SAN DIEGO (KGTV) — Gov. Gavin Newsom has vetoed a bill that would have required the State Justice Department to verify hunting licenses with Fish and Wildlife before approving a firearm sale to a person under 21.The proposed legislation came after ABC 10News uncovered that suspected Poway Synagogue shooter John Earnest purchased the weapon used in the April 2019 attack with an invalid hunting license that went unchecked. Earnest was only 19 at the time he bought the assault-style weapon from San Diego Guns, when the state's age-limit was 21. The age limit, however, remained 18 for those who possessed a valid, state-issued hunting license. The Justice Department does not verify hunting licenses with Fish and Wildlife, instead leaving it to the gun shop to make the only determination. The governor said creating the verification system would require a 30-month information technology project and could disrupt other firearm technology systems in development under seven other bills. "I am concerned that adding an information technology project will impede DOJ's ability to perform the work it has already been tasked," Newsom said in a veto statement. In an interview Wednesday, State Sen. Anthony Portantino expressed shock and disappointment that Newsom vetoed the legislation. "It's a loophole that needs to be closed," he said. "You can't have a system that relies on the validity of a license not being checked to make sure that that license is actually valid. The whole goal is to keep guns out of the wrong hands. This shooter in Poway got a gun based on a faulty license."Portantino vowed to continue pushing for the change, either through the governor's budget in January or a new bill next year. When making the purchase, Earnest presented a state hunting license that was not valid until July 1, 2019, two months after the alleged attack. That technicality meant the sale should have been rejected, Portantino said. It was Portantino's law that raised California's purchase age limit to 21 but created the hunting-license exemption for those 18 and older. Portantino's bill, Senate Bill 914, would have required the Justice Department to verify hunting licenses with Fish and Wildlife before approving a firearm sale to someone under 21. The bill passed both houses of the state Legislature before failing on the governor's desk.Still, legislators and Newsom did act in the aftermath of the shooting, by eliminating the hunting-license exemption for semi-automatic, center fire weapons. It still exists, however, for other guns, including bolt-action rifles and semi-automatic rimfire weapons. Israel Dahan, whose daughter Noya was injured by shrapnel during the attack, declined to comment, citing ongoing litigation related to the shooting. He said, however, that Noya, now 10, will likely need another minor surgery. He said physically she is holding up okay, but is still dealing with the aftermath psychologically.Earnest allegedly carried out the shooting the day after he picked up the gun, killing one congregant and injuring three others, including a child.A worker who answered the phone at San Diego Guns declined to comment Wednesday. 3176
SAN DIEGO (KGTV) - Fed up homeowners' associations are now turning to a local licensed private investigator for help with catching homeowners who are breaking HOA rules by renting out their homes on short-term vacation rental sites such as Airbnb, VRBO and Craigslist. “I admittedly watched a lot of Magnum, P. I. growing up,” jokes Nick Bradley of San Diego’s Bradley Investigative Services. In the last 6 months, Bradley has taken on a new field of investigative work. He and his associates are being hired by HOAs to investigate homeowners and tenants who are violating HOA bylaws and CC&Rs that prohibit turning units into short-term vacation rentals. Bradley gave 10News an exclusive interview about this new area of detective work. He declined to offer us specifics about how he executes his investigations into short-term rental violators. We ask, “Do you ever pose as a guest and do you do surveillance work?” Bradley replies, “No comment.” “My initial thought was [to laugh],” says San Diego attorney Dan Zimberoff. He represents homeowners and has previously represented HOAs. Zimberoff thinks it’s an extreme measure for HOAs to hire private investigators, but he understands why there’s so much passion over short-term rentals. “I think what makes this issue a little different [from others] is the dollars at stake, especially in San Diego. Some of these units can go for multiple hundreds of dollars a night or thousands of dollars. People care,” he adds. According to Airbnb, San Diego is the second ranking city in the state for Airbnb guests, after Los Angeles. Per Airbnb, in 2017 there were 537,000 guest arrivals in San Diego, generating 0 million in host income. “Right now, it’s too lucrative for [homeowners] to not do this,” says Bradley. The short-term rental fight in America’s finest city continues to be ugly. The city attorney has deemed short-term rentals illegal, per code. Meanwhile, the city council is delaying discussions over how to regulate them. Even so, certain HOAs have rules prohibiting them. The fines for violators can be astronomical. “It’s been ,000 per occurrence in some situations,” adds Bradley. If fines don’t work, court is another option. In 2012, The Mark condominium owners association filed a lawsuit against Thomas Stevens, a former condo owner, accusing him of violating the association’s policies about short-term rentals. He then had to pay out more than 0,000 after a judge ruled that he violated The Mark’s policies. Bradley can help gather the evidence that HOAs need to litigate. “When [HOAs] go to court, my documentation and reporting will basically count as expert witness testimony for our side,” he says. Zimberoff thinks it’s time for HOAs to consider allowing short-term rentals, but with reasonable and efficient regulations to curb nuisances, like excessive partying. “Instead of spending that energy trying to catch [a homeowner], let’s try to think of a long-term fix,” he adds. SAN DIEGO (KGTV) - Gusty Santa Ana winds and dry conditions prompted the National Weather Service to declare a Red Flag Warning for parts of San Diego County.A Fire Weather Watch was initially set to take effect Thursday, but NWS officials -- citing Santa Ana winds and low humidity -- updated the declaration into a Red Flag Warning.The warning is scheduled to take effect Thursday at 10 a.m. and will expire at 10 p.m. Friday.
