SAN DIEGO (KGTV) — Documents show the man accused of pummeling a teenage Syrian refugee on a trolley car has a history of run-ins with authorities.On Oct. 15, Adrian Vergara was accused of the crime after approaching the teen and asking him if he's Mexican."He responded, no I am Arab. He does not speak a lot of English, and with that response the person began to pummel him in the face," Geneviéve Jones-Wright, Legal Director, Partnership for the Advancement of New Americans, said.Tuesday, San Diego Police said they had arrested Vergara on suspicion of assault with force and violation of civil rights.RELATED: Man accused of attacking Syrian refugee aboard trolley car arrested10News dug into Vergara's background and found a history of violent incidents. In 2012, court documents say Vergara threatened a man with a billy club. He did community service in the South Metro Career Center. A letter says he worked well there with special needs students as well as general students. A certificate also showed he completed a 12-hour anger management program in 2013 and was called an outstanding professional candidate.RELATED: Teen attacked on trolley in possible hate crimeIn 2015, a case was dismissed accusing Vergara of attacking another man. And in 2016, he was charged with grand theft and burglary for breaking into the Central Library.Later that year, documents say Vergara violated a restraining order against his ex-girlfriend, kicking her front door, texting her and in a phone call, cursing at her and saying, "if you don't talk to me I'm going to go to your job and cause a scene. I don't care about my life." Documents show he called her 20 times in 30 minutes.Court documents also show a carjacking charge at the beginning of 2017.In October 2017, Vergara was charged for beating up a man and given a stay away order from the MTS Imperial Transit Center.The most recent document shows he violated a court order, put in place to prevent domestic violence in January 2019. 1996

SAN DIEGO (KGTV) - Eateries in Ocean Beach say Memorial Day weekend is getting them back on top after a slow winter.A couple factors in play, nearly back to back storms and the closed pier. "Our numbers are still way above normal so we'll take it," South Beach Bar & Grille Bartender Philip Cullin said Friday and Saturday were great for business.Next door at Lighthouse Ice Cream, those sentiments were echoed.Sunday was a different story, clouds loomed overhead with sprinkles and rain in the evening, dampening the influx of customers. "It's really cold, there's not that many people out," 14-year-old birthday girl Bella said. She came out with friends and family to celebrate.Businesses thankful to see those customers, saying it's been tough through the slow winter months.Inside the bar, Cullin said they saw lots of business Sunday, "it comes in waves, you'll get like a mad lunch rush, everybody bombs in at the same time to get their fish tacos, and then they clear out mid afternoon and your locals come in."With the pier open, they're seeing even more people, "this area gets way more congested when people are chilling at the pier," Cullin said."I found out Thursday night the pier was opening on Friday and I knew I had to get here early and start making waffle cones, it was a busy day for us, we couldn't even find parking in the morning," Lighthouse Ice Cream Manager Robbie Valdivia said.They're hopeful Memorial Day will bring sunshine and another wave of customers."We actually had them for about two weeks now, a lot of tourists here from out of town, out of state, so it's been really really nice," Valdivia said, knowing it's the unofficial start of summer. SAN DIEGO (KGTV) - Detainees inside the Otay Mesa Detention Center can reportedly no longer make phone calls to certain immigrants' rights activists. “Quite frankly, I'm outraged that a U.S. federal agency (ICE) would cut off communication,” said Alex Mensing with Pueblo Sin Fronteras. Mensing told ABC10 News on Tuesday that his number was blocked along with numbers to another immigrants’ rights activist group, Otay Mesa Detention Resistance.“Last time I checked, in the United States we're not supposed to censor people's ability to denounce abuses, to denounce medical negligence, to denounce physical assault by guards…by private prison guards or ICE officers against the people,” he added.The Otay Mesa Detention Center has come under fire in recent months for allegations of poor health conditions and abuses inside, as hundreds of people being housed there were testing positive for COVID-19.In May, Salvadoran Carlos Escobar-Mejia became the first detainee in U.S. custody to die after testing positive for the virus. His funeral was held last week.ICE contractor CoreCivic operates the facility.When asked Tuesday about blocking calls, CoreCivic replied, “We took this action at the direction of our government partner. We encourage you to reach out to Immigration and Customs Enforcement (ICE) for more information on their rationale for this decision.”On Tuesday, a spokesperson for ICE sent ABC10 News the following statement:“Due to safety concerns for all detainees in custody, ICE has temporarily blocked detainee calls at Otay Mesa Detention Center to a specific San Diego area phone number after detainee calls to this number resulted in detainees exhibiting highly disruptive behavior, threatening the health and security of other detainees and employees at the facility. ICE takes very seriously the safety and well-being of those in our care and will take all necessary steps in order to ensure the continued safety of both detainees and staff.
