She told Christopher Dougherty he doesn’t have the right to prefer his kid’s expenses over his creditors.Today the judge ruled Dougherty will be in Chapter seven bankruptcy, meaning that he and his wife are no longer in charge of their own assets.A trustee will investigate and liquidate those assets.Dougherty is being accused of running a Ponzi scheme targeting mostly elderly victims who planning for retirement and taking more than million, according to bankruptcy court records.In bankruptcy court documents, the United States Trustee wrote Dougherty’s “deception is the basis of a Ponzi scheme.”“[Their] practice of using new investment money to pay existing investors dividends and the principal gave the false impression that the payments received by investors came from earnings and profits or from a return of their principal,” the documents said.The San Diego County Sheriff's Department tells 10News there is a criminal investigation into Christopher Dougherty with at least 30 potential victims.The Securities and Exchange Commission also has an open investigation into Dougherty. 1237

SAN DIEGO (KGTV) -- A 23-year-old man was arrested in connection with a death at a Rancho Pe?asquitos home stemming from a reported fight at the residence.San Diego police said officers were called to a home in the 12500 block of Darkwood Rd. in Rancho Penasquitos just before 4:15 p.m. Wednesday in response to a reported fight at the house.According to police, a man called 911 to report his 23-year-old son, Wyatt Austin Lane, had been in a fight with a guest at their home earlier in the day.Regarding the fight, the father reported that his son told him “the guest had lost and never regained consciousness,” according to police.Officers arrived to find a deceased male inside a bedroom with “apparent trauma to his body,” police said. The victim was not immediately identified.Lane was arrested and booked into County Jail on suspicion of murder.SDPD Homicide Unit detectives are investigating the incident. 921

SAN DIEGO (KGTV) -- A former Yuma Police officer charged with raping a woman in San Diego is coming face to face with his accuser’s mother. Jared Elkins didn’t flinch in court Tuesday as his wife’s cousin accused him of raping her over and over in her Kensington home. The woman says she didn’t yell because the former officer threatened to kill her. After the rape, the victim said in court that she ran into her mother’s room and escaped out a window. Her mother’s 911 call played in court Tuesday. Elkins’ wife was asleep across the hall. Police body cam footage showed the accuser hysterical in the back of the police car. The woman can be heard telling the officer how afraid she was. Elkins argued that the sex was consensual and the rape charges were made out of guilt. Elkins pleaded not guilty. His attorney said he used bad judgement but the sex was consensual and the two were drinking.He’s facing nine felony counts including forcible rape and could serve 14 years in prison if convicted. SAN DIEGO (KGTV) - A day after deliberations began in the wrongful death civil case over a mysterious Coronado mansion death, a jury has reached a verdict.A jury Wednesday found Adam Shacknai responsible in the death of Rebecca Zahau at the Spreckles Mansion in 2011. Zahau's family will be awarded million in punitive damages.Jurors were asked two main questions: Did Adam Shacknai touch Rebecca Zahau (before she died) with the intent to harm her? Did that touching cause her death? Jurors determined "yes" in both instances.The San Diego County Sheriff’s Department said Wednesday that they are standing by their findings that Zahau committed suicide. Escondido Police officers searched his home and seized hundreds of files Walsh had downloaded through peer-to-peer file sharing software.A jury found Walsh guilty of all charges. U.S. District Judge Anthony J. Battaglia said Walsh’s conduct was “on the extreme end of the cases I have seen.”“Today a man who committed terrible crimes against children was sentenced to many years in prison,” said U.S. Attorney Adam Braverman. “These horrible experiences will echo in the hearts and minds of young victims for a lifetime, and I am deeply distressed and deeply committed to pursuing cases that will protect our vulnerable youth from people like Walsh.”“Today’s sentence confirms that this predator can no longer victimize innocent children because he is off the streets and he is offline,” said FBI Special Agent in Charge John Brown. “This investigation showcases the success of collaborative federal and local investigations working toward a common goal.”Walsh will serve his sentence in federal prison. 1208
