dr. Rohit Loomba, with the UC San Diego Health Liver Center. "That will have detrimental effects on the liver, for sure."The CDC recommends no more than 1-2 drinks per day for "moderate" drinking. Binge drinking is defined as 4 or more drinks over 4-6 hours. Loomba says you may hit the "binge" point in fewer drinks if what you're having is stronger.For example, a Bud Light has just 4.2% alcohol by volume. Craft beers often have 6% or higher, so one craft beer may be as much as 2 or 3 other drinks."That quantity of alcohol intake over years definitely will contribute to higher risk for liver disease," says Loomba.He says people should ask themselves four questions to determine if they are drinking too much:1. Have you ever cut down on drinking? 2. Would you be annoyed if somebody asked you to cut down on drinking? 3. Do you feel guilty after drinking excessively over a weekend? 4. Do you need an "eye-opener" in the morning to get to work?Dr. Loomba says if you answered "yes" to 2 or more of these questions, you should talk to your doctor to discuss treatment.He also says obesity combined with alcohol can lead to more severe liver problems and even death. People with diabetes or who are overweight multiply their risk of the disease."If you're obese, you not only should restrict your alcohol, but you should try to lose some weight as well," says Loomba.The study says the financial crisis may have led to more binge drinking in the past decade, as young adults turned to alcohol to cope with financial stress. Researchers found the rise in alcohol-related deaths overlaps with rising rates of binge drinking from 2002 to 2012 observed across much of the U.S.The good news, according to the study, is that many liver diseases are preventable and reversible."Once you stop alcohol use, you can reverse complications related to it in the majority of cases," says Dr. Loomba. 2882
