SAN DIEGO (CNS) - An ex-con pleaded not guilty to a murder charge today for allegedly stabbing another man in an apparently random attack in a public restroom along the Pacific Beach boardwalk, 16 days after being released from prison.Martin Alvarez, 33, is accused in the Aug. 16 slaying of 39-year-old Michael Wagley, who was found mortally wounded at about 7:30 p.m. on Aug. 16 in the lavatory at 700 Grand Avenue. The victim was taken to a hospital, where he was pronounced dead.Witnesses reported seeing a man fleeing on a bicycle following the stabbing, San Diego Police Department Lt. Andra Brown said.The lieutenant said Alvarez, who matched the suspect description, was detained in the area and later arrested on suspicion of murder.The alleged motive for the slaying was unclear, but a prosecutor said the victim had no connection to his attacker.Deputy District Attorney George Modlin called the stabbing a ``random act of murder'' in which Alvarez allegedly attacked the victim from behind, stabbing him in the neck. The prosecutor said Alvarez then threw Wagley to the ground and stabbed him several more times.Modlin said that following his release from prison, Alvarez failed to report to Post Release Community Supervision and committed the murder 16 days later.It was uncertain what crime Alvarez was serving time for, though the criminal complaint alleges he has prior San Diego County convictions for assault with a deadly weapon and robbery.In addition to murder, Alvarez faces allegations of using a knife in the slaying.He was being held without bail, but a bail review hearing was set for Friday. 1627

SAN DIEGO (CNS) - A man convicted of sex crimes against children in Northern California who was recommended for conditional release to a Pauma Valley home will no longer be considered for placement in San Diego County, prosecutors said Friday.Joshua Cooley, 40, is classified as a Sexually Violent Predator, a designation for those convicted of sexually violent offenses and diagnosed with a mental disorder that makes them likely to re-offend.According to the San Diego County District Attorney's Office, Cooley was convicted in Humboldt County of sex crimes against underage girls.The Department of State Hospitals recently recommended placing Cooley at 15077 Adams Drive after attempts to find a suitable Humboldt County location were unsuccessful, according to the DA's Office.The address is the same location where another Sexually Violent Predator, Joseph Bocklett, was recently recommended for release. San Diego County Superior Court Judge Howard Shore ultimately decided against the placement, ruling that it would bring the 76-year-old Bocklett too close to areas frequented by families.San Diego County District Attorney Summer Stephan lodged a strong objection to Cooley's proposed placement, citing Shore's ruling and the potential risks to the public."Ignoring and overlooking Judge Shore's thorough, thoughtful and well- reasoned conclusions and continuing to consider this location for placement of an SVP is reckless and irresponsible," Stephan wrote in a letter to Liberty Healthcare and the California Department of State Hospitals, which are tasked with locating suitable post-release housing for sexual predators.Stephan wrote that if the placement was considered inappropriate for Bocklett, a senior citizen, the much younger Cooley represented an even greater risk.According to the DA's Office, Liberty Healthcare has stated that the recommendation was made in error, and the Department of State Hospitals no longer feels the Pauma Valley address is a suitable location for Cooley. An Oct. 9 virtual court hearing was scheduled in Humboldt County Superior Court to discuss the proposed placement, but that hearing has since been vacated."This placement would have put children and families at risk, so we went to battle alongside our community, and we prevailed," Stephan said. "I want to acknowledge that the system worked in that the State Department of Hospitals gave serious consideration to our concerns and spared us from an extended legal battle in court. They showed that they care about our community. I also want to acknowledge the SAFE Task Force, led by the sheriff's department, for all their work giving notification and gathering input from the community. As always, the DA Sex Crimes and Human Trafficking Division demonstrated their commitment to keeping our children safe and the community stood firmly with us in stopping this placement." 2888

Single-family home prices decreased 2.2% from 0,000 in June to 5,000 in July, while attached property prices dipped 1.5% from 1,500 in June to 5,000 last month.``The inventory of homes for sale across the county just can't seem to jump-start, although some neighborhoods have been consistently strong,'' said SDAR President Kevin Burke. ``We can be thankful for the continuing economic expansion, low mortgage rates and the recent reduction in the benchmark interest rate by the Fed.''Year-over-year sales declined for both property types, according to the GSDAR. Single-family home sales dipped 3.3% in July when compared to a year ago -- from 2,097 to 2,028, while attached property sales fell 2.8% from 1,055 in July 2018 to 1,025 last month.Year-over-year sales prices increased slightly for both property types. SAN DIEGO (CNS) - Authorities warned the public Friday to beware of crooks who have telephoned Poway-area residents in recent weeks and tried to swindle them out of money by falsely claiming that the victims were in arrears due to outstanding arrest warrants or other obligations to local government coffers."These scammers and impersonators sometimes provide the victims with genuine Sheriff's Department phone numbers, and in the past they have actually used the names of real department employees," sheriff's Lt. Christopher Collier said. "They may sometimes even want to arrange a meeting in the parking lot of a government building or station in an effort to appear legitimate."No employees of the regional law enforcement agency -- or of any other county body -- contact members of the public by telephone to discuss such matters, Collier noted."Nor would any employees ever try to arrange a meeting to allow (a) payment to be made," the lieutenant said. "If you receive a call from a person or persons claiming to be a Sheriff's Department employee, and that person is trying to solicit a payment of some sort, please hang up the phone immediately."Victims of such illicit solicitations are also advised to report the offenses to the Federal Trade Commission at www.ftc.gov, or to local law enforcement if the contact results in an actual loss of money or personal information. 1392

  

SAN DIEGO (CNS) - Councilwoman Barbara Bry jumped into second place Monday in the San Diego mayoral primary election, leapfrogging over Councilman Scott Sherman.The two candidates with the most votes will head to the general election in November, so depending on the final vote count, San Diego voters could be faced with a choice between presumptive front-runner Assemblyman Todd Gloria, a Democrat, and Republican Sherman -- or another Democrat in Bry.The latter option would guarantee San Diego its first Democrat mayor since Bob Filner resigned in 2013 and just the second Democrat elected to the nonpartisan position -- several Democrats served as interim mayors in 2005 and 2013 -- since Maureen O'Connor stepped down in 1992.Bry currently leads Sherman by just nine votes out of 338,673 counted in the race so far -- or .0026% of the vote.With a projected 37,000 provisional ballots left to be counted, and with Sherman's election-night lead of more than 3,000 votes officially made up, the race could prove exceedingly close.If Bry were to gain votes at the same rate as Monday -- which is far from assured -- she would win by just under 500 votes.In the race for City Council District 1, Will Moore maintained his lead over Aaron Brennan for second place.
