The witnesses for Lee are expected to include three family members, his lawyers and spiritual adviser.Lee was convicted in Arkansas of the 1996 killings of gun dealer William Mueller, his wife, Nancy, and her 8-year-old daughter, Sarah Powell.“The government has been trying to plow forward with these executions despite many unanswered questions about the legality of its new execution protocol,” said Shawn Nolan, one of the attorneys for the men facing federal execution.The decision to move forward during a global health pandemic that has killed more than 135,000 people in the United States and is ravaging prisons nationwide, drew scrutiny from civil rights groups as well as family of Lee’s victims.Some members of the victims’ family argued they would be put at high risk for the coronavirus if they had to travel to attend, and sought to delay the execution until it was safer to travel. Those claims were at first granted but also eventually overturned by the Supreme Court.Critics argue that the government is creating an unnecessary and manufactured urgency for political gain. The US Office of Special Counsel announced Tuesday that White House aide Kellyanne Conway violated the Hatch Act on two occasions by "advocating for and against candidates" in last year's Alabama Senate special election.In a new report, the OSC special counsel, Henry Kerner, pointed to Conway's TV interviews conducted in her "official capacity" in November and December of last year. The agency said Conway "impermissibly mixed official government business with political views about candidates in the Alabama special election."One of the two interviews was on CNN's "New Day," and the second was on Fox News' "Fox & Friends."In a letter to President Donald Trump, Kerner said he is referring her violations for the President's "consideration of appropriate disciplinary action."The White House did not immediately respond to a request for comment.During the "Fox & Friends" interview November 20, Conway was introduced by the show's hosts as a "counselor to President Trump" and spoke from White House grounds. She said about Democratic Senate candidate Doug Jones: "Folks, don't be fooled. He'll be a vote against tax cuts. He's weak on crime, weak on borders. He's strong on raising your taxes. The nation’s death toll has surpassed 170,000, Johns Hopkins data showed Monday morning.On Sunday alone, deaths in the U.S. rose by over 480, according to a Reuters tally, with Florida, Texas and Louisiana reporting the most fatalities.The U.S. continues to lead the world in deaths and the number of cases reported, with at least 5.4 million people diagnosed with the novel coronavirus in the country. Johns Hopkins shows the next highest country is Brazil, with over 3.3 million diagnosed and 107,000 dead.Citing a national ensemble forecast, the Centers for Disease Control and Prevention said last Thursday that estimates show the U.S. could reach 200,000 deaths from COVID-19 by Labor Day weekend.The head of the CDC says the pandemic could become even more dire in the months to come. Director Robert Redfield told WebMD that “this could be the worst fall, from a public health perspective, we’ve ever seen.”The reason? Redfield points to the combination of the COVID-19 surge and flu season.
