SAN DIEGO (KGTV) — A Superior Court judge gave San Diego County restaurants the green light to serve on-site again, but not all will make use of the opportunity.For Roddy Browning, the pressure to reopen his restaurant is intense.“We lay in bed at 2:30 in the morning, going, 'Okay, what am I going to do? What am I going to do tomorrow? What am I going to do the next day?'” said Browning, who owns Oceanside's Flying Pig Pub and Kitchen.Browning said sales are down 60% and employees have been reduced from 30 to 12. Reopening for outdoor dining under the new court ruling could boost those numbers.“The state's going to appeal it, and what is the point in opening back up again, and then bringing all these people back to work and saying okay guys the ruling changed, now we're going to have to kick you out of the restaurant again,” Browning said. “I don’t want to do that to my employees anymore.”Don't get him wrong. Browning does plan to reopen under the new court order - but he wants to respect the full three weeks intended in this latest shutdown order, set to complete on Dec. 28."This is not about us against them," Browning said. "We said we would give the governor his three weeks, and I'm going to give him his three weeks."But other San Diego restaurants are planning to remain takeout only until health officials advise otherwise.At Spring Valley's Cali-Comfort Barbecue, a gathering place for sports fans, owner Shawn Walchef says he's not offering indoor or outdoor dining.“We believe that the coronavirus is the antithesis of hospitality. Everything we do in our blood is to take care of people,” Walchef said. “Social distancing doesn’t work in our business. We welcome people into our homes.”Walchef cut about half of his staff - a day he calls his toughest as a restaurant owner.But he says Cali Comfort has fully embraced multiple digital ordering systems, helping it to remain profitable amid the pandemic.Still, the recent order impacts many. SAN DIEGO (KGTV) — A San Diego-area man and his grandmother filed a federal lawsuit against two San Diego County Sheriff's Deputies.The lawsuit alleges deputies responded to the wrong address and pulled a then-17-year-old out of his apartment. "I've never experienced something like that," said Cesar Jaramillo.Jaramillo says last October he was watching TV on the couch when he heard a knock at the door. He says deputies asked if someone from the residence called 911.According to his lawsuit, "Cesar informed defendants the call was not from his residence. When defendants asked Cesar if there was a young black female in the apartment, Cesar said 'No,' and informed defendants that they were at the wrong apartment building. Cesar knew who defendants were referencing and knew they lived in the other building. Cesar informed the deputies over half-a-dozen times that defendants were at the wrong building."Jaramillo tells 10News he complied with everything the deputies asked but felt like they didn't believe him."That's when I started closing the wide door, that's when he just reached in and grabbed my hand," Jaramillo said.The lawsuit claims, "Without warrant or probable cause, both defendants unreasonably lured Cesar to unlock and open the door, then entered into Plaintiff's residence and forcibly pulled Cesar by the forearms into submission, leaving instant bruises on both arms."Jaramillo's grandmother was in the back of the house at the time and said she woke up to the commotion."I saw my grandson laying on the ground, in handcuffs and I went crazy, and I said, what is happening," said Teodora Villalobos.According to the lawsuit, "Due to unreasonable seizure and force used on her grandson Cesar, as well as defendants' indifferent attitude, Teodora began having heart complications on scene."Jaramillo's lawsuit alleges negligence, battery, and unreasonable search and seizure, among other things.10News reached out to the San Diego County Sheriff's Department for comment, but a spokesperson they can't comment on pending litigation. 2066

SAN DIEGO (KGTV) — A school district superintendent and a Native American reservation leader in North County are speaking out against the proposed placement of a sexually violent predator. On Thursday, there were strong reactions from those who are close to North County's Pauma Valley home where sexually violent predator Joshua Cooley could soon be placed. “When people like this are placed by our borders, it's very concerning,” Temet Aguilar, the Chairman of the Pauma Band of Mission Indians, said Thursday. Aguilar is encouraging the hundreds of families on and near the reservation to speak out against the placement of 40-year-old Cooley, whose victims were 12-years-old.“They think this is an area that's rural and there's nobody out here but actually it's more dangerous. Predators can hide out here. We have a tremendous amount of agriculture. We have rural lands,” he added.Valley Center-Pauma Unified School District Superintendent Ron McCowan told ABC10 News they'll write letters if they have to to make sure they're voices on the matter is heard. “We'll write the letters if we have to. We'll show up at the court hearing if we have to," McCowan said. “We'll make every effort we can. We'll work alongside our local officials and make sure that our voice for our community is heard and make sure they understand the risk that they're putting our young children in.”This Tuesday, DA Summer Stephan sent a letter to the Department of State Hospitals, urging the Department to find a different place for Cooley, who's from Northern California, not San Diego. He has no local connections.It's unclear why the Department is seeking his housing in San Diego.Next month, a Humboldt County judge will consider a request from the Department to place him in Pauma.If granted, it would mark the first time that such a predator from outside San Diego would be placed in our county.DA Stephan has called the move reckless and irresponsible. She said that in July, a San Diego judge struck down a request to place 75-year-old sexually violent predator Joseph Bocklett in the same Pauma home.According to an ABC station in Northern California, Cooley’s been denied placement in at least four different areas in and near Humboldt.The Department of State Hospitals will not confirm any information about Cooley, citing privacy concerns. A Humboldt County court official called ABC10 News on Thursday to say the Court would not comment.On Oct. 9, at 8:30 a.m., a hearing on Cooley's placement will be available for viewing at https://www.humboldt.courts.ca.gov/.Those interested in submitting a public comment for the hearing can do so between Sept. 15-23. SAN DIEGO (KGTV) — A woman was sentenced in a federal courtroom Wednesday for stealing mail from nearly 120 San Diegans and cashing stolen checks at banks.Marie Crystal Mays, 33, was sentenced to four years in prison for conspiring to steal mail from residents, including in the Rancho Pe?asquitos area, and defrauding banks in order to cash the stolen checks, according to the Office of the United States Attorney Southern District of California.Prosecutors say the investigation identified at least 119 victims.Mays pleaded guilty in August 2019 to conspiracy, bank fraud, aggravated identity theft, possession of stolen mail, and possession with intent to unlawfully use five or more identification documents.As part of her scheme, she stole credit cards, checks, and money orders from mailboxes, authorities say. She then created a bank account in a victim's name, deposited stolen checks, and withdrew money for herself.A judge also ordered Mays to pay ,950.66 in restitution to four banks and credit unions.“The people of San Diego deserve the peace of mind of knowing that when they send or receive mail, thieves won’t steal it from their mailboxes and scavenge for credit cards, checks and personally identifiable information,” said U.S. Attorney Robert Brewer. “The defendant’s conduct showed a callous and selfish disregard for scores of citizens’ privacy.” 1377

SAN DIEGO (KGTV) -- A stunning photo of a female surfer riding the waves was taken at sunset in Cardiff, and the photographer who took the image is hoping to find her.Los Angeles-based photographer Robin Kerr is inspired by nature. She has been taking nature and wildlife photos since she was a child.“My dad lent me his camera on our family vacation to Montana in 1989, ever since then I’ve had the bug,” said Kerr.Kerr said she had visited some amazing places to take photos, but her trip to San Diego in 2018 is one of her favorites.“I took a trip down to the San Diego Zoo Safari Park to see all of the wildlife there," said Kerr. “It had rained on and off all day. I was thinking it might be a really great sunset, something dramatic with the clouds.”Kerr made her way to Cardiff just before it got too dark to snap pictures of the beach. At that moment, she took a stunning photo of a female surfer gliding on the water, in front of a golden sunset.“You can tell she’s just experiencing so much joy in the photo, doing what she loves," Kerr told ABC 10News.Kerr said while taking photos of other objects on the beach, she missed meeting the surfer. She posted the picture, and another zoomed-in image of the woman on her social media accounts, hoping to find her. She had no luck. Nearly two years later, she is resuming her search.“I came across that picture again; I thought man it would be so great to actually find her," Kerr said.Kerr said she has not been able to retake a photo like this.
