A convicted felon was arrested Friday morning after he broke into a random apartment and was discovered sleeping on a Rittman couple's couch, police said.Eric Branhan, 36, is charged with aggravated burglary.Police said Branham crawled through a window, busted some blinds and entered the apartment. He ate several pieces of candy from an Easter basket and then fell asleep on a living room couch.The couple who lives there, Jaclyn Fortner and Derek Jenkin, made the creepy discovery just after 6 a.m. local time."We kept saying like, 'Who are you? What are you doing?' And, no response, Fortner said.Jenkin continued to scream at the man while on the phone with a 911 operator."Get out of here! Let's go! Come on!"Police said Branham left the apartment but lingered around the complex and was arrested.Officers found two knives and prescription medication on the suspect."It's kind of scary, especially thinking what's out there, so he could have woke up angry and like escalated the situation," Fortney said.According to state records, Branham has spent time in prison for forgery, possession of drugs, illegal possession of drugs and burglary.Branham was on post release control following his release from prison in 2017.Rittman is located in northeast Ohio, about an hour south of Cleveland.   1335

A federal judge has dismissed several charges against Dr. Jumana Nagarwala in the historic female genital mutilation case, ruling that the federal law against female genital mutilation is unconstitutional.U.S. District Court Judge Bernard Friedman ruled that Congress did not have the power to enact a federal law that banned female genital mutilation in the United States.Instead, Friedman made the argument that the law was too broad and it violated Congress' powers, as the law does not stand up to scrutiny under either the Necessary and Proper Clause or the Commerce Clause of the US Constitution.He also found that laws penalizing Female Genital Mutilation should be handled at the state level, similar to laws regarding Criminal Sexual Conduct, battery or child abuse.  Shannon Smith is the Defense Attorney for Dr. Nagarwala.  She says the ruling is "absolutely a huge victory. When you actually studied the law they enacted, there was no constitutional basis for them to enact the law. It’s really an issue that should be left to the states."Smith also claims the doctors did not perform Female Genital Mutilation, saying instead they performed a mild form of female circumcision."What Dr. Nagarwala was doing, if we had gone to trial, would have been vindicated that she was not mutilating little girls. While we’re happy with the victory and we’ll certainly take it, there’s a part of me that’s a little disappointed that the public isn’t going to see the evidence brought out at a trial to see that she was never guilty of it in the first place," Smith said.The ruling comes after Friedman also dismissed a "conspiracy to transport minor with intent to engage in criminal sexual activity" charge in January. That was the only count that could have lead to life in prison for both Nagarwala and Dr. Fakhruddin Attar.Friedman's ruling leaves two counts in place in the case. A deadly crash involving semi-trucks has shut down eastbound Interstate 10 west of Tonopah, Arizona. According to the Arizona Department of Public Safety, multiple semi-trucks were involved in the crash near milepost 79. DPS says a semi rolled over in the area and a second semi was able to come to a stop to avoid the rolled-over truck. At that time, a third truck hit the second semi, killing the driver of the third truck. The impact of the wreck caused the second semi to hit the rolled truck, causing injuries to the second driver. Eastbound lanes are expected to remain closed for some time while crews get "heavy duty tow trucks" to remove the vehicles and debris.The Arizona Department of Transportation says drivers can use the following detour: I-10 EB detour at Vicksburg Road (milepost 45) north to US 60, east to Salome Road and drive southeast back to I-10 past crash site. 925
