ENCINITAS, Calif. (KGTV) -- The San Diego Sheriff's Office is investigating an incident involving Phil Graham, a candidate to represent the 76th district in the California Assembly. Niki Burgan filed the battery case with the Sheriff's Office Sunday, May 20. She accuses Graham of forcibly kissing her at an Encinitas Bar. Burgan told 10News that it happened at 1st Street Bar on S. Coast Hwy 101 on the evening of Sunday, May 13, into the early morning of Monday, May 14 as the bar was closing. She said that Graham had initially been flirting, even mentioning that he was running for office and asked whether she would vote for him. After finding out that he was a Republican candidate she said, no she was a Democrat. At some point, she says his talk turned into aggression and Graham grabbed her hair, pulled her in, and started to kiss her. She said she had to push him off. Burgan also said she remembers that Graham had so much to drink that night that she had to help him sign his tab. The next morning Burgan says she learned that he was related to former Governor Pete Wilson and she was worried about repercussions. That's why she didn't file right charges right away. 1259

Fake states "New California State" and "New Nevada State" have joined in on a lawsuit brought on by Republican Texas Attorney General Ken Paxton, looking to overturn the results of the 2020 election.According to Forbes, Chairman of the New Nevada State movement Robert E. Thomas III filed a 13-page amicus brief Friday.According to the brief, the pretend states are "directly impacted by the arbitrary and capricious changes in election laws and procedures occur with unfortunate regularity in the current States of California and Nevada.""New California State" and "New Nevada State" are movements seeking to form new states from rural counties who are trying to "stop the lawless actions" of the Democratic governors of Nevada and California, Forbes reported.According to USA Today, "New California" claimed its independence in 2018 in a bid to become the 51st state.The brief also alleges that the states took arbitrary actions to change voting laws without consulting their state legislature, which they say violates the Constitution.According to the Associated Press, 17 Republican attorney generals and 106 House Republicans have signed onto the case. 1165
ESCONDIDO, Calif. (KGTV) -- A driver traveling the wrong way on Interstate 15 in Escondido was ejected from her car after crashing into a freeway zipper machine early Wednesday morning.At around 12:45 a.m., the California Highway Patrol received multiple calls about a car going southbound on northbound I-15 near Via Rancho Parkway.Moments later, the CHP was notified that the vehicle crashed head-on into a zipper barrier machine.CHP officials said the female driver was thrown from her car and landed about 30 feet from the wreckage. The woman’s Toyota was completely destroyed on impact.ABC 10News learned the woman was unconscious when she was rushed to the hospital. Her condition is unknown, but she reportedly suffered major injuries.No other passenger vehicles were involved and no other injuries were reported. 828
ESCONDIDO (KGTV) - In one of the closest races this election cycle in San Diego County, Escondido Mayor Sam Abed added nine votes to his narrow lead Tuesday. He now holds a 29-vote advantage over challenger Paul McNamara.Abed is seeking a third term as mayor, first winning in 2010. He was previously a councilman from 2004-2010.Political analyst John Dadian told 10News he did not anticipate the race being so close. "I did not see it coming, so I am suprised. Going into the last week of the campaign, all the people I talked to that really know that area well, they did not see this coming."Dadian feels several factors are playing a role in tightening the race. He cites changing demographics in Escondido, pulling away from the city's long-time conservative majority. Another conservative incumbent, Ed Gallo, appears to be losing his seat, as well.In addition, Democrats in the region had a large turnout, based largely on the unsuccessful effort to oust Congressman Duncan Hunter. That large turnout may have had a down-ballot effect on the mayoral race.Dadian also sites Abed's controversial stance on immigration, leading Escondido's bid to support efforts against California's sanctuary laws and visiting the White House for a highly-publicized meeting with President Trump. Dadian believes that may have helped enthuse opposition against Abed.As of Tuesday night, Registrar of Voters Michael Vu says there are still 299,000 ballots to count county-wide. It is not known how many of those belong to Escondido voters, meaning it will likely be several days until the winner is known. 1630
