NEW YORK (AP) — Singer-songwriter Justin Townes Earle, a leading performer of American roots music known for his introspective and haunting style, has died at age 38.New West Records publicist Brady Brock confirmed his death, but did not immediately provide details.Earle was the son of country star Steve Earle and over the weekend his family posted a Facebook announcement of his death, telling his fans that they hope his music will continue to guide them for years to come.His family also posted lyrics from the ballad “Looking for a Place to Land,” from Earle’s 2014 album “Single Mothers.” 603

NEW YORK (AP) — The operator of Ann Taylor and Lane Bryant filed for Chapter 11 bankruptcy on Thursday, the latest retailer to do so during the pandemic. Ascena Retail Group, which operates nearly 3,000 stores mostly at malls, has been dragged down by debt and weak sales for years. In a press release, the company said they were closing all of their plus-size stores Catherines.The company also said in the release that they plan to "strategically reduce its footprint with the closing of a significant number of Justice stores and a select number of Ann Taylor, LOFT, Lane Bryant, and Lou & Grey stores."It joins other retailers that have filed for bankruptcy in recent weeks, including Brooks Brothers, Neiman Marcus, J.C. Penney, and J. Crew. These retailers were already struggling with poor sales, but the forced closure of stores in March to reduce the spread of the coronavirus put them further in peril. North Wind Heating and Air is a local family-run business proudly serving Macomb County for 28 years. Lisa Agostino signed a work order approving both a service call and repairs to her a/c unit. The part was installed that same day. After the part was installed she reached out to North Wind stating that she no longer agreed with the price of the replaced part. Ms. Agostino was offered a solution to the dispute. She agreed that the part would be returned to North Wind. In turn Ms. Agostino would not be charged. This is what occurred. Ms. Agostino has not been charged for the service call or the replacement part.Days later Ms. Agostino posted false statements about North Wind on-line. She represents that she paid for the service call and replacement part, which she did not. These statements significantly effected North Wind's business. North Wind is a small local business. Ms. Agostino's false and defamatory statements have not only effected the North Wind's business, but has had a direct negative effect on its ability to offer full time hours to its employees.Prior to filing the lawsuit North Wind reached out to Ms. Agostino requesting the removal of the false statements. She refused. North Wind is simply seeking the removal of these false on-line statements.North Wind will continue to proudly serve its customers. 1342

Nearly two weeks after a 16-year-old Pennsylvania girl vanished with a 45-year-old man, the pair was found Saturday in Mexico and the man was arrested, authorities say.Amy Yu was "unharmed and in good health," Allentown police said in a statement.She and Kevin Esterly, the man police say she willingly ran away with, were escorted to Miami by US Homeland Security Investigations agents and the US Marshals Service.Amy has been safely returned to her family in Pennsylvania, according to a statement from Immigration and Customs Enforcement (ICE) and Homeland Security investigators.Esterly's arrest comes two days after Mexico's Attorney General issued an Amber Alert?for Amy. The alert said Esterly was the suspect in her disappearance and that an investigation showed she was in Mexico with Esterly. Her well-being, the alert said, was at risk.CNN has reached out to Mexico's attorney general and the federal police for comment, but has not heard back.Esterly was expected to be extradited back to Pennsylvania. 1027

Next week, the U.S. House and Senate will take up police reform bills.The House will address qualified immunity on a national level. It's a doctrine implemented by the U.S. Supreme Court that makes it difficult to sue police, even if one's constitutional rights are violated.The doctrine protects officers who can defend their actions because they didn't know their conduct was unconstitutional. That's because it wasn't “clearly established” in a prior court ruling.In practice, courts have dismissed civil rights lawsuits because there wasn't a previous case in the same location with the same circumstances. So, there's also no precedent for future cases. That's why the doctrine is criticized as a "catch 22."“That kind of ‘does this officer get the benefit of the doubt?’ type of inquiry gives judges just lots of room based on their interpretation, their view of whether this seems like a bad case or not, and it means that the judge is taking cases away from the jury based on their own views of the facts,” said Brandon Garrett, professor of law at Duke University.“The way to truly understand it is to look at in the context, as a lot of people are suddenly looking at it when police uses force, and particularly when it's deadly force,” said Aderson Francois, professor of law at Georgetown UniversityThe officers involved in a wrongful death lawsuit in Washington D.C. are expected to claim qualified immunity. In 2018, Marqueese Alston was shot and killed by police while running away. The court will only look at it from the perspective of police and if they reasonably feared for their lives.“What the court will not do is to ask did my client, a 22-year-old black man in DC have a reasonable fear for the police that caused him to run away in the first place,” said Francois.It's important to point out that officers do not personally foot the bill in these cases.“It's about the municipality, the county, the city,” said Garrett. “They're the ones who are paying. They're the ones who should be held accountable. After all, if this officer was poorly trained or didn't have the right support from colleagues, it's not the officer's fault necessarily.”Qualified immunity makes it so the constitutional issue is never addressed.
